1995-19488-Order No. 83-283 Recorded 11/16/198395-19488 VuL 50 FACE 99 BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON An Order Relating to the # F �'G D Supplemental Tax Roll For the # Bend-LaPine School District. /VOV 161983' MARY SUE ORDER NO. 83-283 SCHUDETfS Cp JN OM CLERIC WHEREAS, the approval by the voters of the Bend-LaPine School District of an operating levy on November 8, 1983, makes it necessary to prepare and distribute a supplemental tax roll for the late tax levy of the District; and WHEREAS, the extension of the tax levy, pursuant to ORS 310.060(3) was granted to September 1, 1983, and no further extensions were granted; and WHEREAS, Ordinance 83-059 provides that any District which fails or neglects to obtain an extension for the filing of a tax levy after September 1, 1983, shall be responsible for the costs of such levy and supplemental tax roll; and WHEREAS, Deschutes County does not have funds budgeted in the Assessor's Department or the Treasurer's Department to pay the extra cost incurred by the supplemental tax roll and late tax levy; and WHEREAS, the extra costs could have been avoided; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDERS as follows: Section 1. That no supplemental tax roll be prepared and no late tax levy be processed by the Deschutes County Assessor and the Deschutes County Treasurer until the funds from the Bend- LaPine School District are in hand to pay the costs to be incurred, pursuant to Deschutes County Ordinance No. 83-059. Section 2. That the Bend-LaPine School District be notified of the amount necessary to extend the late levy on the tax rolls, the cost of forms and envelopes for preparing the supplemental bills, the cost of mailing those bills, the cost of adjusting the prior tax account distribution, and any other costs incurred by the County by reason of the late tax levy. 1 - ORDER NO. 83-283 KEYPL EB Liuo . ORDINANCE NO. 83-059 THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDAINS as follows: Section 1. Short Title. This Orditance-shall be referred to as the "Late Tax Levy Ordinance of Deschutes County". Section 2. Notice of Tax Levy. This Ordinance is enacted as a matter of local concern to Deschutes County. The Board of County Commissioners of Deschutes County,'Oregon, recognizes that pursuant to ORS 310.060(1), not later than July 15, of each year, every city, school district or other public corporation (district) authorized to levy a tax shall give notice in writing of the tax levy to the Assessor of the County. Section 3. Failure to Request Extension. In absence of an extension from the Deschutes County Assessor as authorized by ORS 310.060(3), if a notice of tax levy is not received by the Deschutes County Assessor on or before September 1 of any parti- cular year resulting in a supplemental tax roll, additional costs incurred by the County in preparing a late tax levy and a supple- mental tax roll shall be the responsibility of the district. S.ection 4. Failure to Submit Notice of Tax Levy. If an extension is granted pursuant to ORS 310.060(3), but a district fails to submit the notice of tax levy required by ORS 310.060(1), thereby resulting in a supplemental tax roll, additional costs incurred by the County shall be the responsibility of the district. Section 5. Costs. Costs shall include, but are not limited to, the cost of extending the late levy on the tax rolls, the cost of forms and envelopes for preparing the supplemental bills re- quired, the cost of mailing those bills, and the cost of adjusting prior tax account distribution. 1 - ORDINANCE NO. 83-059 y •r , 1" VOL 50 rud, 00 0 Section 6. Determination of Costs. The Deschutes County Tax Collector and the Deschutes County Assessor shall jointly deter- mine the cost of preparing such supplemental tax roll, and the said amount shall be reimbursed to the County by the district. Section 7. Emergency. This Ordinance being necessary for the immediate preservation of public peace, health and safety, an emergency is declared to exist, and this Ordinance takes effect on its passage. The School Board of Directors has called for a levy election in August to again seek voter approval for tax funding to keep the schools open during the 1983-84 school year.
