MONDAY, OCTOBER 299 2001
ONERS
Present were Commissioners Tom De Wolf,', Dennis R. Luke and Michael M. Daly.
Also present were Mike Maier, County Administrator Laurie Craghead, Legal
Counsel; Dan Peddycord, Health Department; and Tom Blust and Gary Judd,
Road Department. Also attending were George Read, Dave Leslie, Paul Blikstad
and Damian Syrnyk, Community Development; Mary Fleischmann, Corrections;
and two citizens.
Chair Tom De Wolf opened the meeting at 9: 00 a.m.

None was offered.
13. Before the Board was Consideration of Whether to Hear an Appeal of the
Hearings Officer's Decision on Side Yard Setbacks in an F-2 (Forest Use)
Zone.
Paul Blikstad explained that the owner of this property had applied for a
partition in 1979, which was eventually approved. Both parcels now have
dwellings on them. The plot plan show a 50 -foot setback, but the applicants
apparently would like to add on to their dwelling and have asked for the
establishment of a 25 -foot setback.

Since there were no findings in 1979-1980 regarding setbacks, staff had
recommended to the Hearings Officer that she set the standard. However, she
didn't feel confident doing so; therefore, staff requests that this come before the
Board of Commissioners.
Mr. Blikstad further stated that the applicants have asked for a setback of "not
less than 25 feet" be established, rather Athan an exact number of feet. The
Hearings Officer, Karen White, declared that the decision did approve less than
100 feet, but did not approve less than 25 feet.
Laurie Craghead indicated that there is some opposition to this change. She
recommends a public hearing as well, in order for the Board to decide the
jurisdictional issues raised by an opponent to the application.
LUKE: I move that a date be set for the Board to hear this.
