BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON
A Resolution Setting a Public Hearing for the
Proposed Jurisdictional Surrender of Portions RESOLUTION NO. 2022-009
of NW Pershall Way, NW 101" St, and SW
Helmholtz Way to the City of Redmond,
Oregon Pursuant to ORS 373.270.
WHEREAS, by Redmond Resolution No. 2021-36, attached hereto as Exhibit "A" and by this
reference incorporated herein, the City of Redmond has requested surrender of jurisdiction of portions of
NW Pershall Way, NW 101" St, and SW Helmholtz Way located within the Redmond city limits as
described and depicted in the attached Exhibit "A"; now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES
COUNTY, OREGON, as follows:
Section 1. That on Wednesday, February 23, 2022, at 9:00 A.M. in the Barnes and Sawyer
Rooms of the Deschutes Services Center, 1300 NW Wall Street, Bend, Oregon, the Board of County
Commissioners will hold a hearing to determine whether jurisdiction over portions of NW Pershall Way,
NW 10t" St, and SW Helmholtz Way located within the Redmond city limits as described and depicted in
the attached Exhibit "A", will be surrendered to the City of Redmond.
Section 2. Notice of said hearing, in substantially the form marker Exhibit "B", attached hereto
and by this reference incorporated herein, shall be posted in no less than three (3) public places,
including within the city limits of Redmond, for no less than 20 calendar days before the hearing.

RESOLUTION NO. 2021-36
A RESOLUTION OF THE CITY OF REDMOND REQUESTING THE TRANSFER OF CERTAIN
COUNTY RIGHTS -OF -WAY FROM DESCHUTES COUNTY.
WHEREAS, the City Council has agreed to take jurisdiction of certain County roads within the
City limits; and
WHEREAS, pursuant to ORS 373.270(6), the City Council wishes to initiate transfer of such
jurisdiction to the City.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
REDMOND, OREGON, AS FOLLOWS:
SECTION 1: That the City hereby requests that Deschutes County surrender jurisdiction to the
City of Redmond of certain County rights -of -way described in NW Pershall Way Exhibits A and
B, NW 10th Street Exhibits A and B, and SW Helmholtz Way Exhibits A and B attached hereto
as of 12:00 a.m., February 10, 2022.
SECTION 2: That the jurisdiction of Deschutes County over the rights -of -way described in
Section 1 hereof, and for the right-of-way improvements, construction, and repair shall cease
upon transfer of the property to the City of Redmond.
SECTION 3: This resolution shall be effective February 10, 2022.
ADOPTED by the City Council and SIGNED by the Mayor this 11th day of January 2022.

RECOMMENDED MOTION:
Move approval of Resolution No. 2022-009.
BACKGROUND AND POLICY IMPLICATIONS:
With City of Redmond Resolution No. 2021-36, the City of Redmond has requested
jurisdiction of portions of NW Pershall Way, NW 101" Street, and SW Helmholtz Way.
Resolution No. 2022-009 will set a public hearing for the matter to occur during the
Wednesday, February 23, 2022 Board of County Commissioners meeting.
BUDGET IMPACTS:
jurisdictional transfer of the subject road segments will remove approximately 0.26 mile of
road from the County road inventory. This will result in a very minimal reduction to the
Department's operation and maintenance expenditures.
