7. 2022 Legislative Session Planning
PAC West Lobbyist staff Phil Scheuers was present via Zoom conference call
to present the update on the 2022 Legislative Session. The 2022 session is
set for four weeks and weekly updates will be held with the Commissioners.
Mr. Scheuers will send a bill list to review for the upcoming session.

psychiatric hospital.

It has come to my attention that someone is attempting to plan an event at the Deschutes County Fair and Expo
Center in April who does not want Oregon mask wearing regulations to be enforced. I cannot understand how
anyone would want to plan a large gathering of people without masks at this time. It would be unsafe for our
county residents:
I would like assurance that any events held at the Deschutes County Fair and Expo Center, or any other event
center, will have all applicable Oregon regulations enforced.
For any large gatherings, masks must be required according to state regulations and I would prefer that proof of
vaccination be required for entry.

Hello,
I want to state that I think the ordinance is better than nothing, but I have noticed a deterioration in my Sky Quality
Meter values that measures magnitude per square arc -second . So, I think it needs to be more vigorously enforced and
more shade is needed on commercial lighting: I've seen signs up that have no shading at all. We will lose this precious
benefit of living here if this rate of deterioration continues.

SUBJECT: 2022 Legislative Session Planning
BACKGROUND AND POLICY IMPLICATIONS:
The upcoming 35-day legislative session, known as the "short session," begins on February
1. Pac/West Lobby Group will provide an overview of the upcoming session and seek Board
input on potential legislative session priorities.
Staff will also seek direction from the Board on the frequency and timing of legislative
check in meetings during the short session.

State Funding Request for
Deschutes County Circuit Court Addition
Background
During the 2021 legislative session, the legislature approved two new judges for the Deschutes
County Circuit Court through HB 3011. As a result, Deschutes County is moving forward with a
much needed expansion of the Courthouse.
Issue
Located in the State of Oregon's 11th Judicial District, the Deschutes County Circuit Court was
built in 1977 with five courtrooms. In 2004, two additional courtrooms were added. Due to
limited space rn the Courthouse building, Court administrative staff were located into a separate,
,
but connected, building along with the District Attorney's Office. The current court facility
minimally meets current space needs for services to the public and will not accommodate
additional judges. Also, one of the existing courtrooms (Courtroom F), is undersized and does
not meet current needs.
A few options will employed for a short period of time to allow for the two additional judges to
hold court, however these would be wholly inadequate as a permanent solution. With the
addition of the two new judge positions, a courthouse expansion is necessary to add new
courtrooms and staff space.
Proposal — State Funding Assistance
Although counties are responsible for providing courthouse facilities, the state has been
providing funding assistance for county courthouse projects. For example, Multnomah and
Jefferson counties received state bond matching funds for new courthouses. Deschutes County is
requesting state funding assistance through a direct budget appropriation to support expansion of
the courthouse to provide a courtroom and support staff space. The proposed project does not
meet the criteria to use State bond funds.
Proposed Project
Deschutes County owns the property
immediately south of the existing
courthouse. The property is zoned PF,
Public Facilities, and the proposed use
would be an outright permitted use.
Rather than building a one-story
addition to add two courtrooms and
space for support staff, Deschutes
County is proposing to add a multi-
story structure to optimize the limited
land available for expansion, address
current unmet space needs of the
Court, and plan for future needs. Several years ago, Deschutes County worked with Court staff
on initial programming to determine the types of space and square footage that would be
required to meet the needs of the Circuit Court through 2035. The conceptual plan (see picture
above) calls for a three-story addition plus secure basement -level parking, totally 40,000 square
feet. The plan provides for four courtrooms, lobby enlargement and security enhancements,
office space for current and future needs, additional space to expand the jury assembly room and
hearing room, and secure parking for inmate transport and judge parking.
Deschutes County is seeking State assistance to fund construction of an addition consisting of
secure -level parking and three -stories totaling 40,000 square feet. One floor would be used for
Court office space and expanded security and the other floors would house three -courtrooms
initially with room for fourth courtroom to be added in the future. Two courtrooms would be for
the new judges. The third new courtroom would replace existing Courtroom F (which doesn't
meet current needs). Once relocated, Courtroom F would become a hearing room and space for
mediation. The estimated cost for this project is $27 - $28 million. This estimate is based on
other recent courthouse and law enforcement construction projects in Oregon. Once funding is
secured and the project it approved, the project is expected to take 24 - 36 months to complete.
Current Status
The County's Facilities Project Review Committee has reviewed the conceptual design and
budget has recommended that the project proceed with the current concept as the basis for
design. The County has selected an owner's representation firm and a Request for Proposals for
an architectural and engineering team is being prepared.

