Luke MINUTES OF MEETING Mike Daly DESCHUTES COUNTY BOARD OF COMMISSIONERS WEDNESDAY, AUGUST 22, 2001 Present were Commissioners Tom De Wolf, Dennis Luke and Mike Daly. Also present were Mike Maier, County Administrator; George Kolb and Tom Blust, Road Department; Susan Ross and Jenny Scanlon, Commissioners' Office; and two citizens. Chair Tom De Wolf opened the meeting at 10: 00 a. m. 1. Before the Board was Citizen Input. None was offered. 2. Before the Board was a Public Hearing and Consideration of Signature of Order No. 2001-075, Completing the Legalization Procedures regarding the Realignment of a Portion of Pinehurst Road. George Kolb explained that an e-mail letter has been given to the Board from Michele and Tom Grimm. The letter stated that they had met with him on July 19, along with Mr. Briggs; and also spoke with him over the phone. Mr. Grimm said in essence that he wanted to make sure that what Mr. Kolb had told them is correct. (A copy of the e-mail is attached as Exhibit A.) Chair DeWolf said that the Grimms ask to reserve the right to a delayed hearing. He explained that obviously they don't have any such right, and no one does. Meeting Minutes Page l of 6 Pages Wednesday, August 22, 2001 Quality Services Performed with Pride George Kolb stated that the concern of the Grimms and Richard Briggs is that if the Oregon Department of Transportation comes in and buys right-of-way, the property line will be amended and his fences will be moved. However, the expense for this would be borne by ODOT. (He referred to an oversized map at this time, detailing the location of the road and surrounding area.) Mr. Kolb said that he met with six landowners, and none of them had a problem. The situation was explained to them over the phone and in person. He explained that all they are doing is going twenty feet off the centerline on either side. The road is not being moved. The property owners do have a concern as far as the intersection alignment being done on the highway by ODOT; they are not doing any turn lanes. The turn lane is really separate from the legalization procedure, and it's ODOT's call. ODOT explained they don't have the money to do this at this time, nor do they feel the volume of traffic warrants one. Commissioner Daly asked if forty feet is a substandard right of way. Mr. Kolb replied that this is what the original establishment was, and they have to follow it. If the County were to go out to sixty feet, it would have to buy that additional property. Chair Tom De Wolf opened the public hearing at this time. Citizen Richard Briggs spoke; however, he refused to use a microphone. He said, in essence, that there is more development coming to the area and a better road is needed. He stated he understands a turn lane is an ODOT issue, but wanted to encourage the Board to apply any pressure it can to encourage ODOT to do this. Chair DeWolf advised Mr. Briggs that "the squeaky wheel gets the grease". The Board does not have the authority to tell ODOT to do anything, but ODOT does pay attention when people show up or contact them. Commissioner Luke added that perhaps Mr. Briggs could put together a petition and get as many people as possible to sign it; that always makes a bigger impression than having individual people calling them up. Contract with the Oregon Economic Development Department, Extending the Expiration Date to December 21, 2001. Susan Mayea Ross said that the existing contract expired in April, but that there is one more drawdown due. All loans and grants, in the amount of approximately $4.3 million, are in place, and the La Pine Water District is basically now on its own. She added that because the Klamath Falls Basin was declared to be in a state of emergency by the Governor, this project also benefited by about $500,000 additional grant funds from the federal government. Before the Board was Consideration of Chair Signature of Notice of an Intent to Award a Construction Contract for the Annex Remodel Project to Keaton King Construction Co. Susan Mayea Ross stated that the appeal period expires on Monday, August 27, 2001 at 5:00 p.m. If there is an appeal, there is a hearing scheduled for that Wednesday. The low bid was Keaton King Construction, at $201,471. The next one was P & P Construction, at $231,200; and the third was from R & H Construction, at $287,600. Before the Board was Consideration of Chair Signature of a Notice of Intent to Award an Architectural Contract to Pinnacle Architecture. Susan Mayea Ross explained that approval and signature today would start the fourteen -day clock on this intent to award. However, we would like to go on record with this e-mail letter and make two points: 1) We have received notice of the public hearing to legalized portions of Pinehurst Road, which borders more than a half -mile of our property at 19315 Pinehurst Road. Specifically, we own tax lots 909 and 906 that run along Pinehurst Road from near the junction with U.S. Highway 20 to near the road's 90 -degree right-hand turn at Mock Road. We have met with George Kolb of the Deschutes County Road Department and he explained that this is simply a formalization of the proposed right-of-way that extends from the center line of Pinehurst Road and runs a distance of 20 feet on either side of that line. Twenty feet from that center line runs to the existing fences that border our entire property along Pinehurst Road. This is to let you know that we have no objection to the legalization of the road at a width of 20 feet from the center line, as stated in person by Mr. Kolb to Tom Grimm and Richard Briggs, a neighbor on the opposite side of the road, during a discussion with us at the road department's offices on July 19, 2001. However, we reserve the right to a delayed hearing or adequate time to file a formal objection if the so -stated 20 -foot right-of-way distance on either side of the Pinehurst Road center line has been amended since then (July 19, 2001) in any way that would affect and/or alter the current fence line that establishes our property line. 2) Furthermore, we wish to urge the Board of Commissioners to ensure that the forthcoming changes to Pinehurst Road at its junction with U.S. Highway 20 include provision for TURNING LANES in order to protect the health and safety of Deschutes County residents and all others who drive along that highway and Pinehurst Road. This is a very dangerous intersection! Changing it from a diagonal crossing to a 90 -degree crossing, as proposed, is a much needed improvement, but that will not prevent potential accidents from confused or impatient drivers who pass illegally while drivers are waiting to turn from the highway onto Pinehurst Road. We believe the same left- and right-hand turning lanes added to the adjacent junction of the highway at Couch Market Road should be installed at Pinehurst Road. Increased traffic on Highway 20, as well as on Pinehurst Road, demands such turn lanes be installed in the interest of public safety. Please note that when the 117 acres of property at Mock Road and Tumalo Reservoir Road (a reclaimed pumice pit owned by the Tumalo Irrigation District and currently offered for sale) becomes a rural neighborhood housing development, traffic from and onto Pinehurst Road will become even greater and more dangerous to people who live and travel in the area. We urge you to contact the ODOT immediately to discuss the possibility of adding turn lanes to the junction of Highway 20 and Pinehurst Road before the state firms up its plans for improvements to that heavily -used and unsafe intersection.
