QUARRY AVENUE INTERSECTION DESC E LOCATED IN THE SOUTHWEST QUARTER (SW1/4) OF SECTION 1, THE SOUTHEAST QUARTER (SE1/4) OF SE C THE NORTHEAST QUARTER (NE1/4) OF SECTION 11 & THE NORTHWEST QUARTER (NW1/4) OF SECTION 2, TOWNSHIP 16 SOUTH, RANGE 12 EAST, WILLAMETTE MERIDIAN DESCHUTES COUNTY, OREGON OCTOBER 2018 NARRATIVE THIS SURVEY WAS PERFORMED TO RETRACE THE RIGHTS -OF -WAY FOR SOUTH CANAL BOULEVARD (OLD BEND-REDMOND HIGHWAY), S.W. 61ST STREET & S.W. QUARRY AVENUE, AND FOR THE ESTABLISHMENT OF SURVEY CONTROL POINTS AND PERPETUATION OF RECOVERED BOUNDARY MONUMENT POSITIONS WITHIN THE PROJECT AREA THAT COULD BE DISTURBED OR DESTROYED DURING FUTURE CONSTRUCTION ACTIVITIES. THE RIGHT-OF-WAY SHOWN HEREON FOR SOUTH CANAL BOULEVARD (OLD BEND-REDMOND HIGHWAY) WAS ESTABLISHED AS FOLLOWS: THIS ROAD WAS ORIGINALLY REFERRED TO AS THE DALLES-CALIFORNIA HIGHWAY AS SHOWN ON OREGON STATE HIGHWAY DEPARTMENT DRG. NO. 21318-4 TITLED LOCATED LINE "A", DALLES-CALIFORNIA HIGHWAY-DESCHUTES COUNTY, BEND-JEFFERSON COUNTY LINE SECTION, DATED 1919 (R1){N). A NOTE ON THE FACE OF SAID DRG. NO. 21318-4 MAP STATES "THIS ROUTE ABANDONED AS STATE HIGHWAY JULY 29, 1937". IT APPEARS THIS ROAD WAS ESTABLISHED AS A COUNTY ROAD PER COMMISSIONER'S JOURNAL 1, PAGES 242-249, DATED MARCH 26, 1920 (R1){N). THIS ORDER OF ESTABLISHMENT CREATED A 60 FOOT WIDE RIGHT-OF-WAY AND INCLUDES A CENTERLINE DESCRIPTION FOR THE PROPOSED ROADWAY, "THE CENTER LINE OF WHICH IS NOW STAKED OUT ON THE GROUND". TO DATE, NO CENTERLINE OR RIGHT-OF-WAY MONUMENTS FROM THIS 1919 SURVEY HAVE BEEN REPORTED FOUND. BECAUSE OF THIS, I BELIEVE THE AS -CONSTRUCTED CENTERLINE OF THE EXISTING ROADWAY PROVIDES THE BEST EVIDENCE AS TO THE INTENDED 1919 DESCHUTES COUNTY ROAD ALIGNMENT. A FOUND STEEL BAR (#1290) MARKING THE NORTHERLY END OF S.W. 61ST STREET, DESCHUTES-PLEASANT MARKET ROAD ALIGNMENT (SEE BELOW), AT P.I. STATION 195+58.5=CENTERLINE OF THE DALLES-CALIFORNIA HIGHWAY WAS HELD FOR THE CENTERLINE OF SOUTH CANAL BOULEVARD. THIS MONUMENT MATCHES THE AS -CONSTRUCTED CENTERLINE FOR SOUTH CANAL BOULEVARD WITHIN REASON AND PROVIDES A COMMON POINT BETWEEN ALIGNMENTS. HOLDING THIS POINT, THE RECORD BEARING FOR THE CENTERLINE OF SOUTH CANAL BOULEVARD LYING NORTHEASTERLY AND SOUTHWESTERLY OF THIS POINT WAS ROTATED TO BEST FIT THE AS -CONSTRUCTED CENTERLINE OF SOUTH CANAL BOULEVARD WITHIN THE PROJECT AREA. THE MONUMENTED NORTHWESTERLY LINE OF THAT 10.00' WIDE RIGHT-OF-WAY DEDICATION (SOUTHEASTERLY LINE OF PARCEL 2) OF PARTITION PLAT NO. 2018-9 (M) WAS HELD FOR THE NORTHWESTERLY RIGHT-OF-WAY LINE FOR SOUTH CANAL BOULEVARD NEAR THE NORTHEASTERLY EXTENTS OF THE PROJECT AREA. THE RIGHT-OF-WAY SHOWN HEREON FOR S.W. 61ST STREET (F.H. SHERWOOD ROAD ALIGNMENT) WAS ESTABLISHED AS FOLLOWS: THE LINES COMMON TO SECTIONS 1 & 2 AND SECTIONS 11 & 12 WERE HELD AS THE CENTERLINE OF THE ROAD