ORDER NO. 84-010
WHEREAS, the Board of County Commissioners of Deschutes
County, Oregon, has held a hearing in accordance with law fixing
the assessments of improvements abutting certain real property in
Preble Way L.I.D. in Deschutes County, Oregon; and
WHEREAS, there were no remonstrances to the proposed
assessments relating to said property; now, therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY,
OREGON, ORDERS as follows:
Section 1. The assessments for road improvements in Preble
Way L.I.D. are hereby certified in accordance with Exhibit "A",
attached hereto and by this reference incorporated herein.
Section 2. That the rate of interest to be charged on un-
paid assessments for which financing requests are filed with the
Board of County Commissioners, and for assessments for which
financing requests are not filed and remain unpaid more than
thirty (30) days from the date of assessment, shall be twelve per
cent (12%) per annum.
Section 3. That the Director of Public Works shall mail on
or before February 27, 1984, notices of the assessments as fixed
by this Order to owners of the said property with an application
to finance the improvements in not more than 20 semi-annual in-
stallments. The notice of assessment shall substantially comply
with Exhibit "B", attached hereto and by this reference incorpor-
ated herein. The application to finance improvements shall
substantially comply with Exhibit "C", attached hereto and by
this reference incorporated herein.
Section 4. That the Order, excepting Sections 2, 3, 4 and
5, be published in a newspaper of general circulation within
Deschutes County on February 27, 1984, with the following
heading:

NOTICE OF ASSESSMENT
The Board of County Commissioners of Deschutes County,
Oregon, at its regular meeting on February 22, 1984,
passed Order No. 84-010, assessing the following
described property for road improvements. Upon failure
of owners to make application to pay the assessments in
installments by March 30, 1984, or upon failure of the
owner to pay the assessment in full by March 30, 1984,
interest will commence and run at the rate of twelve
per cent (12%) per year, and the property assessed will
be subject to foreclosure.
Section 5. The County Clerk shall, upon the filing of this
Order, record and index it upon the lien docket of Deschutes
County known as Assessment District Liens.

TO THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON
Pursuant to the provisions of the Act of the Legislature of the State
of Oregon, known as the "Bancroft Bonding Act", (ORS 223.205 to
223.300, as amended), applicant makes application to finance the
portion of the cost of the road improvement levied against applicant's
property and being part of the improvement of roads in unincorporated
Deschutes County, Oregon, as the same has been determined and assessed
by the Board of County Commissioners of Deschutes County, Oregon, and
Order No. 84-010, and docketed upon the Docket of Assessment District
Liens of Deschutes County, Oregon.
The applicant and property owner of the property described below does
hereby waive all irregularities or defects, jurisdictional or other-
wise, in the proceedings to cause said improvement to be constructed or
made for which the assessment is levied, and in the apportionment and
assessment of the cost thereof, and acknowledges that applicant is
indebted and the property legally charged with the assessment.
Applicant agrees to pay the assessment in twenty (20) or fewer
semi-annual installments, together with interest at twelve per cent
(12%) per annum on all unpaid assessments. The interest shall be paid
semi-annually in addition to and at the time each principal payment is
made.
The installments shall be due and payable on the 1st day of October,
1984, and thereafter on the 1st day of April and the 1st day of October
in subsequent years.
