EXCERPT OF MINUTES OF WORK SESSION
DESCHUTES COUNTY BOARD OF COMMISSIONERS
MONDAY, OCTOBER 22, 2001
Present were Commissioners Tom De Wolf and Michael M. Daly; Commissioner
Dennis Luke was unable to attend. Also present were Mike Maier, County
Administrator; Laurie Craghead and Mark Amberg, Legal Counsel; Sue Brewster,
Sheriff's Office; and Tom Blust, Gary Judd and George Kolb, Road Department.
Also in attendance were Doreen Blome' and Damian Syrnyk, Community
Development; Media Representative Barney Lerten of bendnet. com; and three
citizens.
Chair Tom De Wolf opened the meeting at 10: 03 a.m.
1. Before the Board was Citizen Input.
Citizen Vic Russell of La Pine explained that he is involved in the recall of
members of the La Pine Rural Fire Protection District Board. He stated that if
the recall goes through, the remaining Board members may be split; and it is his
understanding that if this occurs, the Board of County Commissioners will
choose the next La Pine RFPD Board member. The results of the recall will be
determined on November 6, followed by the regular meeting of the members of
the La Pine RFPD Board on November 13.
Chair Tom DeWolf explained that typically it takes a month or longer to
appoint a new member of any group, after advertisements are placed and
interviews are conducted. He also said, however, that County Legal Counsel is
researching this issue, and that it is his understanding that the Board of County
Commissioners could appoint someone to act in the interim.

Mr. Russell said that applications have come in, and two of those individuals
are still interested in serving. At the last La Pine RFPD Board meeting action
was taken to do this, but they are concerned about the financial ramifications of
an interim person.
Chair DeWolf replied that it probably will take the County Clerk at least a week
to certify the results of the election, and no advertising could be done until that
has been completed.
County Administrator Mike Maier suggested that County Legal Counsel could
research this issue between now and the election, so that they will be ready with
the proper information in the event the La Pine RFPD Board does end up with a
split vote at its next meeting. At that time the County Commissioners will
know what they can and cannot do to deal with this situation.
The Commissioners and Mr. Russell agreed that this would be the appropriate
path to follow at this time.
8. Before the Board was Discussion and Consideration of Signature of
Amendment No. 3 to Intergovernmental Agreement No. 1927, between
Deschutes County and the Oregon Department of Corrections, to Extend
the Term of a 1998 Agreement regarding the Housing of DOC Prisoners.
Sue Brewster explained that the State delayed this extension, which should have
been signed three months ago.
Mike Maier expressed his concern that the State is not paying an adequate share
of the cost of housing State prisoners, and he would like to see this contract
revisited and analyzed in the near future. Ms. Brewster stated that the contract
indicates it can be terminated by either party with proper notice, but she prefers
that the County first get paid for the previous three months now owed by the
State before contacting the State on the cost issue.
DEWOLF: Move approval, subject to legal review.
DALY: Second.
VOTE: DALY: Yes.
DEWOLF: Chair votes yes.
Being no further formal action taken by the Board, Chair Tom De Wolf adjourned
the meeting at 10:35 a.m.
