Chairman Young called the meeting to order at 10:06 A.M.
Commissioner Prante and Commissioner Tuttle were also present.
Amendments to Chairman Young read aloud the amendments to
the Agenda the agenda. There was one item added to the
amendments: Reconvene at 11:00 A.M. this date to
discuss Awbrey Butte Master Plan.
Order No. 84-146 Chairman Young read the title of Order No. 84-146.
Appropriations This order resulted because of a necessity to

Appointment Chairman Young read a letter received from River
to River Bend Bend Estates Special Road District nominating Barry
Estates Lee Smith to fill a six month vacancy through
Special December 31, 1984. The District also recommended
Road District Mr. Smith to a full term of office commencing on
January 1, 1985 and expiring December 31, 1987.
MOTION: PRANTE moved to appoint Barry Lee Smith to
the River Bend Estate Special Road
District as recommended contingent upon
him being a registered voter.

Discussion
Richard Isham explained that some time ago, Arnold

Irrigation District Board Member, Barry Smith,

explained that they had discovered that within

Ambrosia Acres and Brightenwood Subdivisions there

are approximately 12 1/2 acres of water that was
failed to be transferred when the property was
subdivided. Since the property has been
subdivided, the distribution system that went
through Mountain High Subdivision (to the west of
Ambrosia Acres and Brightenwood) has been destroyed
and there is no method of delivering water to the
subdivisions and has not been delivered for four
years. Mr. Isham explained that water not
delivered for a period of five years can be lost.
Arnold Irrigation District desires not to lose the
system and has contacted potential people on the
distribution system to see if they are interested
in purchasing the water. Deschutes County has 2
1/2 acres of water that has been taken from the
public right of ways. Mr. Isham stated that David

L. Ipoc has contacted him to see if the County
would auction that water off to him. Mr. Isham
said that the only method of selling that property
interest would be by auction. That work necessary
to be completed by the County would consist of map
work, which the District is doing at no cost to the
County; an agreement of transfer, which would be a
sale document from such an auction; and to file the
subdivision plats showing the ownership distribu-
tion of the public right of ways where that water
is located within the district. Mr. Isham stated
that this problem should not again occur because
under the planning ordinance the irrigation
districts have to sign off on the plats making them
aware of the water. Mr. Isham stated that water
within the Arnold Irrigation system could go from
$500 - $1,000. Mr. Isham stated that the County's
alternative would be to not sell the water, which
would be lost to the downstream flow.
MOTION: PRANTE moved to put the water rights up
for auction.

Award of Bid Chairman Young read aloud a memo received from
for Recarpeting Michael Maier recommending the bid be awarded
of the Justice to Rubenstein's of Eugene. Mr. Maier explained

because of a portion of the building that will not
