WHEREAS, Deschutes County Rural Fire Protection District No.
2 has adopted an Ordinance providing for a uniform fire code
within the District's boundaries in unincorporated Deschutes
County, Oregon; and
WHEREAS, ORS 478.924 requires the Board of County Commis-
sioners approve said Ordinance by Resolution; now, therefore,
BE IS RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
DESCHUTES COUNTY, OREGON, as follows:
Section 1. Ordinance No. 2 of the Deschutes County Rural
Fire Protection District No. 2, marked Exhibit "A", attached
hereto and by this reference incorporated herein as though fully
set out herein, is hereby approved in its entirety.

A14 ORDINANCE ADOPTING A UNIFORM FIRE CODE FOR DESCHUTES
COUNTY RURAL FIRE PROTECTION DISTRICT NO. 2; PRESCRIBING REGULA-
TIONS GOVERNING CONDITIONS HAZARDOUS TO LIFE AND PROPERTY FROM
FIRE AND EXPLOSION; ESTABLISHING A BUREAU OF FIRE PREVENTION AND
PROVIDING OFFICERS THEREFOR AND DEFINING THEIR POWERS AND DUTIES;
REPEALING PRIOR ORDINANCES; PROVIDING PENALTIES; AND OTHER
PERTINENT PROVISIONS.
WHEREAS, THIS AND PREVIOUS BOARDS OF DIRECTORS OF
R.F.P.D. NO. 2 being aware of the need to provide adequate
rules and regulations for effective fire protection and pre-
vention services for the residents, inhabitants and property
located within the district and the need to coordinate
such rules and regulations with those governing the operation
of the Fire Department of the City of Bend, Oregon, which
department furnishes fire protection to the district.
RURAL FIRE PROTECTION DISTRICT NO. 2, DESCHUTES
COUNTY, OREGON, DOES ORDAIN AS FOLLOWS:
Section 1. Adoption of Uniform Fire Code. In
accordance with Oregon Revised Statute 478.91Q, for the
purpose of prescribing regulations governing conditions
hazardous to life and property from fire or explosion,
R.F.P.D. #2 does herebv adopt that certain Code known as the
Uniform Fire Code, 1982 edition, recommended by the Western
Fire Chiefs Association and the International Conference of
Building Officials, with deletions, amendments and modifications,
as adopted by the City of Bend by Ordinances No. NS948,
1130, and 1323, and by ordinances supplemental thereto. Not
less than three copies of said Code and not less than three
copies of said Ordinance adopted by the City of Bend have
been and are,now filed in the office of the City of Bend
Recorder -Treasurer and the same are hereby adopted and
incorporated as fully as if set out herein, and from the
date on which this ordinance shall take effect, the provisions
thereof shall be controlling within the limits of R.F.P.D.
42, Deschutes County,.Oregon.
Section 2. Establishment and Duties of Bureau of Fire
Prevention.
(1) The Uniform Fire Code shall be enforced b_v the Bureau of
Fire Prevention in the fire ;department of the City of Bend
which is established under this authority and which shall
be operated under the supervision of the Chief of the Fire
Department.

