BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON
An Order Denying a Request to Reopen the
Record for File Nos. 247-23-000614-CU, 247- * ORDER NO. 2024-032
23-000615-SP, 247-24-000292-A
WHEREAS, the Board of County Commissioners ("Board") is the hearings body for a an
appeal of a Hearings Officer decision denying a Conditional Use Permit and Site Plan Review to
establish a psilocybin service center (File Nos. 247-23-000614-CU, 247-23-000615-CU, 247-24-
000292-A); and
WHEREAS, on July 17, 2024, the Board held a public hearing on the proposal, at the
conclusion of which the Board closed the public hearing and allowed an open record period that
concluded on August 7, 2024;
WHEREAS, DCC 22.24.160(A) grants the Board discretion and authorityto reopen the record
either upon request or upon its own initiative;
WHEREAS, on August 12, 2024, the Board received a written comment with a request to
reopen the hearing record; and
WHEREAS, the Board considered the request on August 21, 2024, and determined parties
had ample opportunity to provide comment through public hearings and written comments
throughout the duration of the hearing process and reopening the record is not necessary; now,
therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, HEREBY
ORDERS as follows:
Section 1. Pursuant to DCC 22.24.160(A), the record of the subject appeal shall not be
reopened to accept new testimony.
