Present were Commissioners Patti Adair, Anthony DeBone, and Phil Chang. Also present were Kim Riley,
Assistant County Counsel; Whitney Hale, Deputy County Administrator; and (via Zoom conference call)
Angie Powers, BOCC Administrative Assistant.

CALL TO ORDER: Chair Adair called the meeting to order at 9:00 a.m.
PLEDGE OF ALLEGIANCE
CITIZEN INPUT:
Commissioner Adair acknowledged that Association of Oregon Counties (AOC) Director,
Gina Nikkei and AOC Legislative Affairs Manager, Mallorie Roberts, were in attendance at
the meeting.
Commissioner Adair discussed Citizen Input received via email and voicemail. There were a
total of 65 emails received from community members in opposition to turning Worell
Wayside Park into parking spaces for the Courthouse. Commissioner Adair pointed out that
she was the lone "NO" vote on the conversion of Worell Wayside Park into a parking lot,
and instead supports a two-story parking garage structure on the site of an existing parking
lot. Commissioner Chang said that a downtown parking analysis is currently taking place,

and Worell Wayside Park is the most logical location for additional needed parking.
Commissioner DeBone wanted to clarify that the proposal is for a reconfiguration of the
park, where natural rock features would be maintained, and is not a complete conversion
of the park into a parking lot.
In an unrelated matter, another community member left a voicemail regarding her bill for
Fire and Rescue transport services. Commissioner Chang put Tom Kuhn, with Deschutes
County Health Services, in contact with the caller as he is the point person for the County's
ambulance service area.

Kim Riley, County Assistant Legal Counsel, discussed the proposed annexation.
The Fire District has approved the annexation and Legal Counsel is suggesting
the Board move approval of the annexation, Order No. 2022-048.
Public hearing was opened at 9:08 a.m. No one wished to testify. Public Hearing
was closed at 9:08 a.m. No discussion on the Order.

8. Consideration of Resolution No. 2022-063 Increasing Appropriations within
the 2022-23 Deschutes County Budget
Dan Emerson, County Budget Manager, discussed the policy implications of this
proposed increase in appropriations. The County's entry into a Full Faith & Credit
Obligation for the Negus Waste Transfer Station Project requires this increase in
debt service appropriations. This resolution also corrects under -budgeted
amounts by increasing debt service appropriations in the Fair & Expo Center,
Solid Waste and RV Park. Dan Emerson will send a follow-up to the
Commissioners.

9. Workers Compensation Third Party Administrator Notice of Intent to
Award
Erik Kropp, Deputy County Administrator and Risk Manager, discussed the
County's Notice of Intent to Award to TRISTAR. Sarah Key, Loss Prevention
Coordinator for Risk Management was also in attendance. Deschutes County is
self -insured for its worker's compensation program, and hires a third -party
administrator for claims administration. Three companies responded to the RFP.
One was deemed non -responsive because they only bid on a portion of the

contract. TRISTAR is the incumbent, and scored highest after a comprehensive
evaluation. County Staff recommends TRISTAR continue as the County's third -
party claims administrator. TRISTAR presented alternate options, including
medical only claims and indemnity claims (medical and time away from work).
The contract term will be a three-year contract with the option of two two-year
extensions. This option helps the County with locking in prices, but allows for the
County to go out for a new RFP if the contractor is not performing.
Commissioner Chang stated that the county averages fifty worker's comp claims
per year, and asked staff how many of those claims were COVID-related. Sarah
Key replied that over the past year, approximately four claims were COVID-
related.

• Jen Patterson, County Strategic Initiatives Manager, presented a letter to the
Board for signature. The letter is addressed to Kelly Sparks, Vice President of
Finance and Strategic Planning at Oregon State University - Cascades
campus, thanking her for her service to the community as an advocate for
child care in Deschutes County and as a leader for OSU-Cascades. Kelly is
leaving OSU-Cascades for a new position with the University of Maine.
Commissioners DeBone and Chang recognized Kelly for her contributions in
helping convert a pumice mine landfill into a thriving campus for Central
Oregon and in strengthening the partnership between Deschutes County
and OSU-Cascades. They requested a sentence be added in that respect.