RIGHT-OF-WAY PER THAT SURVEYOR'S REPORT AND MAP SIGNED BY THE DEPUTY COUNTY SURVEYOR FOR tCROOK COUNTY, AS FILED OCTOBER 31, 1911 (R3)(S). THIS SURVEY APPEARS TO BE THE BASIS FOR THAT `,ORDER OF ESTABLISHMENT RECORDED SHORTLY THEREAFTER IN CROOK COUNTY COMMISSIONER'S JOURNAL 5, PAGE 575. NO RIGHT-OF-WAY WIDTH WAS STATED WITHIN THESE DOCUMENTS, AND IS THEREFORE SHOWN AS 60 FEET (30' EACH SIDE OF THE SECTION LINE) PER THE STATUTORY WIDTH IN EFFECT AT THE TIME. THE RIGHT-OF-WAY SHOWN HEREON FOR S.W. 61ST STREET (DESCHUTES-PLEASANT RIDGE MARKET ROAD ALIGNMENT) SOUTHERLY OF S.W. CANAL BOULEVARD WAS ESTABLISHED AS FOLLOWS: THE CENTERLINE FOR S.W. 61 ST STREET (DESCHUTES-PLEASANT RIDGE MARKET ROAD ALIGNMENT) IS DESCRIBED WITHIN DESCHUTES COUNTY FIELD BOOK NO. 55, PAGES 1-12 TRANSIT NOTES FOR DESCHUTES-PLEASANT RIDGE MARKET ROAD (R2){P) AND ON THAT MAP OF DESCHUTES-PLEASANT RIDGE MARKET ROAD NO. 34 (R2){Q}. THE ORDER OF ESTABLISHMENT FOR THIS ROAD WAS RECORDED IN DESCHUTES COUNTY COMMISSIONERS' JOURNAL 2, PAGE 383 ON APRIL 25, 1929 (R2){R}. FOUND MONUMENTS AT P.I. STATIONS 148+87.6 (#1172) AND 195+58.5 (#1290), AS SHOWN ON COUNTY SURVEY NO. 01786 (F) WERE HELD TO DEFINE THE CENTERLINE OF THIS PORTION OF S.W. 61ST STREET. THIS SURVEY APPEARS TO BE A THOROUGH RETRACEMENT OF THE ORIGINAL 1927 DESCHUTES COUNTY SURVEY OF DESCHUTES -PLEASANT MARKET RIDGE MARKET ROAD (R2){P}{Q}. TANGENT LENGTHS FOR CURVES Cl & C2 WERE HELD PER THE ORIGINAL 1927 DESCHUTES COUNTY SURVEY WITH RADIAL DISTANCES COMPUTED BASED ON THE RESULTING ANGLES OF INCIDENCE BETWEEN THE RESOLVED TANGENTS OF S.W. 61ST AND SOUTH CANAL BOULEVARD. THE CENTERLINE CURVES BASED ON THE ORIGINAL 1927 DESCHUTES COUNTY SURVEY WERE FOUND TO BE BASED ON CHORD DEFINITION DERIVED DEGREE OF CURVATURE VALUES, WITH LENGTHS EXPRESSED AS THE SUM OF CHORD SEGMENTS (100 FEET LONG) ALONG THE OVERALL CURVE. DESCHUTES-PLEASANT RIDGE MARKET ROAD WAS ESTABLISHED BY THAT ORDER OF ESTABLISHMENT RECORDED APRIL 25, 1929 IN DESCHUTES COUNTY COMMISSIONER'S JOURNAL 2, PAGE 383 (R2){R). A PORTION OF THE F.H. SHERWOOD ROAD RIGHT-OF-WAY AS ESTABLISHED IN 1911, LYING SOUTHERLY OF SOUTH CANAL BOULEVARD, OVERLAPS THE DESCHUTES-PLEASANT RIDGE MARKET ROAD RIGHT-OF-WAY. NO VACATION DOCUMENTS WERE FOUND FOR THIS PORTION OF F.H. SHERWOOD ROAD, NOR WAS ANY LANGUAGE INCLUDED WITHIN THE DESCHUTES -PLEASANT MARKET RIDGE MARKET ROAD ESTABLISHMENT DOCUMENTS REGARDING THE EXISTENCE OF, OR INTENT TO VACATE, THE PREVIOUSLY ESTABLISHED F.H. SHERWOOD ROAD RIGHT-OF-WAY. THEREFORE, BOTH RIGHTS -OF -WAY ARE SHOWN HEREON, RESULTING IN A NON -UNIFORM WIDTH FOR S.W. 61ST STREET (SOUTHERLY OF SOUTH CANAL BOULEVARD). THE RIGHT-OF-WAY SHOWN HEREON FOR S.W. QUARRY AVENUE (M.M. WHITTEMORE ROAD ALIGNMENT) EASTERLY OF S.W. CANAL BOULEVARD WAS ESTABLISHED AS FOLLOWS: THE CENTERLINE FOR S.W. QUARRY AVENUE (M.M. WHITTEMORE