BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON
An Order Accepting Review of Hearings
Officer's Recommendation in File No. 247- * ORDER NO. 2025-040
25-000106-TA.
WHEREAS, on June 16, 2025, a public hearing was held before a Hearings Officer regarding
File No. 247-25-000106-TA; and
WHEREAS, pursuant to Section 22.28.030(A) of the Deschutes County Code ("DCC"), the
Hearings Officer has authority to make a decision on a proposed quasi-judicial Text Amendment
unless that decision is appealed or called up by the Deschutes County Board of County
Commissioners ("Board") for review; and
WHEREAS, the Hearings Officer in File No. 247-25-000106-TA determined that the proposed
quasi-judicial Text Amendment involves issues of policy on which the Board should have the final
decision and therefore will issue a recommendation, rather than a decision; and
WHEREAS, DCC Section 22.28.050 provides the Board discretion on whether to initiate
review of File No. 247-25-000106-TA prior to an appeal being filed; and
WHEREAS, the Board has given due consideration as to whether to initiate review of this
application; now therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, HEREBY
ORDERS as follows:
Section 1. That it will initiate review and hear file no. 247-25-000106-TA pursuant to Title
22 of the DCC and other applicable provisions of the County land use ordinances.
Section 2. The Board hearing shall be de novo.
Section 3. Staff shall set a hearing date and cause notice to be given to all persons or
parties entitled to notice pursuant to DCC 22.24.030 and DCC 22.32.030.