• Commissioner DeBone will attend the Redmond Economic Development Inc.
(REDI) strategic planning session the afternoon of September 21St. The
eastside of Redmond will be discussed: capital investments, dispersed
camping issues, etc.
• Commissioner Chang shared that Janice Garceau, the incoming County
Health Services Director, expressed an interest in attending (virtually) an
upcoming meeting with AOC relating to the reconstitution of the Local
Government Advisory Committee to work with OHA and the State of Oregon
with the aid and assist population.
• Commissioner Adair discussed that a Project Wildfire meeting took place
yesterday, September 20th that was well -attended. The search for the new
County Forester is underway, and she thanked Sgt. Nathan Garibay for
chairing that meeting. She highlighted that there are now 70 Firewise
communities, and commended Project Wildfire for their efforts. One
community will utilize 150 goats to help reduce ladder fuels across ten acres
of land.
• Commissioner DeBone shared that the Land Conservation and Development
Commission (LCDC) is meeting in John Day on Thursday or Friday, and he will
attend in lieu of the AOC District 2 meeting in Madras on Friday. He serves on
the Bylaws Committee, which is currently working on a proposal to change
the bylaws in respect to the election process.
• Commissioner Adair recently met with Cheyenne Purrington, the new
Houseless Strategies and Solutions Director, and highlighted her background
and qualifications.

MEETING FORMAT: The Oregon legislature passed House Bill (HB) 2560, which requires that public
meetings be accessible remotely, effective on January 1, 2022, with the exception of executive

Dear Commissioners,
Please revisit your decision to redevelop Worrell Wayside Park into a parking lot for the sake of an unknown parking
need estimated for some time in the future. As designated by Order No. 97-147, Worrell Park should remain a public
park, preserved and protected for public access and recreation.
This mostly natural area of 1.29 acres is a gem in the heart of downtown Bend. There is nothing else like it. Please keep
Worrell Wayside a Park. Please seek other options for a parking lot, if more parking spaces are really needed.
The park is within close proximity to many businesses and government offices including a day care facility. It is perfectly
located for citizens to use for a conversation or lunch at a picnic table or bench, or a quick run for a child scrambling
along the pathways. Watchable wildlife such as lizards, chipmunks, marmots and deer; hummingbirds, goldfinches, jays
and pollinators; bumble bees, honeybees and butterflies. Why would the County Commission want to redevelop this
natural feature into a parking lot?
Several suggestions and options related to the need for additional parking related to a future courthouse expansion
have been shared with you and your Facilities manager. Please consider these and drop Worrell Wayside as an option.

Be creative and think about the future. Some Parking Options include :
• Keep and utilize the courthouses established at the Fairgrounds in Redmond. This reduces the size of the expansion of
the downtown courthouse and the need for more parking.
• Move some/all fleet parking off the Bend downtown campus to other county locations • Encourage and promote the
remote work policy allowing county employees to work remotely.
• Seek development of parking structures on existing parking lots in thoughtful and phased implementation

As someone who uses Bill Worrell Wayside Park, I want to express my concern that it will soon be a parking
lot: Commissioners Adair and DeBone, 1 ask that you reconsider your vote. There are many reasons to save this park.
My reasons are threefold: I do not want the trees to be destroyed -we need more trees, not less. I do not want the
animals displaced or killed -they add to the enjoyment of the area. Finally, I do not this beautiful park that is enjoyed
by so many of us to be turned into an, ugly parking lot. I know it's more expensive to build a parking garage, but it is
worth it.