(2) The Chief (or Fire Marshall) in charge of the Bureau of
Fire Prevention shall be appointed on the basis of exam-
ination to determine his qualifications.
(3) The Chief of the Fire Department may detail such members
of the Fire Department as inspectors as shall from time
to time be necessary.
Section 3. Definitions.
(1) Wherever the word "jurisdiction" is used in the Uniform
Fire Code, it shall be held to mean the legal limits of
R.F.P.D. 42.
(2) Wherever the term "Corporation Counsel" is used in
the Uniform Fire Code, it shall be held to mean
the attorney for R.F.P.D. #2, Deschutes County,
Oregon.
(3) Wherever the words "Chief of the Bureau of Fire
Prevention" are used thev shall be held to include
"Fire Marshall".
Section 4. Amendments Pude to the Uniform Fire Code.
The Uniform Fire Code is amended and changed in the following
resuects:
(1) Section 10.309 of the 1982 Edition of the Uniform
Fire Code is amended to reac as follows:
AUTOMATIC SPRINKLER SYSTEMS
Section 10.309. (s) General. Automatic sprinkler
systems shall be provided in accordance with the provi-
sions of this section.
(b) Where Required. Automatic sprinkler systems shall
be installed and maintained in operable condition as
specified in this article in the following locations
within the Bend Urban Growth Boundary:
1. All occupancies exceeding 3000 square feet ex-
cept Group R, Division 3, Group M, and Group B-2.
(a) Any building over two stories in height
except R-3 occupancies.
(b) Any existing basement shall be provided
with automatic sprinklers upon change of occu-
pancy or change of storage to a higher hazard.
(c) The provisions of this section shall apply
to all new construction or change of occupancy
in existing construction.

A. In every story or basement of all buildings when the floor area
exceeds 1500 square feet and there is not provided at least 20 square
feet of opening entirely above the adjoining ground level in each 50
lineal feet or fraction thereof of exterior wall in the story of base-
ment on at least one side of the building. Openings shall have a
minimum dimension of not less than 30 inches. Such openings shall be
accessible to the fire department from the exterior and shall not be
obstructed in a manner that fire fighting or rescue cannot be accom-
plished from.the exterior.
When openings in a story are provided on only one side and the
opposite wall of such story is more than 75 feet from such openings,
the .story shall be provided with an approved automatic sprinkler
system, or openings as specified above shall be provided on at- least
two sides of an exterior wall of the story.
If any portion of a basement is located more than 75 feet from
openings required in this section, the basement shall be provided
with an approved automatic sprinkler system.
B. At the top of rubbish and linen chutes and in their terminal rooms.
Chutes extending through three or more floors shall have additional
sprinkler heads installed within such chutes at alternate floors.
Sprinkler heads shall be accessible for servicing.
C. All rooms where nitrate film is stored or handled shall be equipped
with an approved automatic sprinkler system as specified in U.B.C.
Standard No. 48-1.
D. In protected combustible fiber storage vaults as in Section 9.118 of
this code.
2. Group A Occupancies.
(a). In all basements.
(b) When the occupance has over 3,000 square feet of floor area which
can be used for exhibition or display purposes.
(c) In any enclosed usable space below or over a stairway in Group A,
Divisions 2, 2.1, 3 and 4 Occupancies.
(d) Under the roof and gridiron, in the tie and fly galleries and in all
places behind the proscenium wall of stages; over enclosed platforms in
excess of 500 square feet in area, and in dressing rooms, workshops and
storerooms accessory to such stages or enclosed platforms.
EXCEPTIONS:
1. Stages or enclosed platforms open to the auditorium room on
three or more sides.
2. Altars, pulpits or similar platforms and their accessory rooms.

3. Stage gridirons when side-wall sprinklers with 135° F. rated
heads with heat -baffle plates are installed around the entire
perimeter of the stage at points not more than 30 inches below
the gridiron nor more than 6 inches below the baffle plate.
4. Under stage or under enclosed platform areas less than 4 feet
in clear height used exclusively for chair or table storage and
lined on the inside with materials approved for one-hour fire -
resistive construction.
3. Group E. Occupancies.
(a) In all basements.
(b) In any enclosed usable space below or over a stairway.
4. Group I Occupancies.
EXCEPTIONS:
1. In hospitals of Types I, II Fire -resistive and II One-hour
construction, the automatic sprinkler system may be omitted from
operating, delivery, cardiac, X-ray and intensive care rooms
not exceeding 450 square feet in area when
each such room is provided with smoke detectors connected to a
continuously attended station or location within the building.
Increases for area and height specified in Sections 506(c) and
507 shall not apply when this exception is used.
2. In jails, prisons and reformatories, the piping system may be dry,
provided a manually operated valve is installed at a continuously
monitored location. Opening of the valve will cause the piping
system to be charged. Sprinkler heads in such systems shall be
equipped with fusible elements or the system in U.B.C. Standard
No. 38-1.
5. Group H Occupancies.
(a) In Group H, Divisions 1 and 2 Occupancies larger than 1500 square
feet in floor area.
(b) In Group H, Division 3 Occupancies larger than 3000 square feet in
floor area.
(c) In Group H, Division 4 Occupancies.
(d) In rooms where flammable or combustible liquids are stored or
handled in excess of 30 gallons of Class I -A, 60 gallons of Class I -B,
90 gallons of ClassI-C, 120 gallons of Class II, 250 gallons of Class
III -A, or any combination of flammable liquids totaling 240 gallons.
e) For paint spray booths or rooms and for special provisions on
hazardous chemicals and magnesium, and calcium carbide, see Section
45.208, Articles 48, 49 and 80. See also Section 10.301.

