1. Welcome and Introductions
Chair DeBone called the meeting to order at 8:00 a.m.
2. Consideration of Resolution No. 2025-034 correcting a scrivener's error and
replacing Resolution 2025-007 - Cam Sparks
Cam Sparks, Budget and Financial Planning Manager, highlighted a scrivener's error
on Board Resolution 2025-007, approved by the Board on June 18. Resolution 2025-
007 incorrectly reads that the Transfers Out of the Transient Room Tax Fund be
increased by $161,800 and Program Expense be increased by $71,000. Board
Resolution 2025-034 corrects this error and correctly states that Program Expense
will be increased by $161,800 and Transfers Out will be increased by $71,000. It is
necessary for this correction to be made prior to the end of the fiscal year on June
30.

3. Consideration of a Notice of Intent to Award a contract for the Tumalo Road
Paving Project - Cody Smith
Cody Smith, County Engineer and Assistant Director Road Department, reported the
Road Department recently solicited bids for the Paving of Tumalo Road: Cline Falls
Highway to Tumalo Place project. Smith described the scope of the project. Three

bids were received, and the Road Department proposes to award the contract to
the apparent low bidder, Tri County Paving, LLC, in the amount of $2,150,814.50.
The project will begin in late July, with a projected completion date of September 30.

Intent to Award contract for the Paving of Tumalo Rd: Cline Falls Hwy
to Tumalo PI, to Tri County Paving, LLC, in the amount of
$2,150,814.50.

4. Commissioner Updates
Commissioner Adair thanked Representatives Breese -Iverson and Levy for their
advocacy in securing $5.2 million in funding for the juniper removal bill. She shared
that only three insurance companies are writing homeowners policies for homes in
the city of Sisters, so there is a lot of work ahead.
Commissioner DeBone reported that $10 million in CORE3 funding is a component
of the Capital Construction bill and described this critical need as a statewide asset.
Commissioner Chang highlighted $3.1 million in funding secured for a child
psychiatric facility for our region. Among others, he credited Holly Harris for her
efforts.
5. Updates from NW Policy Advocates
Doug Riggs spoke about the final days of the session. Related to the Christmas Tree
Bill, Central Oregon did quite well. $10 million in CORE3 funding was secured.
Overall, approximately 80% of projects were unfunded.
Riggs summarized some successes. $5.2 million for juniper removal and water
restoration was secured, which includes funding for COIC to coordinate the projects
and the allocation of monitoring funding. $3 million for an inpatient child psychiatric
facility represents progress towards a key gap in service. Mosaic Medical Center
received $4 million for their clinics. Crook County received funding for their
courthouse. Many requests by cities for housing infrastructure went unfunded.
A slightly modified version of the transportation bill, HB 2025, passed through the
Transportation Committee on Reinvestment. Modifications removed the sales tax

on new and used vehicles and removed the inflationary adjustment that had been
added into the gas tax increases resulting in a 12-cent gas tax increase. It is unclear
whether it will pass in the House or Senate.
A second Christmas Tree bill, HB 5548, is scheduled for Ways and Means today. A
wildfire funding mechanism passed, as a tax on tobacco pouches with an estimated
$40 million per year to be raised. Including this package, the legislature will set aside
$260 million per biennium for wildfire fighting and mitigation efforts. Moving
forward, the legislature will seek a more permanent funding mechanism.
Commissioner Chang added that interest from the Rainy -Day fund will be part of
this funding.
Corey Barber reported that $60 million will be raised over the next two years from
the sales of nicotine pouches.
The rural ADU bill, SB 75, has been held hostage in the House Rules Committee.
Rep. Levy's motion passed nearly unanimously and managed to get SB 83, the
- wildfire maps repeal bill, through committee. It is on its way to Governor Kotek's
desk. Subsequently, SB 75 was then released, and will also hopefully make it to the
governor's desk.
The Transient Lodging Tax (TLT) bill got through committee and through the House
by one vote. However, it did not make it through the Senate Finance Committee, so
this bill appears to be dead and will not move forward this session.
HB 2005, the Aid and Assist bill, is on its way through. Community Corrections
funding is one of the key disappointments this session but there may be something
in the final Christmas Tree bill. The E Board has set aside $500 million in reserve
funding, which may be another opportunity for Community Corrections. Counties
will need to make difficult budget decisions.
Related to groundwater management areas and groundwater areas of concern,
Peter Gutowsky asked about the status of SB 1154. Riggs reported that it has its
third reading today and has passed the Senate. It still needs to pass the House and
if so, it will move onto the governor's desk.
Commissioner Chang asked about the future of the transportation bill with some
legislators reportedly leaving the Capitol. As the bill is a tax, three -fifths of the body
is required to pass the bill. This supermajority requirement is a complicating factor,
and the bill's path to victory is difficult to discern.
HB 5548 is a second Christmas Tree bill and is scheduled for a Ways and Means
hearing today.