I've sent comments before, but must reiterate my strong opposition to destructing Worrell Wayside for any reason, and
in particular for a parking lot.
With more people doing business via Zoom and employees telecommuting, now isn't the time to destroy an
irreplaceable asset for more parking. There are many new and ongoing initiatives to reduce vehicle traffic and
congestion, it seems counterintuitive to encourage more traffic by adding parking.
DON'T do what Joni Mitchell sang about, "you pave paradise, put up a parking lot"!

Shame on our city! This is a historic area of Bend. With all the allowed deforestation and building leading to water
shortages, heat increases, decreased air quality, destruction of natural wildlife habitats, change in cooling patterns in
downtown, what a ridiculous plan it is to put parking here!
I pray you will use your better judgement, long-term community mental health, environmental needs, and preserving
the decreasing natural beauty areas we have around downtown!
People need to walk! Please put the parking lot somewhere else! It does not need to be that close to county buildings.
Our population needs to get outside and exercise! It will not hurt anyone to walk even 5-6 blocks more!

It seems an increasing number of local government decisions are inexplicably sucking the uniqueness and beauty out of
our community. Please leave Worrell Park as is! We are going to need a parking structure sooner rather than later.
Just do it now. It will only get more costly later!
As designated by Order No. 97-147, Worrell Park should remain a public park, preserved and protected for public access
and recreation.
This mostly natural area of 1.29 acres is a gem in the heart of downtown Bend. There is nothing else like it. Please keep
Worrell Wayside a Park. Please seek other options for a parking lot, if more parking spaces are really needed.
The park is within close proximity to many businesses and government offices including a day care facility. It is perfectly
located for citizens to use for a conversation or lunch at a picnic table or bench, or a quick run for a child scrambling
along the pathways. Watchable wildlife such as lizards, chipmunks, marmots and deer; hummingbirds, goldfinches, jays
and pollinators• bumble bees, honeybees and butterflies. Why would the County Commission want to redevelop this
natural feature into a parking lot?

As a resident and tax payer of Deschutes County, I am asking for the commissioners to find an alternate site for
the proposed parking for the courthouse. One of the things that makes Bend a desired place to live, work (and
for others to visit) is the open space and integration with our surroundings. However, there has been a recent
trend of removing this space at an alarming rate. This is an established park that is a treasure for the citizens of
Bend and Deschutes county. There is an impact not only with the loss of the trees and habitat for birds and other
urban fauna, but also a deadening of the soul of this city. This park (as designed) provides trails, picnic tables
and benches offering a wonderful respite for those working nearby, families and individuals as well as tourists.
It exemplifies the "high desertliving that we are famous for and it is my hope that this is an oversight on the
part of the commissioners that they will rectify immediately. It was also clear after looking at this plan that this
redesign would both destroy the spirit of this park AND NOT be sufficient for the actual parking issues. Please
work with your constituents and let us find a different solution.
I recognize the commissioners are individuals and I want to thank Commissioner Patti Adair for understanding
the importance of this and voting against it.

Worrell Wayside, a county park set aside nearly 25 years ago, "preserved and protected for public use," sets on
an outcropping of relatively recent volcanic rocks from the early times of Newberry Monument, and is presently
occupied by a beautiful selection of native plants and animals. It's located just a stone's throw north from the
courthouse.
But then, you know this, right?
This is a publicly owned park. if the commissioners do not respect the will of the majority of the people, what
other natural areas will be at risk of being destroyed? But then, you understand this too.
YOU CAN and will do better. Find parking elsewhere, no need to worry about running from car to building in

1 would implore the council to not develop the Worrell Wayside park. I am sure there are other options to provide
parking - or even better- discourage driving in the area. Once public open space is gone it is gone forever. The school
district learned this lesson when they tried to sell Troy Field and even the city when it tried to rezone the mirror pond
parking lot for development. Please consider other options - even if they cost more in the short term (although ;.
promoting bike/ped/transit options would be very cheap). There is a lot of land around the current building for a

Will you please reconsider the ridiculous notion of paving over little Worrell Park in favor of more tarmac and

people that would take pictures in the gazebo just after they got married at the courthouse.. Bill Worrell was a
great citizen in Bend. He did wonderful things for the city of Bend. I went to his passing services. I've never
seen so many people at a funeral. I hope it's not turned into a parking lot. What can I do to stop this?

