ORDER NO. 84-155 REViEWc LEG COUNSEL DESCHUTES COUNTY, OREGON 4: 37 VOL 33 Phrr-- 496 WHEREAS, the Board of County Commissioners of Deschutes County, Oregon, has received the Engineer's proposed assessment for each parcel of land for the improvement of roads in Mathers L.I.D.; and WHEREAS, ORS 371.645 provides that the Board must set a public hearing by Order of the Board to hear objections to any such proposed assessment; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDERS as follows: Section 1. That the report of the Engineer, marked Exhibit "A", attached hereto and by this reference incorporated herein, is hereby accepted, and that a public hearing for the purpose of hearing objections to the proposed assessment shall be held on Wednesday, July 11, 1984, at 10:00 a.m. in the Deschutes County Courthouse Annex, Bend, Oregon. Section 2. That the Director of Public Works, on behalf of the Board of County Commissioners, mail written notice within five days of the date of said hearing to the owners of the parcels described in Exhibit "A", identifying the parcel, showing the proposed assessment, and giving notice of the hearing scheduled in Section 1 of this Order. Section 3. That the written notice to be given in Section 2 shall comply substantially with the form of notice marked Exhibit "B", attached hereto and by this reference incorporated herein. The property owners responded favorably to the remonstrated amount of $31,000.00 and the improvements were ordered by the Board of Commissioners on August 17, 1983. The original amount was based on an actual bid given to the property owners by a contractor. Fifteen (15) percent was added to the bid for engineering and administration services. Due to weather restrictions, the Public Works Department postponed this improvement until the Spring of 1984 at which time plans and specifications were prepared. The project was advertised in the Daily Journal of Commerce and the Bend Bulletin for a two week period. Six (E) firms requested plans with two (2) firms submitting bids prior to the bid deadline. The low bidder was R.L. Coats, of Bend, Oregon, in the amount of $34,500.00. The Engineer's estimate based on calculated quantities was $38,100.00 Attached for your review is the compilation of all bids showing the unit prices. UPWWWORM The original Engineer's Investigation was performed in response to Resolution Numer 83-040 which initiated the Mathers Road Local Improvement District. Due to the bid price being higher than the remonstrated cost, the Engineer has reinvestigated this project. The Engineer's reinvestigation of the Mathers Road Local Improvement District found the following: 1. In the judgement of the Public Works Director, improving this portion of Mathers Road to Deschutes County Road Standards for a Rural Local Road is feasible. 2. For this road to meet County Road Standards the following work must be I completed: a. Clearing and Grubbing - the existing road must be cleared to a width of approximately forty feet. b. Subgrade - a substantial amount construct subgrade. There will provide proper drainage. EXHIBIT "A" of earthwork will be required to be limited construction required to VOL 53 r,An 498 c. Base - placing, shaping, compacting and fine grading of base will be required. A four inch depth of compacted rock base would be utilized in conjunction with asphaltic concrete. The finish width shall be thirty-two (32) feet measured between the edge of shoulders. d. Paving - the paving will be a two (2) inch compacted depth of asphaltic concrete. The pavement will be twenty-four (24) feet in width. 3. The estimated cost for improving a portion of Mathers Road as outlined above, is: Original Estimate New Estimate a. The fairest method of assessment for this Local Improvement District would be an equal assessment for each ownership ($40,000.00/10 lots = $4,000.00 for each ownership). 5. Attached is a description, assessed value, estimated amount assessed and name of owner for each lot in the Local Improvement District. The Public Works Department has received a commitment from R.L. Coats to allow the County a grace period for remonstrance prior to awarding the bid. County Legal Counsel recommended July 11, 1984 as the earliest date for a second remonstrance hearing. The Public Works Department recommends a second remonstrance be held for Mathers Road L.I.D. in the amount of $40,000.00 to be divided equally by the ten (10) benefited properties and that the hearing date for said remonstrance be set for July 11, 1984. The Public Works Department further recommends that, if the outcome of the remonstrance is favorable, the contract for the construction of the Mathers Road L.I.D. project be awarded to the low bidder, R.L. The County Engineer has made a favorable report to the Board of County Commissioners regarding the proposed improvement. Upon completion of the proposed improvement, the roads will be accepted.into the County Road System, and will be maintained by Deschutes County. " The total estimated cost of the proposed improvement and the proposed total amount of the assessment against your land is as shown above. If you object to the proposed improvement and assessments shown in the Engineer's Report, you are required to file written objection, if any, with the Board of County Commissioners, c/o Deschutes County Department of Public Works, 61150 S. E. 27th Street, Bend, Oregon 97702, within 20 days of the date of this notice, or at the public hearing on the proposed improvement before the Board of County Commissioners, which will be held on August 17, 1983, at 10:00 a.m. in the Deschutes County Courthouse Annex, Bend, Oregon, in order to stop this improvement. If more thap 50% of the owners of land representing more than 50% of the total amount of the assessment for the proposed improvement file objections, the proposed improvement will be declared abandoned and no new resolution shall be filed within a period of one year. If the required number of objections are not received, the improvement will proceed and you will be notified of the actual assessment when it is determined by the Engineer. This assessment, as finally approved by the Board of County Commissioners, will be entered into the lien docket of Deschutes County and will be released when the assessment is paid in full.
