WHEREAS, Ordiance No. 82-011, Deschutes County Land Use
Procedures Ordinance, has been amended to provide that the Bend
Urban Area Planning Commission no longer hears quasi-judicial
appeals, but may call up certain land use decisions for review;
and
WHEREAS, it is necessary that the Comprehensive Plan for the
Urban Area be amended to be consistent with this change; now,
therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY,
OREGON, ORDAINS as follows:
Section 1. That the section entitled "Procedure" on page
70, Bend Area General Plan, Ordinance No. 80-216, be amended to
read as follows:
"Procedure.
The Planning Commission shall review and report every
other year on the adequacy of the plan to the governing
body. The report may include, after appropriate hear-
ing, such recommendations as seem necessary to ensure
that the plan continues to function as a guide for
community development. The Planning Commission or
governing body may initiate legislative changes to the
plan. The Planning Commission shall hold one or more
hearings on such changes and recommend to the governing
body who shall also hold a hearing prior to adoption of
any change.
Quasi-judicial changes shall be treated as zone changes
and follow the uniform procedural ordinance for zone
changes. Such plan changes shall be consistent with
the goals, objectives, policies, and statements of
intent of the plan, or these guidelines, shall be first
changed or amended to reflect new policies. An indi-
vidual requesting a change shall demonstraat the

change is warranted due to changed conditions, a
mistake, or other specific facts that demonstrate a
public need and benefit for the change.
The governing body shall maintain records of all
amendments to the plan in a form convenient for public
use."
Section 2. This Ordinance being necessary for the immediate
preservation of public peace, health and safety, an emergency is
declared to exist, and this Ordinance takes effect on its
passage.