Responding to Commissioner Adair, Riggs is doubtful that the $2.5 million in
Terrebonne sanitary district funding will show up in the second Christmas Tree bill.
Additionally, Riggs has not seen the breakdown amongst three allocations for
County Fair funding, but AOC may have some answers.
Commissioner DeBone thanked Northwest Policy Advocates for their representation
of Deschutes County this session. He noted the Board of Commissioners is not
meeting for a few weeks, and there will be a Legislative Session debrief.
Commissioner Chang reported thatJuly 11 through 14 is the NACO Annual
Conference, and he shared that the Board of Commissioners can identify a voting
delegate. Commissioner Chang will be attending the conference, and proposed he
serve as a voting delegate for Deschutes County if a majority of the Board is
supportive. Some potential items to vote for include a perennial resolution to
extend Medicaid benefits to incarcerated individuals, and a perennial resolution to
increase PILT payments to small population counties.
While acknowledging a difference of opinion overall, Commissioner DeBone
supported Commissioner Chang's voting representation. Commissioner Adair did
not support, noting that Oregon already has 34% of its population receiving
Medicaid and she doesn't support extending Medicaid benefits to incarcerated
individuals. Commissioner DeBone directed Commissioner Chang to proceed as the
voting delegate for Deschutes County at the Annual NACO Conference.
Riggs reported that tax foreclosure bill, HB 2089, has passed. The water transfer bill,
SB 1153, is not moving forward. There is $1 million in the Christmas Tree bill for wolf
depredation.
Lee Randall provided an update on HB 2688, which expands the prevailing wage to
offsite fabrication of certain materials. Riggs reported this bill has not yet hit the
House or Senate floor and is opposed by LOC and AOC. The bill does not define its
terms, leaving it open to interpretation and leading to high costs.
Commissioner Adair noted that Oregon has the fewest retail pharmacies per capita
in the nation. Related to pharmacies in rural Oregon, Emma Innes confirmed that no
legislation ended up moving forward.
Commissioner DeBone spoke about residency requirements for Deschutes County
Sheriff candidates. Dave Doyle said that residency is required at the time of
appointment, and if they wish to run for office they must have maintained residency
for one year prior to the election. Commissioner DeBone said that he misspoke

about residency requirements during a radio interview yesterday and wished to
acknowledge.

WHEREAS, the Deschutes County Budget & Financial Planning Manager presented Fiscal
Year 2025 budget adjustments to the Board of County Commissioners on June 18, 2025, for
increased appropriations within the Deschutes County Budget to account for changes that have
occurred since budget adoption, and
WHEREAS, ORS 294.471 allows a supplemental budget adjustment when authorized by
resolution of the governing body, and
WHEREAS, ORS 294.463 allows the transfer between appropriation categories within a
fund when authorized by resolution of the governing body, and

to Award Contract for the Paving of Tumalo Rd: Cline Falls Hwy to Tumalo PI
RECOMMENDED MOTION:
Move approval of Order No. 2025-024.
BACKGROUND AND POLICY IMPLICATIONS:
Deschutes County Road Department prepared bid solicitation documents for the Paving of
Tumalo Rd: Cline Falls Hwy to Tumalo PI project. The project scope of work includes
construction of new asphalt concrete pavement, cold plane pavement removal, installation
of permanent pavement marking and delineation, and incidental work. The project was
advertised in the Daily Journal of Commerce and The Bulletin on May 28, 2025. The
Department opened bids at 2:00 P.M. on June 11, 2025.
Three (3) bids were received for this project. The bid results are as follows:

This action issues a Notice of Intent to Award the contract to the apparent low bidder, Tri
County Paving, LLC, and allows seven days for concerned parties to protest the award. If
there is no protest within the seven-day period, the contract will be awarded to the
apparent low bidder. The bid tabulation, including the Engineer's estimate, is attached.
BUDGET IMPACTS:
The project is budgeted in the Road CIP (465) Fund for Fiscal Year 2026.

Contract for Paving of Tumalo Rd: Cline Falls Hwy to Tumalo PI
To Whom It May Concern:
On June 27, 2025, the Board of County Commissioners of Deschutes County, Oregon considered proposals for the
above -referenced project. The Board of County Commissioners determined that the successful bidder for the project
was Tri County Paving, with a bid of Two Million OneHundred Fifty Thousand Eight Hundred Fourteen and 50/100
Dollars ($2,150,814.50).
This Notice of Intent to Award Contract is issued pursuant to Oregon Revised Statute (ORS) 279C.375. Any entity which
believes that they are adversely affected or aggrieved by the intended award of contract set forth in this Notice may
submit a written protest within seven (7) calendar days after the issuance of this Notice of Intent to Award Contract to
the Board of County Commissioners of Deschutes County, Oregon, at Deschutes Services Building, 1300 NW Wall Street,
Bend, Oregon 97703. The seven (7) calendar day protest period will end at 5:00 PM on July 4, 2025.
Any protest must be in writing and specify any grounds upon which the protest is based. Please refer to Oregon
Administrative Rules (OAR) 137-047-0740. If a protest is filed within the protest period, a hearing will be held at a
regularly -scheduled business meeting of the Board of County Commissioners of Deschutes County Oregon, acting as the
Contract Review Board, in the Deschutes Services Building, 1300 NW Wall Street, Bend, Oregon 97703 within two (2)
weeks of the end of the protest period.
If no protest is filed within the protest period, this Notice of Intent to Award Contract becomes an Award of Contract
without further action by the County unless the Board of County Commissioners, for good cause, rescinds this Notice
before the expiration of the protest period.