6. Group B, Division 2 Occupancies.

(a) Where the floor area exceeds 12,000 square feet on any floor or
24,000 square feet on all floors.
(b) In buildings used for high -piled combustible storage, fire protection
shall be in accordance with Article 81.
(c) In all basements.
(c) Alarms. When serving more than 100 sprinklers, automatic sprinkler
systems shall be supervised by an approved central, proprietary or r -emote
hich will give an audible signal at a
station service or a local alarm w
constantly attended location.
(d) Permissible Omissions. Subject to the approval of the building official
with the concurrence of the chief of the fire department, sprinklers may be
omitted in rooms or areas as follows:
1. Where sprinklers are considered undesirable because of the nature of
the contents or in rooms or areas which are of noncombustible con-
struction.with wholly noncombustible contents and which are not exposed
by other areas. Sprinklers shall not be omitted from any room merely
because it is damp or of fire -resistive construction.

Sprinklers shall not be installed where the application of water or
flame and water to the contents may constitute a serious life or fire
_hazard, as in the manufacture or storage of quantities of aluminum
powder, calcium carbide, calcium phosphide, metallic sodium and
potassium, quicklime, magnesium powder, and sodium peroxide.

Communication equipment areas under the exclusive control of a public
communication utility agency, provided:

A. The equipment areas .are separated from the remainder of the
building by one-hour fire -resistive occupancy separation; and
B. Such areas are used exclusively for such equipment; and
C. An approved automatic smoke detection system is installed in
such areas and is supervised by an approved central, proprietary
or remote station service, or a local alarm which will give an
audible signal at a constantly attended location; and
D. Other approved fire -protection equipment, such as portable fire
extinguishers or Class II standpipes, is installed in such areas.

5. Other approved automatic fire -extinguishing systems may
be installed to protect special hazards or.occupancies in
lieu of automatic sprinklers.
(2) Section 11.101 (b) is amended by inserting 20 feet for 50
feet as it appears therein. Further, the following sentence is
added: An approved waste burner is one made of non-combustible
materials with a 1/4 inche mesh cover and without openings into
the combustion chamber.
(3) Section 11.105 is amended by deleting paragraph (c) and re-
membering paragraphs (d) & (e) & (d) respectively. The new para-
graph (c) is now amended by inserting 1/4 inche for 1/2 inche as
it -appears therein.
(4) Section 11.106 (a) is amended to read: Any residential in-
cinerator shall be installed in accordance with the provisions
of the Uniform Mechanical Code (U.B.C. Vol. II)
(5) Section 11.112 (b) 2.is amended by inserting 20 feet for 25
feet as it appears therein.
(6) Section 78.101 is amended to read: "Fireworks" means anv
combustible or explosive composition or substance, or anv
combination of such compositions of substances, or anv other
article which was prepared for the purpose of providing a
visible or audible effect by combustion, explosion, deflagration
or detonation, and includes blank cartridges or toy cannons
in which explosives are used, balloons which require fire
underneath to propel the same, firecrackers, torpedoes, sky-
rockets, Roman candles, bombs, rockets, wheels, colored fires,
fountains, mines, serpents or anv other article of like con-
struction or any article containing any explosive or inflammable
compound, or anv tablets or other device containing any
explosive substances or inflammable compounds; but does not
include:
(a) Sparklers, toy pistol paper caps, toy pistols, toy
canes, toy guns, or other devices in which paper caps
containing .25 grains or less of explosive compound are
used, and when the rate of burning and the explosive
force of the materials in such devices are not greater
than an equivalent weight of F.F.F.G. black powder, and
when such devices are constructed that the hand cannot
come in contact with the can when in place for explosion,
and the major explosive force is contained or dispelled
within the housing or shell of the device, there is no
visible flame during discharge, there is no flaming or
smouldering or any of the components or parts of the
device after discharge, and the device does not produce
sufficient heat to readily ignite combustible materials
upon which the device may be placed. The sale and use
of such devices shall be permitted at all times.

