WHEREAS, the Pacific Northwest is presently experiencing record-breaking hot weather conditions; and WHEREAS, the National Weather Service has issued an Excessive Heat Warning for the region, including Deschutes County,through 8PM on Sunday, July 4, 2021; and WHEREAS,the current National Weather Service forecast for locations within Deschutes County shows daily high temperatures as high as 109 degrees F (Redmond) and 106 degrees F (Sisters and Bend), and no lower than 95 degrees F through at least July 4, 2021; and WHEREAS,the extreme heat is contributing to already high fire danger within area forests such that Central Oregon National Forests have moved to Industrial Fire Protection Level (IFPL) II as of June 25, 2021; and WHEREAS, water levels in area lakes, reservoirs, rivers and streams are approaching all- time lows, and municipalities within Deschutes County are monitoring water use and encouraging users to implement volunteer reduction efforts due to a shortage of chlorine necessary for treatment; and WHEREAS, the use of fireworks within the region has already caused at least one identified fire, mandating emergency response and substantial water application; and WHEREAS, there is a critical need to preserve water resources and not overly tax existing emergency response capacities within the region; and Page 1 - ORDER NO. 2021-033 WHEREAS, ORS 401.309 and the Deschutes County Emergency Operations Plan (EOP) authorize the county governing body to declare a state of emergency within the county or within a designated portion of the county and to establish procedures to prepare for and carry out activities which are necessary to prevent, minimize, respond to, or recover from an emergency; now therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, hereby ORDERS as follows: Section 1. Pursuant to ORS 401.309 and the Deschutes County EOP, a local emergency is declared to exist throughout Deschutes County due to the significant fire danger occasioned by the record-breaking excessive heat conditions occurring throughout the region and projected to continue through at least July 4, 2021, and likely beyond. Section 2. Pursuant to the authority provided in ORS 480.160,the governing body orders that the use of any and all fireworks as defined by ORS 480.111 within the unincorporated area of Deschutes County during this declared emergency is strictly prohibited. Violations of this Order shall be prosecuted as provided in Deschutes County Code as a Class A violation. Monetary fines imposed shall be no less than the Presumptive and Minimum Fines provided in ORS 153.019. For purposes of these prohibitions,"use"includes lighting, exploding, or igniting in any way. Use of fireworks that are illegal under state law continue to be prohibited at all times. Section 3. As appropriate,Deschutes County will coordinate the implementation,response and recovery of this emergency with local and state jurisdictions. Section 4. This Order is effective upon signing and will remain in effect, unless otherwise amended, revoked or extended, until July 9, 2021. Dated this 30u, day of June, 2021.
