1995-42375-Order No. 83-169 Recorded 5/19/1983VOL 6 Pw 8`17 9 E, -423, 76 -- ------ BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON An Order Relating to the * _ Improvement of Certain Dedi- cated Public Roads Known as a Portion of Buck Drive, a G, Portion of Doe Lane, all of Stag Lane and all of Fawn L Lane, Directing the Improve- ment be Made By Contract, and Directing the Clerk to Record *" and Index the Order as Notice * cry c:o of Lien. * '' ORDER NO. 83-169 WHEREAS, on April 21, 1982, the Board of County Commissioners of Deschutes County, Oregon, initiated by Resolution the improve- ment of certain dedicated public roads known as a portion of Buck Drive, a portion of Doe Lane, all of Stag Lane, and all of Fawn Lane, in Deschutes County, Oregon; and WHEREAS, the Resolution was referred to the County Engineer, who investigated the improvement and estimated the cost of the improvement, and a cost estimate of this improvement has been prepared in accordance with ORS 371.625; and WHEREAS, notice pursuant to ORS 371.630 was mailed to each benefited property owner; and WHEREAS, a hearing on the proposed improvement was held on May 26, 1982, at 10:00 a.m. at the Deschutes County Courthouse Annex, Bend, Oregon, for the purpose of hearing remonstrances on said improvement; and WHEREAS, the project was bid based on the Engineer's estimate and bids were in excess of the estimate by $24,000.00; and WHEREAS, an amended Engineer's Report was filed, new notice was given, and a new hearing was held on September 1, 1982; and WHEREAS, because of the uncertainty of financing the project was abandoned; and WHEREAS, property owners abutting the project requested that the project be revived; and WHEREAS, notice of hearing on the revived project was mailed each property owner on April 13, 1983; and 1 - ORDER NO. 83-169 4,3rA. i[D 1995 s Yrt 46 FA�F 83 S WHEREAS, a hearing on the revived project was held on May 4, 1983 and May 18, 1983, at 10:00 a.m. at the Deschutes County Courthouse Annex, Bend, Oregon, for the purpose of hearing remon- strances on the said improvement and only two persons remon- strated; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDERS as follows: Section 1. To improve certain dedicated public roads known as a portion of Buck Drive, a portion of Doe Lane, all of Stag Lane, and all of Fawn Lane, in Klippel Acres, an unrecorded subdivision in Deschutes County, Oregon, to Deschutes County Local Road Standards for the benefit of the area described in Exhibit "A", attached hereto and by this reference incorporated herein, and consisting of the lots as described in Exhibit "B" attached hereto and by this reference incorporated herein. Section 2. That the dedicated roads to be improved within the District described in Section 1 of this Order are to be improved by contract and are described as a portion of Buck Drive, a portion of Doe Lane, all of Stag Lane, and all of Fawn Lane. Section 3. This Order is notice that the land described in Section 1 is subject to a lien of an assessment for the costs of the improvement, in an amount to be determined later by an Order of the County Court. Section 4. The County Clerk shall endorse upon the Order the date of the filing thereof, and shall record and index the same in a Lien Docket in the office of the County Clerk against the properties described in Section 1 of this Order.