(b) Snakes or similar smoke producing material containing
not more than 100 grains of combustible substances when
there is no visible flame during discharge, there is
no aftersmouldering, and the devices do not produce
sufficient heat to readily ignite combustible materials
upon which the devices may be placed. The sale and use
of such devices shall be permitted at all times.
For the purposes of this section "sparklers" means
materials of a character that will, when ignited, sparkle
without throwing or dropping hot residue capable of
igniting combustible materials, attached to a wire or
other non-combustible central support, with such materials
arranged in a cvlindrical shape not more than 10 inches
in length not more than 1/4 inch in diameter and which shall
not burn more rapidly than 1 inch in 10 seconds, but not
including materials encased within a container of any
character. "Explosive substance" or "explosive mixture"
as used in this section shall mean anv substance so
arranged as to burn in less than 1 second. "Combustible
substance" shall mean an_v substance so arrangedas to
burn in more than 1 second.
(7) Section 78.102 is amended by adding subsection (d). No
person shall sell any unclassified fireworks within Deschutes
County Rural Fire Protection District #2 unless such unclassified
fireworks have first been inspected and approved by the Fire
Marshall of the City of Bend.
Section 5. Building Permit Review. The agency of
Deschutes County responsible for the issuance of building
permits shall be the agency authorized and directed to review
Plans for compliance with the Fire Prevention Code.
Section 6. Appeals. [whenever the Chief or the
Plan Review Agency of Deschutes Countv shall dissapprove an
application or refuse to grant a permit applied for, or when
it is claimed that the provisions of the Code do not apply
or that the true intent and meaning of the Code have been
misconstrued or wrongly interpreted, the applicant may
appeal from the decision of the Chief or the decision of
the Plan Review Agency to the Fire Prevention Boards of
Appeals within 30 days from the date of the decision appealed.
Section 7. Penalties.
(1) Any person who violates any of the provisions of
this ordinance shall be guilty of a misdemeanor,
punishable by a fine of not more than $500.00 or
by imprisonment for not more than 100 days or both.

The imposition of one penalty for any violation shall
not excuse the violation or permit it to continue; and
all such persons shall be required to correct or
remedy such violations or defects within a reasonable
time; and when not otherwise specified, each 10 days
that prohibited conditions are maintained shall
constitute a separate offense.
(2) The application of the above penalty shall not be
held to prevent the enforced removal of prohibited
conditions.
Section 8. Savings Clause. If any article, section,
subsection, subdivision, phrase, clause, sentence or word in this
Ordinance or the Uniform Code adopted hereby, shall for anv reason
be held invalid or unconstitutional by a court of competent
jurisdiction, it shall not nullify the remainder of this Ordinance
or said Code, but shall be confined to the article, section,
subsection, subdivision, clause, sentence or word so.held invalid
or unconstitutional.
Section 9. Date of Effect. The Ordinance shall
take effect and be in full force and effect upon the 30th day
following its adoption by the District Board of Directors or its
approval by the governing body of Deschutes County whichever last occurs.