ROAD) WAS ORIGINALLY DESCRIBED AS RUNNING ALONG THE NORTH LINE OF SECTION 12 PER THAT SURVEYOR'S REPORT BY ROBERT B. GOULD, DEPUTY COUNTY SURVEYOR, DATED AUGUST 31,1915 (R4)(U). THE ORDER OF ESTABLISHMENT FOR THIS ROAD WAS RECORDED IN CROOK COUNTY COMMISSIONERS' JOURNAL 5, PAGE 375 ON SEPTEMBER 2, 1915 (R4){V}. NO RIGHT-OF-WAY WIDTH WAS STATED WITHIN THESE DOCUMENTS. FENCE LINES WITHIN THIS PORTION OF THE PROJECT AREA ON THE NORTH AND SOUTH SIDES OF THE ROADWAY MEASURE APPROXIMATELY 40 FEET ACROSS. IN 2017, THE DESCHUTES COUNTY SURVEYOR'S OFFICE WAS INSTRUCTED TO DETERMINE THE SOUTHERLY RIGHT-OF-WAY LINE OF S.W. QUARRY AVENUE IN RESPONSE TO A REPORT THAT A FENCE ON TAX LOT 16-12-12-300 HAD BEEN DAMAGED BY SNOW PLOWING WORK. THE CONCLUSION OF THIS STUDY CONFIRMED THAT THE TOTAL RIGHT-OF-WAY WIDTH FOR M.M. WHITTEMORE ROAD IS 60 FEET (THE DEFAULT STATUTORY WIDTH IN 1915), WITH THE RIGHT-OF-WAY LINES BEING 30 FEET EACH SIDE OF THE SECTION LINE, AS SHOWN HEREON. THE RIGHT-OF-WAY SHOWN HEREON FOR S.W. QUARRY AVENUE (WEST WHITTEMORE ROAD ALIGNMENT) WESTERLY OF S.W. CANAL BOULEVARD WAS ESTABLISHED AS FOLLOWS: RESEARCH PERFORMED BY THE DESCHUTES COUNTY SURVEYOR'S OFFICE IN 2008 INDICATE THAT THIS RIGHT-OF-WAY WAS ESTABLISHED AND/OR LEGALIZED IN 1941 PER DESCHUTES COUNTY COMMISSIONERS' JOURNAL 4, PAGE 18 (R5){W}. PER A NOTICE OF LEGALIZATION FOR WEST WHITTEMORE ROAD DATED SEPTEMBER 17, 1941, THE CENTERLINE IS DESCRIBED AS RUNNING ALONG THE THE NORTH LINE OF SECTION 11 (HELD FOR ROAD RIGHT-OF-WAY CENTERLINE AS SHOWN HEREON), BUT NO WIDTH WAS SPECIFIED FOR THIS RIGHT-OF-WAY. NO ACTUAL RESOLUTION OR ESTABLISHMENT ORDERS WERE FOUND. PER WILLIAM F. FRYE'S PAPER TITLED "DETERMINING WIDTHS OF EXISTING RIGHTS -OF -WAY FOR COUNTY ROADS", THE LAW NARRATIVE (CONT.) OFFICIAL RECORDS N 2, NTY SURVEYOR PRESCRIBES NO STANDARD WIDTH FOR RIGHTS -OF -WAY ESTABLISHED DURING THIS TIME PERIOD AND THAT THE WIDTH OF COUNTY ROAD MUST BE STATED SUBJECT TO A SPECIFIED MINIMUM. AFTER REVIEWING AVAILABLE 1941 ESTABLISHMENT DOCUMENTS, DESCHUTES COUNTY LEGAL COUNSEL STATED THE HISTORY PROVIDED "FAVORS 40 FEET" FOR THE RIGHT-OF-WAY WIDTH OF WEST WHITMORE ROAD. THE RIGHT-OF-WAY WIDTH IS THEREFORE SHOWN AS 40 FEET, 20 FEET EACH SIDE OF THE SECTION LINE, HEREON. THE AS -CONSTRUCTED ROADWAY CROWN WAS FOUND TO LIE SOUTHERLY OF THE SECTION LINE (APPROX. 5'-6' THROUGH THE PROJECT AREA). THE 1941 NOTICE OF LEGALIZATION CALLS FOR THE NORTH LINE OF SECTION 11, RATHER THAN THE PHYSICAL ROAD, TO BE THE ROAD RIGHT-OF-WAY CENTERLINE. NO EVIDENCE WAS FOUND TO SUGGEST THAT THE SECTION LINE HAD BEEN DETERMINED TO FALL SOUTHERLY (ALONG THE AS -CONSTRUCTED ROADWAY) OF THE CURRENTLY ACCEPTED LINE AS RELATED TO THE 1941 ROAD CENTERLINE DESCRIPTION. COORDINATE SYSTEM = COORDINATE VALUES SHOWN HEREON ARE CENTRAL OREGON COORDINATE SYSTEM (COCS) GRID COORDINATES.
