The designated speed of 35 m.p.h. be assigned to all of Cody Road. Section 2. That the County Road official erect appropriate signing according to ORS 810.200 requirements giving notice of the established speed. Section 3. Cody Road and Donna Lane are located approximately 5 miles east of Bend and are accessed from Bear Creek Road. Cody Road is a stub road and serves as access to Donna Lane. Both roads are paved and maintained by the Deschutes County Road Department. Deschutes County has been delegated authority, by the State of Oregon, to establish speed zoning on low volume (less than 500 vehicles per day) and/or unpaved County roads. This authority was granted under the condition that the County follows the engineering principles of and the criteria adopted by ODOT for the investigation and establishment of speed zones. INVESTIGATION OF THE REQUEST The Road Department conducted field speed studies on Cody Road and Donna Lane. The complete results of the studies are in the attached report. The studies consisted of measuring the speed and volume of vehicles using the road. The results were: Average speed 85% speed Daily volume CODY ROAD 34 mph 40 mph 336 veh. DONNA LANE 29 mph 35 mph 240 veh. The Road Department forwarded the speed zone request to the Sheriff's Department. John Diehl of the Sheriff's Department reviewed this request and agreed that a 35 mph is the appropriate speed for Cody Road and Donna Lane. RECOMMENDATION The Road Department recommends that the Board of County Commissioners approve the Order setting the speed limit on Cody Road and Donna Lane to 35 mph. If the Board establishes a speed zone the Road Department will install the speed signs on the road as soon as possible. S - We, the residents of Cody Rd., are requesting the establishment of a designated speed zone for Cody Rd. from Bar Creek Rd. north to the end of the pavement. The request is for the establishment of a designated speed 35 MPH zone. Cody Road is about one half (1/2) mile in length, then dead ends into multiple driveways. It is about 20 feet wide with no painted centerline or fog lines. There is about an average of about one foot to one foot and one half of un -maintained dirt and gravel shoulder. This is a residential road with two dead end side streets (Cody Jr. & Donna Ln.) that feed into Cody Rd. Cody Road is used daily by pedestrians who walk their dogs, elderly persons walking from a Senior Care Home, and persons jogging for their daily exercise. Children ride their bicycles up and down Cody road nearly every day, Also, nearly everyday, horseback riders ride their horses on or near the shoulder of Cody Road. Persons halter training their horses frequently walk their horses on Cody Road. During the weekdays, Cody road is used by school buses to pickup or drop off school children at two different times during the morning hours and two different times in the afternoon. Kindergarten children are also picked up or dropped off at noon. Nearly every day, cars will enter Cody Rd. from Bir Creek Rd. and accelerate rapidly up to 50 to 60 mph before they reach the end of the road where it turns to dirt/gravel or turn quickly onto Cody Jr. or Donna Ln. (obviously persons that have no regard for human life or live stalk on Cody Road). This subdivision, which is all small acreages, contains only the above three listed roads. There is no other entrance or exit to this area except by use of Cody Road from Baar Creek Road. Cody Road and Cody Jr. both dead- end at driveways to residences with no turn a round. Donna Ln. dead -ends with a turn around area. This area is also listed as open range and contains numerous livestock. (another reason to drive carefully and safely). Without a designated safe speed limit set for Cody Road We fear that a human life will be seriously injured or killed by a speeding driver. Also without the protection of a designated speed it is difficult for local law enforcement to enforce anything but careless driving unless the road conditions meet the criteria for Violation of the Basic Rule. (Keep in mind that there has been at least one fatal accident at the end of Cody Road in the last 20 plus years). Your immediate attention to designation of a 35 MPH speed zone for Cody Road would be appreciated.
