WHEREAS, a petition, pursuant to ORS 368.351, requesting the
vacation of a portion of Murphy Road, described in Exhibit "A",
attached hereto and by this reference incorporated herein, was
filed with the Board of County Commissioners of Deschutes County,
Oregon, on February 1, 1984; and
WHEREAS, the County Road Official has filed with the Board
of County Commissioners a written report that contains the Road
Official's assessment that a vacation of the public property is
in the public interest; now, therefore
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY,
OREGON, ORDERS as follows:
Section 1. That the property, described in Exhibit "A", is
hereby vacated.
Section 2. That this Order shall be recorded with the
Deschutes County Clerk, and copies shall be filed with the
Deschutes County Surveyor and County Assessor.

A tract of land lying in the southeast one-quarter of
the southwest one-quarter of Section 16, Township 18
South, Range 12 East of the Willamette Meridian,
Deschutes County, Oregon, being more particularly
described as follows:
Commencing at the iron pin marking the southwest corner
of said southeast one-quarter; thence N 890 26' 00" E
333.25 feet along the south line of said southeast
one-quarter; N 40 57' 44" W 30.09 feet to the POINT OF
BEGINNING; thence N 40 57' 44" W 145.18 feet to a point
on the northerly right of way line of Murphy Road, said
right of way line being 20.00 feet northerly of, when
measured perpendicular to, the center line of Murphy
Road; thence, 72.25 feet along said right of way line
and along the arc of a curve to the left having a
radius of 491.35 feet, the chord of which bears S 490
14' 58" E 72.19 feet; thence, 100.57 feet continuing
along said right of way line and along the arc of a
curve to the left having a radius of 491.35 feet, the
chord of which bears S 600 35' 04" E 100.39 feet;
thence 28.43 feet along the arc of a curve to the left
having a radius of 50.00 feet, the chord of which bears
S 150 43' 24" W 28.05 feet; thence S 0° 34' 00" E 20.00
feet; thence S 890 26' 00" W 122.18 feet to the point
of beginning. EXCEPTING THEREFROM, an easement over,
across and through said property for utility purposes.

We, the undersigned, constituting 100% of the owners of real
property abutting the property proposed to be vacated, respect-
fully request the following described property be vacated under
ORS 368.326 to 368.366.
Legal description of property to be vacated:

South, Range 12 East of the Willamette Meridian,
Deschutes County, Oregon, being more particularly
described as follows:

1. This property should be vacated because it is no longer
needed for public use because of the construction of the Murphy
Road crossing across the Burlington -Northern right-of-way to the
north of the property to be vacated.
2. The following persons' wholly recorded interest in the
property proposed to be vacated.
