BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON
A Resolution Declaring the Intent to
Sell Real Property by Private Sale.
RESOLUTION NO. 2001-073
WHEREAS, ORS 275.225 authorizes Deschutes County to sell surplus County land by private
sale when the assessed value is less than $5,000.00 and the property is unsuited for the construction or
placement of structures thereon under current zoning ordinances and building codes of Deschutes
County; and
WHEREAS, Deschutes County owns certain real property generally described in Exhibit "A",
which is not needed by Deschutes County; and
WHEREAS, the real property described in Exhibit "A" is unsuited for the construction under
current zoning regulations and has an assessed value of $1,600.00; and
WHEREAS, Rose and Associates have requested that Deschutes County sell the real property
described in Exhibit "A", consideration for the purchase by Rose and Associates will be the dedication
of public rights of way described in Exhibit `B"; and
WHEREAS, the above stated dedications are greater than or equal to the assessed value of the
property described in Exhibit "A"; now therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES
COUNTY, OREGON, as follows:
Section 1. That the legal notice described in Exhibit "C", shall be published in the "Bulletin"
on October 3, 2001.
Section 2. That the Board of County Commissioners shall accept written comment on the

proposed private sale through October 17, 2001, whereafter the Board may act to sell the real property
described in Exhibit "A" to Rose and Associates, by way of a Bargain and Sale Deed.

COUNTY PROPERTY DESCRIPTION
Three parcels of land lying in the NE'/4 NE 1/4 of Section 23, Township 18 South, Range 12, East of
the Willamette Meridian, Deschutes County, Oregon, and being more particularly described as
follows:
Parcel 1:
All of the tract of land conveyed to Deschutes County by the Pine Forest Grange No. 632 in
that deed filed on 12/9/1953 in Volume 106, Page 82 of the Deed Records of Deschutes
County, Oregon
Parcels 2 and 3:
Both tracts of land conveyed to Deschutes County by the State Land Board in that deed filed on
12/22/1953 in Volume 106, Page 185 of the Deed Records of Deschutes County, Oregon.
Subject to Deschutes County dedicating a portion of the above described properties described
as follows:
A parcel of land located in the NE'/4 NE 1/4 of Section 23, Township 18 South, Range 12,East of the
Willamette Meridian, Deschutes County, Oregon, and being the portions of the tract of land conveyed
to Deschutes County by the Pine Forest Grange No. 632 in that deed filed on 12/9/1953 in Volume
106, Page 82 of the Deed Records of Deschutes County Oregon and the tracts of land conveyed to
Deschutes County by the State Land Board in that deed filed on 12/22/1953 in Volume 106, Page 185
of the Deed Records of Deschutes County Oregon lying within the following described parcel of land:
Commencing at the northeast corner of said Section 23, a brass cap 0.4 feet down in a
monument box, the Point of Beginning; thence along the north line of said section
N89°01'14"W a distance of 2302.01 feet; thence leaving said section line S80°08'23"E a
distance of 114.34 feet; thence 159.65 feet along the arc of a curve to the left with a radius of
1030.00 feet and a long chord which bears S 84°34'49" E a distance of 159.49 feet; thence
along a non -tangent line S89°01'14"E a distance of 1456.17 feet; thence 103.83 feet along the
arc of a curve to the right with a radius of 537.37 feet and a long chord which bears

Page 881 of the Deed Records of Deschutes County Oregon lying within the following described
parcel of land:

PUBLIC NOTICE
The Board of County Commissioners of Deschutes County, Oregon hereby announces its intent
to sell at private sale, pursuant to ORS 275.225, that real property generally described as follows:
Three parcels of land lying in the NE'/4 NE 1/4 of Section 23, Township 18 South, Range 12, East of
the Willamette Meridian, Deschutes County, Oregon, and being more particularly described as
follows:
Parcel 1:
All of the tract of land conveyed to Deschutes County by the Pine Forest Grange No. 632 in
that deed filed on 12/9/1953 in Volume 106, Page 82 of the Deed Records of Deschutes
County, Oregon
Parcels 2 and 3:
Both tracts of land conveyed to Deschutes County by the State Land Board in that deed filed on
12/22/1953 in Volume 106, Page 185 of the Deed Records of Deschutes County, Oregon.
The assessed value of the real property herein described is $1,600.00. The private sale as
described in the Board of County Commissioners's Resolution No. 2001-073, shall be authorized not
sooner than fifteen (15) days following publication of this notice. Written objections or other comment
on the proposed private sale shall be accepted through October 17, 2001 and should be directed to
Deschutes County Property Management, 1130 NW Harriman Street, Bend, Oregon 97701. Upon
consideration of said written comments, the Board may act to sell the real property as described to
Rose and Associates, by way of bargain and sale deed.
