Luke EXCERPT OF MINUTES OF WORK SESSION Mike Daly DESCHUTES COUNTY BOARD OF COMMISSIONERS MONDAY, JULY 23, 2001 Present were Commissioners Dennis Luke and Mike Daly; Commissioner Tom De Wolf was excused. Also present were Mike Maier, County Administrator; Jenny Scanlon and Ted Schassberger, Commissioners' Office; Tom Anderson, Damian Syrnyk, Pat Kliewer, Kevin Harrison, Barbara Rich and Paul Blikstad, Community Development; Rick Isham, Laurie Craghead and Mark Amberg, Legal Counsel; Tom Blust, George Kolb and Gary Judd, Road Department; Becky Jackson, Parole & Probation; Debi Harr, Commission on Children & Families Tammy Credicott, Property Management; Jeff Mullins of KBND Radio; and eleven citizens. Acting Chair Mike Daly opened the meeting at 10: 00 a.m. 1. Before the Board was Citizen Input. A. Duffy Sweeney, a resident of Crooked River Ranch, explained that there is a big traffic in his neighborhood problem ranging over a four-year period that is a jurisdictional problem, due to the location of the county line within Crooked River Ranch. He and his neighbors have attempted to address this problem through Crooked River Ranch Association first, without success; they then went to Jefferson and Deschutes Counties for help. (He then provided a three-page explanation and a copy of a petition signed by his neighbors to all members of the Board.) Commissioner Luke said that part of this area is in Deschutes County, and some is in Jefferson County. He asked for more specifics on the problem. Quality Services Performed with Pride Mr. Sweeney said that they have counted over 100 cars a day between 7 a.m. and 4 p.m., going between 30 and 60 miles per hour in a 25 mile per hour zone. Their petition asked for, and Crooked River Ranch turned down, a barrier at the county line with a removable post in middle. He explained it is a real safety hazard, and that this situation probably generated twenty or more calls to the Sheriff every week. He then presented an oversized map for the Board to review. Tom Blust also presented an oversized map of the area, which was then discussed. Mr. Sweeney and Tom Blust then adjourned to another room to discuss the situation further. 2. A PUBLIC HEARING (TODAY ONLY- continued from an earlier date) of Appeal #A-01-10 of the Hearings Officer's Decision to Deny a Variance to the Density and Open Space Standards to Add Lots in an Existing Planned Unit Development (Odin Falls Ranch). This public hearing will be held at 11:00 today. The minutes from the hearing will be published separately. 3. Before the Board was Discussion and Consideration of Whether to Rescind Order No. 2001-073, and Hear an Appeal De Novo from SBA Communications, Inc., regarding the Establishment of a Wireless Telecommunications Facility in the Sunriver Business Park. Damian Syrnyk explained that this was brought forward a few weeks ago after the receipt of an appeal from SBA. The Board originally decided to hear the appeal on the record, as there was not enough time to hear de novo. SBA has asked for an extension of time so that the Board can hear it de novo. LUKE: Is this a different one ? Thought we did this one. CRAGHEAD: You had decided to hear this one on the record. They are asking for you to hear it de novo and have waived the time limit. You are also hearing the Mericom case de novo. They wish for you to hear both on the same day, as it encompasses the same issues and they are using the same attorney. LUKE: I move hear this appeal de novo. DALY: I second. VOTE: LUKE: Yes. DALY: Acting Chair votes yes.
