CALL TO ORDER: Chair DeBone called the meeting to order at 9:00 am. PLEDGE OF ALLEGIANCE CITIZEN INPUT: • Jason Bynon said the hearing held last week before the Dog Control Board of Supervisors was unfair. He requested a new hearing before the order which requires the euthanization of five Rottweilers owned by Michael Winner is enacted. Authorization to apply for the Oregon Criminal Justice Commission Behavioral Health Deflection Program grant Captain Michael Shults reminded that HB 4002 allows for the deflection of certain low-level crimes by eligible persons who are addicted to drugs and who agree to enter into a treatment plan. The Sheriff's Office partners with service providers Ideal Options and BestCare to administer this program. Shults said in addition to persons who are taken into custody for criminal activity, the program also treats others by referral. Jessica Vanderpool, Management Analyst, said the grant from the Criminal Justice Commission will be received in two phases, with the first one amounting to $311,000 and the second one becoming available in October. Public Hearing: Text Amendments for Repeal of the State Wildfire Hazard Map Will Groves, Planning Manager, said because Oregon's statewide Wildfire Hazard Map has been repealed by the Legislature, the County must now update its Code to align with the changed regulations and remove associated language which is no longer applicable. Discussion ensued regarding the opportunity now before the County to establish local standards for wildfire resiliency. Groves said the updated R327 standards (State building code) can only be applied to new construction. The State Fire Marshal is working to develop recommended regulations for local jurisdictions to consider regarding defensible space requirements. The public hearing was opened at 9:18 am. There being no one who wished to testify, the public hearing was closed at 9:18 am. Noting the consensus of the Board to immediately proceed to deliberations, Commissioner DeBone said when Deschutes County formerly compiled a county- wide wildfire hazard map, the conclusion was that the entire county is at high risk for wildfire. It therefore does not make sense to distinguish between adjacent properties in terms of higher or lower wildfire risk as the State's map did. Commissioner Adair urged implementing local regulations as soon as possible so that fire hardening standards are applied to new construction. Groves agreed this is a high priority item for the Planning division. Commissioner Chang advocated for the opportunity to add ADUs to increase housing availability and supported the development of local regulations to ensure that property owners take action to create and maintain defensible space for the benefit of themselves and their neighbors. Noting that houses in rural areas are much farther apart than they are in cities, Commissioner Adair said under the State's map, over 21,000 properties were labeled as high risk for wildfire, yet all properties in Deschutes County are at high risk. She agreed that property owners must keep their land clear of yard debris and further should treat wood fencing with protective coating to deter burning. BOCC MEETING AUGUST 13, 2025 PAGE 3 OF 5 Commissioner DeBone supported heightened awareness of constructing structures to resist fire and of the need to reduce flammable fuels, saying that on red flag warning days such as today, any spark or ember could potentially start a fire. Saying it is important to build homes as safe as possible, Commissioner Adair suggested offering incentives for the removal of juniper trees and shared that property owners can rent goats to help rid land of unwanted vegetation. BACKGROUND AND POLICY IMPLICATIONS: The Deschutes County Sheriff's Office is seeking to apply for BHD grant funding. Phase 1 funding is $311,908 for Deschutes County. Phase 2 formula had not been finalized yet. State of Oregon House Bill (HB) 4002 created a new misdemeanor for possession of a controlled substance. HB 4002 offers pathways to expungement, dismissal, or no charges filed, and encourages distract attorneys and law enforcement to divert a person, in lieu of arrest or prosecution, to a deflection program. A deflection program is a collaborative effort between law enforcement agencies and behavioral health systems that strives to aid individuals in receiving treatment, recovery support services, housing, case management, and/or other services. On July 23, the Board of County Commissioners gave approval to award a contract with Bestcare and Ideal Option related to this program. This grant application was also discussed. Phase 1 application will be submitted by August 315t. Disbursement will be in September. Phase 2 application process will begin in October with disbursement coming in December. BUDGET IMPACTS: The estimated $800,000 in revenue is included in the adopted budget.
