HomeMy WebLinkAboutSurvey 20586SURVEYOR'S NARRATIVE _ PROPERTY LINE ADJUSTMENT I 2 THE PURPOSE OF THIS SURVEY IS TO ADJUST THE COMMON PROPERTY LINE BETWEEN THE LANDS DESCRIBED IN THE BARGAIN AND SALE DEEDS RECORDED AS INSTRUMENT NUMBERS 2017-002010 AND 2016-28552 OF DESCHUTES COUNTY OFFICIAL RECORDS, AS REQUESTED BY THE OWNER OF BOTH TRACTS, TINA LYONS. THE PROPERTY LINE ADJUSTMENT RECEIVED TENTATIVE APPROVAL BY THE DESCHUTES COUNTY PLANNING DEPARTMENT IN FILE NO.247-21-000004-LL. CONTROL FOR THIS SURVEY IS PER THE RECORD SURVEYS REFERENCED HEREIN, AND THE MONUMENTS SHOWN HELD AND SET ON THIS MAP OF SURVEY. BASIS OF BEARINGS FOR THIS SURVEY IS THE OREGON COORDINATE REFERENCE SYSTEM, BEND-KLAMATH FALLS ZONE, USING THE NAD83(2011) EPOCH 2O10.00 DATUM REALIZATION. THE LANDS DESCRIBED IN INSTRUMENT NUMBER 2017-002010 (TAX LOT 200) ARE COMPRISED OF LOT 33 OF BLOCK 2 OF LA PINE ACRES, AS WELL AS A METES AND BOUNDS DESCRIPTION OF A PORTION OF THE SE1/4 SW1/4 OF SECTION 9; THIS PORTION IN ESSENCE PROJECTS THE NORTH AND SOUTH LINES OF LOT 33 EASTERLY TO THE MIDDLE OF THE LITTLE DESCHUTES RIVER AND THE EAST LINE OF THE SE1/4 SW1/4 OF SECTION 9. THE LANDS DESCRIBED IN INSTRUMENT NO.2016-28552 (TAX LOT 102) ARE A METES AND BOUNDS DESCRIPTION OF A PORTION OF THE SE1/4 SW1/4 OF SECTION 9, AND MAKES EXPLICIT CALLS TO LOTS AND STREETS IN LA PINE ACRES AS WELL AS THE LITTLE DESCHUTES RIVER; THE NORTHERN BOUNDARY OF SAID PORTION MAKES AN IMPLICIT CALL TO THE NORTH PLAT BOUNDARY OF LA PINE ACRES, THE BEARINGS OF WHICH ARE EXACTLY THE SAME AS DESCRIBED IN THE DEED FOR THE NORTH LINE OF THE SE1/4 SW1/4 OF SECTION 9. ORIGINAL MONUMENTS FROM THE LA PINE ACRES SUBDIVISION WERE FOUND AND HELD AT BOTH NORTH CORNERS OF LOT 33 OF BLOCK 2 AND THE NORTHEAST CORNER OF LOT 30 OF BLOCK 5; NO MONUMENTS WERE FOUND AT THE SOUTH CORNERS OF LOT 33. A WITNESS CORNER SET BY SCOTT FRESHWATERS IN HIS 2011 SURVEY OF TAX LOT 7101 WAS ALSO FOUND AND HELD; THE NORTHERLY LINE OF TAX LOT 7101 IS COINCIDENT WITH THE SOUTH LINE OF TAX LOT 102 PER THE DEED DESCRIPTIONS FOR BOTH. A 1/2-INCH IRON ROD SET BY JEAN HAWTHORNE (CSO4756) AS THE SOUTH 1/4 CORNER OF SECTION 9 WAS FOUND AND HELD, AS IT HAS BEEN FOR NUMEROUS SUBSEQUENT RESURVEYS IN THE AREA. WE ALSO FOUND THE 5/8-INCH IRON ROD SET BY GEORGE COLVIN AS THE C-S 1/16 CORNER IN MINOR LAND PARTITION MP-81-59; THIS CORNER HAS ALSO BEEN HELD BY NUMEROUS SUBSEQUENT RESURVEYS. HOWEVER, IT IS SUBSTANTIALLY OUT OF POSITION WITH THE 1/16TH CORNER AS SHOWN BY R.S. ALLMON IN HIS PLAT OF LA PINE ACRES; IT IS UNCERTAIN FROM THE PLAT WHETHER ALLMON ACTUALLY SET THE 1/16TH CORNER OR NOT, BUT REGARDLESS, NO OTHER MONUMENT WAS FOUND AFTER A DILIGENT SEARCH. WE FIND IT LIKELY THAT ALLMON DID NOT ESTABLISH THE 1/16TH CORNER BY PROPER METHODS, BUT RATHER CALCULATED IT OR PROTRACTED IT, WHICH UNFORTUNATELY WAS NOT AN UNCOMMON PRACTICE IN THIS ERA, AND IN FACT, COLVIN NOTES IN HIS SURVEY OF MP-81-59 THAT ANOTHER NEARBY ALLMON SUBDIVISION PLAT BOUNDARY, GLENWOOD ACRES, ALSO DOES NOT COINCIDE WITH TRUE 1/16TH LINES. THE VESTING DEEDS FOR THE PROPERTIES SUBJECT TO THIS PROPERTY LINE ADJUSTMENT CLEARLY EXPECT THE NORTH BOUNDARY OF LA PINE ACRES TO COINCIDE WITH THE NORTH LINE OF THE SE1/4 SW1/4.OF SECTION 9, AS IT SHOULD; HOWEVER, WE FIND IT LIKELY THAT A GORE EXISTS BETWEEN THE TWO, FURTHER INVESTIGATION OF WHICH IS BEYOND THE SCOPE OF THIS PROPERTY LINE ADJUSTMENT SURVEY. FOR THE PURPOSES OF THIS SURVEY, WE HAVE HELD COLVIN'S 1/16TH CORNER MONUMENT FOR THE EAST LINE OF THE SE 1/4 SW1/4 OF SECTION 9 ONLY, AND PROTRACTED THE NORTH LINE OF LA PINE ACRES FROM THE FOUND MONUMENTS AT THE NORTH CORNERS OF LOT 33 TO DERIVE DEED INTENT, THE RESULT OF WHICH FOLLOWS AN EXISTING FENCE LINE WITHIN ONE FOOT (EXCEPT FOR A SMALL PORTION AT THE EASTERLY END WHERE THE FENCE SKEWS TOWARDS THE RIVER BANK). THE LINE BETWEEN THE ADJUSTED TRACTS WAS THEN MONUMENTED AS SHOWN ON THIS SUBJOINED MAP OF SURVEY, AND A NEW DEED REFLECTING THE ADJUSTED TRACTS WAS RECORDED WITH THE DESCHUTES COUNTY CLERK AS DOCUMENT NO. 2021-38870.