While Worrell Wayside my appear to be a under utilized park, it is a small piece of what makes Bend so unique. A great
little pocket of nature in a place where you would not expect it.
It is also a nice reprieve for those spending time at the courthouse while going through stressful times.
I believe turning this park into a parking lot is simply a short sighted and an all around bad idea. More parking isn't
needed, more carpooling and bike riding is. Want to see a healthier future? Then lets stop working to make
driving/parking convienent and start promoting biking, walking, public transit and carpooling.

Please do not level Worrell Wayside for parking.
This is a case of our local government seeking to trade a valuable and increasingly rare natural area for fewer parking spaces than will ultimately be
needed. Devaluing an iconic remnant of our native environment right in our down -town by allegedly referring to it as "a rock pile", is an example
of some shortsighted vision and values by the development community. Our commitment to keep natural areas amid the development is a big part of
the feel and livability of our growing city. A move to change the status of a publicly owned county park should require a public vote.
The new county buildings could lead the way by using the money it would take to demolish this tiny living spec of high desert toward creating
-parking under the new buildings. Leave this small island of lava, junipers and sagebrush, as was promised, a public park, and a remembrance of a
citizen who made a significant contribution to our amazing community.
Don't let our future citizens say, "They paved paradise, put up a parking lot"

lot. As a self-proclaimed "Bend advocate", I cannot help but think this destroys one of the many reasons that
have led so many of us to choose to call Bend home. Growing up here in Bend, it was the little parks where my
friends and I ate lunch or climbed trees. Today, it is these spaces that help remind us all that we are still a
beautiful mountain town.. if we eliminate these spaces from our core, we risk losing that space in people's

Worrell park is dear to my heart and full of memories. I've never had trouble finding parking near the courthouse: Do
not turn this precious green space into another parking lot.
Please revisit your decision to redevelop Worrell Wayside Park into a parking lot for the sake of an unknown parking
need estimated for some time in the future. As designated by Order No. 97-147, Worrell Park should remain a public
park, preserved and protected for public access and recreation.
This mostly natural area of 1.29 acres is a gem in the heart of downtown Bend. There is nothing else like it. Please keep
Worrell Wayside a Park. Please seek other options for a parking lot, if more parking spaces are really needed.'
The park is within close proximity to many businesses and government offices including a day care facility. It is perfectly
located for citizens to use for a conversation or lunch at a picnic table or bench, or a quick run for a child scrambling
along the pathways: Watchable wildlife such as lizards, chipmunks, marmots and deer,• hummingbirds, goldfinches, jays
and pollinators; bumble bees, honeybees and butterflies. Why would the County Commission want to redevelop this
natural feature into a parking lot?
Several suggestions and options related to the need for additional parking related to a future courthouse expansion
have been shared with you and your Facilities manager. Please consider these and drop Worrell Wayside as an option
for additional parking.
Be creative and think about the future. Some Parking Options include
• Keep and utilize the courthouses established at the Fairgrounds in Redmond. This reduces the size of the expansion of
the downtown courthouse and the need for more parking.
• Move some/all fleet parking off the Bend downtown campus to other county locations • Encourage and promote the
remote work policy allowing county employees to work remotely.
• Seek development of parking structures on existing parking lots in thoughtful and phased implementation

