Chairman Young called the meeting to order at 10:00 A.M.<<Qw'
Commissioner Tuttle and Commissioner Prante were also present. CIA*
Chairman Young explained that this is only a work session and no
public testimony will be taken.
Chairman Young explained that the new draft sufficiently addresses
the concerns that he had with the ordinance. He had no further
changes to make at this time and would be satisfied if it went on
to the Deschutes County Planning Commission.
Commissioner Prante explained that she is pleased with the
progress of the ordinance and that the Board of Commissioners
resolved to pass an ordinance that would balance the uses of the
river while preserving the natural environment. The core of the
ordinance are essential aspects and are being maintained. Those
aspects are the study time, the goal 5 process, and having a river
zone. Commissioner Prante felt that it was important to use the
Northwest Power Planning Council's regional research in incorp-
orating the ultimate ordinance. The draft was sent back to the
technical staffs of both the city and the county and the planning
commissions of each. They have come up with some new information
in clarifying the verbage and being more precise in the actual
determination of minimum flows of the river. A noise standard has
been included and the cut and fill activities have been addressed.
She continued that the overlay zone has been modified to more
clearly represent the impact on the river. Section 4(1) has been
included to deal with special districts so that we work through
cooperative agreements with Deschutes County in any project that
happens. Commissioner Prante stated that when this ordinance is
completed, Deschutes County will have legislation it can be proud
of and are now in a position to expedite the process. Commis-
sioner Prante stated that she would like to stipulate that the
task force be appointed to determine as closely as possible the
costs involved and to identify the sources of those funds. Any
further involvement or responsibility to the task force will be
determined by the County commissioners at a later date. The final
determination on the length of the study should be made upon the
recommendation of the task force rather than taking an arbitrary
time that is not based on concrete data. The study should take
the amount of time necessary to do its job. Commissioner Prante
also felt that a specific time line should be developed to see if
a date can be set to move on this ordinance.

Commissioner Tuttle stated that he supports the re -draft of the
ordinance. By re -ordering some of the previous purposes section
into a specific use required by the standards section, it more
clearly matches the traditional way an ordinance is looked at.
He stated that it carries the full force of the first draft. In
addition, the inclusion of the minimum stream flows is a specific
standard which improves the ordinance. Commissioner Tuttle stated
that his previous concern with the task force process is that we
not get bogged down. Everyday that passes without action being
taken on this issue, the state and federal agencies have oppor-
tunity to act before the ordinance is in place. He continued that
it is more appropriate for the task force to begin its
deliberations after the ordinance is in place since the ordinance
itself establishes the task force. Commissioner Tuttle stated
that this ordinance is only dealing with PL -15 and not the urban
growth boundary.
Richard Isham recommended that Section 6(C) be modified and
incorporated into the study period section and 6(D) be
incorporated into the conditional use section (Section 3). Mr.
Isham continued that Section 3 (where it makes reference to
underlying zones) appears that some of these areas also have other
overlay zones (such as an LM zone) and it is not clear that those
other zones will also be a standard criteria. Mr. Isham stated
that the city had some concerns over Section 6(A)(B) that these
should be separate for the purpose of regulating the land uses.
Commissioner Tuttle explained that the objectives of Section
6(A)(B) are to be certain that we take affirmative action as far
as intervention, where it is appropriate or possible to do so. He
continued that this should be part of the ordinance. The strength
of the ordinance is that when the County intervenes there is a
plan behind it. Commissioner Tuttle agreed to modifying this
section if it can be modified to have the same meaning, but
intervention will have more meaning if it can be identified in the
ordinance itself.
Richard Isham mentioned that possibly the intervention should be
part of the study period.
MOTION: TUTTLE moved to send the draft including
today's recommendations of County Counsel and
the Board members to the Planning Commission
for hearing on December 14, 1983.
PRANTE: Second
AMENDED MOTION: TUTTLE amended the motion to include that we
set December 21st as the hearing date for the
Board of Commissioner's hearing in the evening
on the same ordinance.
