Luke MINUTES OF PUBLIC HEARING Mike Daly DESCHUTES COUNTY BOARD OF COMMISSIONERS MONDAY, OCTOBER 15, 2001 The subject of this hearing a decision by the Deschutes County Board of Commissioners on the approval of a Final Master Plan (FMP) for the Eagle Crest III expansion to an existing destination resort (on property zoned EFU- SCISMIAIDR). Present were Commissioners Tom De Wolf, Dennis R. Luke and Michael M. Daly. Also present were Laurie Craghead, Legal Counsel; Paul Blikstad, Community Development; Alan Van Vliet of Eagle Crest; and Nancy Craven, Attorney representing Eagle Crest, and several citizens. Chair Tom De Wolf opened the meeting at 3: 00 p.m. Commissioner Luke explained that members of the Board were at a joint meeting with the City of Redmond, and had a discussion about the sewer hookup between Eagle Crest and the City. He wished for this to be reflected on the record today. Chair DeWolf added that they basically voted six to nothing to move forward. DEWOLF: The Board met on September 17 and agreed at that time to continue that discussion until today. This hearing is a continuation of that hearing, which had been continued from July 12. This has been said before, but I'm going to say it again. These hearings are being held in accordance with Deschutes County Code provision 22.24.020(b), authorizing the Board to call up an administrative decision for review without the necessity of an application going before the Hearings Officers. You raise it now, or forever hold your peace. DEWOLF: Right. With specificity according to the criteria that we're all familiar with. It's all in the record. The hearing is now reopened. Nancy (Craven), do you have any kind of statement to make? NANCY CRAVEN: No. Not really. I think the issue that we dealt with previously dealt with the sewer. We have entered into an agreement with the City of Redmond for that, as you know. LUKE: No, we don't know. You need to put that in the record. CRAVEN: The City Council voted six to zero on October 9 to enter into an agreement with Eagle Crest, to accept and treat the sewage from Eagle Crest. I realize you met with them subsequent to that. We are getting a letter from the City of Redmond that documents that agreement, and we will submit a copy of it to you. We don't have it with us today, but I did want to put on the record that we did resolve the sewage issue with regard to it going to the City of Redmond. In front of you are some proposed findings and decision that we have worked on with Laurie (Craghead) and Paul (Blikstad) to present to you. This deals specifically with the sewage issue, as well as the other FMP (Final Master Plan) criteria. Under the sewage criteria, it indicates that Eagle Crest will be sending the sewage from Eagle Crest III to the City of Redmond. LUKE: Eagle Crest will not be asking to hook up any houses from the third phase - Eagle Crest III. There will be no applications to hook up houses in Eagle Crest III to the existing septic system. CRAVEN: That's correct. Condition #9 provides for the sewer extension to the City of Redmond, consistent with the agreement with the City of Redmond; and all development in Phase III will be connected. Minutes of Public Hearing Monday, October 15, 2001 Eagle Crest III Findings and Decision Page 2 of 5 Pages LUKE: Is there a proposal to sell lots and build houses subject to the sewer system being in place? CRAVEN: It's our intention to proceed now with a variety of land use steps we need to take to subdivide and plat. That's going to take longer than the sewage connection to Redmond. We anticipate having the sewage connection done two or three months prior to any occupancy that might occur in Eagle Crest III. LUKE: And you expect to hook up to the sewage treatment plan when? ALAN VAN VLIET: With our current schedule, it is anticipated that we would hook up with Redmond in May 2002. LUKE: I don't care if you build the houses. My concern is that you don't hook them up into the existing septic system. If you want to sell land, do your roads and build your houses, I don't care as long as the people know they can't hook up until the sewer is there. DEWOLF: That's all in this agreement. My understanding is that our Legal Counsel and our Community Development Department, and Eagle Crest are all in agreement on these findings. Is that correct? CRAGHEAD: Yes. DEWOLF: I would like to state publicly and for the record that Eagle Crest has been an absolutely wonderful community partner to Redmond and all of Deschutes County. I know that this has been a really difficult time for Eagle Crest as an organization. Just speaking for myself, I am really impressed with the yeoman's effort that you made to deal with a really difficult and emotional issue, and I want to thank you for stepping forward. You've been straight -up, great people throughout this entire process, and I'm really glad that this has worked out with the City of Redmond. I'm very excited to see this move forward. I just wanted to state that because there has been so much negative stated, and I don't want people to forget how far beyond what is necessary both Eagle Crest and Jeld-Wen have gone in the greater Central Oregon community, and Redmond in particular, for years and years. I want to thank you. I'm really excited to be able to support this today. LUKE: You've always been a class organization. I remember three different homebuilder meetings where we had presentations on Eagle Crest before they even got off the ground, and I was always glad that they finally did get off the ground. You've been a very good community supporter, and we use you as an example when we try to get some destination resort legislation through the legislature. I think you have stepped forward and have been very professional in this. I'm glad it worked out. DEWOLF: Is there anyone else who would like to testify in this matter? Being no response offered, Chair DeWolf then closed the hearing. LUKE: Are you (referring to stafj) satisfied that this covers all of the concerns that we had? BLIKSTAD: Do you want that letter in the record before you sign it? The letter from Redmond? LUKE: Absolutely. CRAGHEAD: Yes, I have gone over this thoroughly, and I am comfortable with it.
