2025-355-Order No. 2025-051 Recorded 11/3/2025REVIEWED LEGAL COUNSEL Recorded in Deschutes County CJ2025-355 Steve Dennison, County Clerk 11/03/2025 8:28:04 AM Commissioners' Journal BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON An Order Designating the Deschutes County Property Manager, Kristie Bollinger as the Deschutes County representative for the purpose of signing documents associated with releasing a deed restriction encumbering real property located at 835 E Hwy 126, Redmond, Oregon 97756 and known as Map and Tax Lot 151315BDO0300 * * ORDER NO. 2025-051 * * WHEREAS, the Board of County Commissioners of Deschutes County has authorized releasing a deed restriction encumbering real property consisting of +/- 3.21-acres located at 835 E Hwy 126, Redmond, Oregon 97756 and known as Map and Tax Lot 151315BD00300; and WHEREAS, in 1966, Deschutes County conveyed +/- 26.18-acres located at and adjacent to 835 E Hwy 136, Redmond, to the Opportunity Foundation for $10; and WHEREAS, the 1966 conveyance deed included a deed restriction limiting the use of said real property to educational and training purposes; and WHERAS, the Opportunity Foundation wishes to sell +/- 3.21-acres of said real property in 'a private sale; and WHEREAS, to proceed with the private sale, the Opportunity Foundation has requested the encumbering deed restriction be released by the County; and WEHREAS, the County and Opportunity Foundation have agreed to the County receiving 10% of the sales proceeds; now, THEREFORE, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, HEREBY ORDERS as follows: Section 1. The real property was originally acquired by the County from the Federal government by land patent for zero dollars. The Opportunity Foundation wishes to sell +/- 3.21-acres of said real property to a private buyer. However, the 1966 conveyance deed included restrictive language that limits the use of said real property to educational and training purposes. To proceed with the private sale, the Opportunity Foundation has formally requested the encumbering deed restriction be released by the County. The County and the Opportunity Foundation have agreed to the County receiving 10% of the sales proceeds. BUDGET IMPACTS: County will receive 10% of the sales proceeds, which will be received in the Project Development Fund (Fund 090) ATTENDANCE: Erik Kropp - Deputy County Administrator