As I wrote early -on to Comm. Phil Chang, we are opposed to the destruction of this gorgeous, central, useful,
NATURAL park.
That pretty much sums up our request that you drop the plan for another large parking area when the longer
range plans for the county are to encourage walking, biking, etc.
As 1 see the worldwide flooding such as has disastrously occurred in Pakistan in recent days, I am further
enraged that our country cannot curb our demand for fossil fuels and our individual use of them.
Do you Part, or perhaps soon to be perhaps, new commissioners will do your job for you, Think, act long range
add, a level to the current county parking garage.
I like parking in the county parking lot, or the DCL lot and walk all over downtown Bend for my errands. I
used to enjoy a sack lunch in the DCL area; but alas, benches were removed. SO, Worrell Park became a better
place.
We moved here from Roseburg in 1973 when my husband became the County Mental Health Director of a very
small staff Without the support of Comm Bob. Montgomery and Al Young, the clinic would have remained
underfunded and understaffed.
This info may seem unrelated? It is not: what makes Bend a superb place to raise families are places like
Worrell Park and commissioners who think LONG Range. Our son, whom you may know, Aaron Henson and
his wife Sara were even able to move back to Bend for their professional careers AND to raise our 2 grandsons,
now at COCC and U of O.
For years I walked to my job at the COCC library - walkable from off Shevlin Park road. After I left for
another career, I missed those sometimes snowy starts to my day. Let's keep what we can of our community's
special places.

Bend needs to maintain its open natural spaces. I recently read in the news a proposal to tear apart Worrell Park
for a parking lot.
This proposal brings to mind a song Joni Mitchell penned "they paved paradise and put up a parking lot.:
Don't it always seem to go that you don't know what you've got til it's gone. They paved paradise and put up a
parking lot. She penned this song in 1970 yet we have not yet seemed to have learned these lessons. I hope
Joni Mitchell's wise words speak to our city commissioners and they will reconsider:
This space as a parking lot destroys habitat for wild animals that have adapted to urban living. It would also
eliminate a peaceful stop for lunch or a quick walk during the working hours. A $2.5 million project is a lot of
money for just adding parking (makes me sick to my stomach thinking about programs that are under-resourced
that actually help people).
Have other alternatives been considered such as utilizing the parking garage, or the lot at the Old Elks lodge, or
charging for parking to encourage carpooling, use of public transportation or biking during the good weather
seasons? I am not against expanding the court house but adding parking and removing our nature spots detracts
from what Bend is and should continue to be, Before we know it we will be just another city in the USA all
cement with no natural habitat to speak of Keep Bend beautiful -keep our parks.
I was born and raised in Bend and have dedicated my adult years and raising my child here as well, about 41
years all in. In recent years we have had a huge influx of new residents and with that new developments for our.
land use- like a big city they moved away from. If we want to maintain the beauty we all love to live here for
we need to keep all these special open outdoor nature spots. As human nature is with one park compromised it
opens the door to other spaces.
Chang, DeBone and Adair I hope you will reconsider and perhaps use these funds to campaign for carpooling,
incentives to use public transportation and biking:

all crave, love and need in our lives, especially Worrell Wayside Park.

dont use the ones we have here now. With Covid lots of office buildings arent even being used, put homeless in there so

I am writing to register my concern over the plans to basically destroy the wonderful habitat that is Worrell
Wayside Park. The proposed leveling and reducing the area to add parking, spaces will strip this site of its
beauty, history and purpose,
Surely we can save this little oasis within the city, and preserve the habitat that has sheltered and fed deer,
pollinators and all sortsof critters. But most important is the need to preserve this natural landscape for the
humans who have been enjoying this park for 25 years! How can a registered park even be considered for
destruction?? Bend is attempting to Go Green; removing native landscape to pave it for parking is the exact
opposite. You already know this, so please put your heads together and come up with an alternative plan to
increase parking, if that is indeed necessary (which many claim is not). Put the walk in the talk, and SAVE
WORRELL WAYSIDE PARK!!

Please reconsider this important issue. Razing this park to create parking is a shortsighted "solution." It's not just about
the money. Unlike many of our other parks, this is a relatively natural space and should be preserved for lots of good
reasons.
And yes, I have been impacted by parking shortages near the courthouse and once paid a ticket. Please consider other
ways to solve these problems.
