There were no changes or additions. agenda Laurence Chairman Young explained that he had a letter to the Tuttle's Chairman from Laurence Tuttle which he read aloud. Request for The letter explained that Laurence Tuttle is Legal Counsel requesting legal counsel under ORS 30.285 and 30.287. MOTION: PRANTE moved to grant Laurence Tuttle's request for legal counsel. YOUNG: Second VOTE: TUTTLE abstained, YOUNG & PRANTE both said yes. Request for Before the Board of Commissioners was a request for Refunds refund for Lee Durdan in the amount of $18.20 1983-85 Compre- John Andersen, Director of Community Development hensive Plan Department explained that the County applied for Maintenance funds annually from LCDC to assist with the Agreement maintenance of the Comprehensive Plan as well as coordinating activities. This agreement is for two years for $10,750. Mr. Andersen continued that there is a new fund provided for projects that would be useful on a statewide basis which provides for special planning monies. He suggested with the controversay of the Deschutes River, the County should apply for these funds. PAGE 1 MOTION: PRANTE moved to accept the Grant Agreement for the Comprehensive Plan Maintenance. TUTTLE: Second VOTE: UNANIMOUS APPROVAL KEY GHEE) 1995 VOL 51 fAtE 260 Temporary Use John Andersen explained that there has some concern Policy that the procedures ordinance leaves open the Planning Division's authority in granting temporary use permits. He continued that there is some potential for liability should a temporary use permit be granted for beginning an activity with a final result of the permanent use being denied. It is the Planning Division's feeling that it would be reasonable for them to have the authority to grant temporary use permits for mobile homes and minor alteration site plans. The possibility of denial for these types of permits are very small and the liability is limited should the ultimate decision be a denial of the request. When applying for a temporary use permit a person will have to release the county from all liability and recognize that anything that happens is at their own risk. MOTION: PRANTE moved to grant the authority of allowing temporary use permits to the Planning Commission for mobile homes and minor alteration site plans. TUTTLE: Second VOTE: UNANIMOUS APPROVAL Holdback Chairman Young read aloud the Holdback Agreement. Agreement Through this agreement Sunriver County Mall Partnership authorizes Seafirt Mortgage Corp. to hold from the proceeds of their construction loan a cash collateral account in the sum of $100,000 for completion of landscaping. MOTION: TUTTLE moved to execute the holdback Agreement with Seafirst Mortgage Corp. PRANTE: Second VOTE: UNANIMOUS APPROVAL Discussion re- Jim France, Deschutes County Sheriff, explained that garding bids no one could meet the 60 day delivery requirement on on 4 x 4 the bid specifications. The quotes received were from Wagons and a delivery time of 80 to 100 days. There are some 4 x 4 Pickups alternatives that will be looked into. Sheriff France for Sheriff's recommended that they not accept any of the bids Department received. MOTION: TUTTLE moved to accept the recommendation of Sheriff France to not award the bids. PRANTE: Second VOTE: UNANIMOUS APPROVAL PAGE 2 VOL 51 rAcE 261 Contract Review Chairman Young explained that under Oregon Law each Board Reso- jurisdiction is allowed to be their own contract lution for review board. Brothers School District £15 has Brothers requested this. School District £15 MOTION: PRANTE moved to accept the Resolution for Brothers School District £15. TUTTLE: Second VOTE: UNANIMOUS APPROVAL Grazing Lease Rick Isham, Legal Counsel, explained that this lease with Moser, requests an interim lease on the land in the Tumalo Hausner, and area of approximately 1608 acres with the knowledge Frank and understanding that this land is involved in the land exchange with BLM. When the exchange is final, this lease is termianted. They have received a letter from BLM stated that they have no problem with this lease. MOTION: PRANTE moved to approve the lease.
