ORDER NO. 2001-086 WHEREAS, by Resolution No. 2001-40, the City of Redmond has requested surrender of jurisdiction of Umatilla Avenue, 43d Street, Forked Horn Butte, Salmon Avenue, 41St Street, Timber Avenue and NW 19th Street located within the Redmond city limits, as set forth in Exhibit "A" attached hereto and by this reference incorporated herein; and WHEREAS, the Board of County Commissioners finds that it is in the public interest to surrender jurisdiction and accept the request set forth in Resolution No. 2001-40 of the City of Redmond, dated the 24th day of July, 2001; now, therefore, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDERS as follows: Section 1. That effective as of 12:00 AM, August 10, 2001, the Board of County Commissioners hereby surrenders jurisdiction of Umatilla Avenue, 43d Street, Forked Horn Butte, Salmon Avenue, 41St Street, Timber Avenue and NW 19th Street in Resolution No. 2001-40 of the City of Redmond, attached hereto as Exhibit "A", to the City of Redmond. Section 2. From and after 12:00 AM, August 10, 2001, the road described in Exhibit "A" shall be a City of Redmond street. DAL Y, COMMISSIONER Page 1 — Order No. 2001-086 — Umatilla Avenue, 43rd Street, Forked Horn Butte, Salmon Avenue, 41 st Street, Timber Avenue and NW 19th Street EXHIBIT "A" REDMOND RESOLUTION RESOLUTION NO. 2001-40 A RESOLUTION OF THE CITY OF REDMOND REQUESTING THE TRANSFER OF CERTAIN COUNTY RIGHTS-OF-WAY FROM DESCHUTES COUNTY. WHEREAS, the City Council has agreed to take jurisdiction of certain County roads within the City limits; and WHEREAS, pursuant to ORS 373.270(6), the City Council wishes to initiate transfer of such jurisdiction to the City; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF REDMOND, OREGON, AS FOLLOWS: Section 1. That the City hereby requests that Deschutes County surrender jurisdiction to the City of Redmond of certain County rights-of-way described in Exhibit "A" attached hereto as of 12:00 AM, August 15, 2001. Section 2. That the jurisdiction of Deschutes County over the rights-of-way described in Section One hereof, and for the right-of-way improvements, construction, and repair shall cease upon transfer of the property to the City of Redmond.