SUBJECT: Public Health Modernization Funding
RECOMMENDED MOTION:
Move approval of Resolution #2022-001, increasing appropriation and FTE in Health
Services Fund.
BACKGROUND AND POLICY IMPLICATIONS:
On December 1, 2021, Deschutes County Health Services (DCHS) received approval from
the Board to apply for Public Health Modernization funding through the Oregon Health
Authority (OHA), and a total of $2,006,631 is awarded to DCHS Public Health for the 2021-
2023 biennium (see the supplemental email from OHA outlining approved funding
awarded). A contract amendment is forthcoming and will be brought to the Board for
signature. The funds are awarded as follows:
• Program Element (PE) 51-01: Public Health Leadership, Governance, and Program
Implementation ($741,129 + $344,461), which is anticipated ongoing funding.
• PE 51-02: Regional Modernization ($545,261).
• PE 51-03: Workforce Support ($375,780) in one-time funding.
Public Health identified gaps in services that Public Health Modernization funding can fill,
including environmental hazard response, data analysis, congregate setting outbreak
response and education, as well as improving understanding of environmental threats that
have become prevalent in recent years, such as wildfires, wildfire smoke, excessive heat,
drought, and vector -borne communicable disease. Strengthened programming in these
areas will help our community to better respond and adapt to environmental conditions,
which were not as predominant in the past.
The table below outlines awarded funds and the anticipated use of those funds.
Specifically, funds will continue to support existing staff and the department requests 5.0
full-time equivalents (FTE) to support the identified gaps noted above as well as an
extension of the Public Information Officer position from June 30, 2022 to June 30, 2023.
The new positions should be effective as of February 1, 2022 and extend through June 30,
2023.

I was just circling back to you on this. Good news is that we figured out a way to begin the recruitment process with our recruitments all being "'Pending Approval," however, we will still need to go before the Commissioners

Hope you had a great New Year! Our Fiscal Officer asked if OHA could provide us an e-mail or something which listed the total awards for PE 51-01, 52-02, and 51-03 for the Biennium? When we requested permission to apply for
these funds, we were using the total award amounts, so the Commissioners are most familiar with those numbers. We need to request permission to accept the funds (aka budget adjustment), which will also enable us to begin
our recruitment process. A simple e-mail with 51-01, 52-02, and 51-03 amounts listed would work. Thanks for any assistance with this.

A Resolution Increasing Appropriations
And FTE within the 2021-2022 * RESOLUTION NO. 2022-001
Deschutes County Budget *
WHEREAS, the Deschutes County Health Services Department presented to the Board of
County Commissioners on 1/19/2022, with regards to increasing appropriations and creating 5.0
limited duration FTE and extending 1.0 limited duration FTE in support of Public Health
Modernization through funding from the Oregon Health Authority, and
WHEREAS, ORS 294.471 allows a supplemental budget adjustment when authorized by
resolution of the governing body, and
WHEREAS, it is necessary to approve Public Health Modernization funds from the c6oll
Health Authority, and
WHEREAS, it is necessary to increase program expense appropriations by $417,358 and
$126,927 Health Services to accommodate this request, and
WHEREAS, Deschutes County Policy HR-1 requires that a creation of or increase in FTE
outside the adopted budget be approved by the Board of County Commissioners; now therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
DESCHUTES COUNTY, OREGON, as follows:
