SURVEYOR'S CERTIFICATE
1, Kevin James Blakley, a Registered Professional Land Surveyor in the
State of Oregon, being first duly sworn, depose and say that I or those
under my direct supervision have correctly surveyed and marked with
legal monuments the land shown on this subdivision plat map and the
INITIAL POINT being a 5/8 inch iron rod with yellow plastic cap marked
"SCE&S" at the Northeast corner of said Parcel 1 of Partition Plat No.
2013— 05:
Parcel 1 of Partition Plot No. 2013-05, as recorded in Partition Cabinet
4, Page 143, Records of Deschutes County, Oregon.
Containing 26,558 square feet, more or less.
SURVEYOR'S NARRATIVE
The purpose of this survey was to replat that parcel described in the
"SURVEYOR'S CERTIFICATE". Control for this survey was based on the
referenced surveys on this survey plat and existing monuments found
and set during the course of this survey. All record monuments were
found to fit very well with record distances and therefore were held
along with all record data per Partition Plat No. 2013-05, recorded as
CS18513, by Kevin James Blakley. Monuments found and set during the
course of this survey are as shown on the subjoined survey plat.
PUBLIC UTILITY NOTE
Utilities shall have the right to install, maintain and operate their
equipment above and below ground and all other related facilities within
the Public Utility Easements identified on this plat as may be necessary
or desirable to service the lots identified herein, including the right of
access to such facilities and the right to require the removal of any
obstructions including trees and vegetation that may be placed within
the P.U.E. at the lot owner's expense. At no time may any structure be
placed within the P.U.E. or any other obstruction which interferes with
the use of the P.U.E. without the prior written approval of the Utilities
and facilities in the P.U.E.
CITY OF BEND EASEMENTS
These easements are granted to the City of Bend and shall be a
permanent, perpetual and exclusive right to construct, install, maintain
and operate sewer lines and all related facilities (within sewer
easements) and water lines and all related facilities (within water
easements) on the surface and within the subsurface of these
easements. No person shall be authorized to construct, erect or install
any structure or facilities on the surface or within these easements
without first obtaining approval from the City of Bend.
DECLARATION
KNOW ALL MEN BY THESE PRESENTS, that BEND AREA HABITAT FOR
HUMANITY, an Oregon Non —Profit Coroporation, have caused said lands
to be surveyed and subdivided into lots in accordance with the
provisions of O.R.S. Chapter 92; the CITY OF BEND, beneficiary of those
trust deeds recorded as Volume 2016, Page 24707 and Volume 2016,
Page 24708, and the STATE OF OREGON, beneficiary of the trust deed
recorded as Volume 2021, Page 15146, have consented to any
dedication or donation of lands, as shown on this plat; and hereby
dedicate to the public forever the Public Access Easement and Public
Utility Easement as shown on this plat; and hereby reserve the
Stormwater Cross Drainage Easement to the Watercress Way Townhomes
Homeowners Association, as shown on this plat; and hereby grant the
Avion Easement to the Avion Water Company, as shown on this plat;
and hereby dedicate to the City of Bend the Sewer Easement as shown
on said plat; and submit for approval and record said plat of
"Watercress Way Townhomes,'; henceforth to so be known.
