The Official GLO plat and field notes indicate a standard 80 Chains per mile dist. along the North/South lines. RECORD - North between secs. 20 & 21. Var. 17*30' East. At 40.00 chains north - Set 1/4 Sec. Post from which a Pine 11 in diam bears N 70 W 130 lks dist a 3 S 45 E 138 The BLM, in 1956, under Special Instructions for Group 350, approved Ap. 2, 1958 and Group 393, approved Sept. 15, 1958, included the remonumentation of certain original corner points in Township 21 South, Range 10 East. RECORD - The 1/4 sec. cor. of secs. 20 and 21, determined at record bearing and distance from the remaining original bearing tree: A pine, 35 ins. diam., bears N. 70° W., 130 lks. dist., marked 1/4 S. At the corner point Set an iron post, 28 ins. long, 2 1/2 ins. diam., 22 ins. in the ground, with brass cap marked 1/4 S20 I S21 T21S R10E 1958 from which A p ine, 8 ins diam., bears N .32 °E ., 71 lks. dist., marked 1/4 S21 BT . A p ine, 15 ins. diam., bears N .70 °W ., 6 lks. dist., marked 1/4 S20 BT . In 1968, Jean Hawthorne, PLS 454. filed several surveys in the area which related to this corner. The dates refer to the date on the survey, not the date filed at the County. CS O4582, partial sectional breakdown of sections 16 and 21, dated May 1, 1968; CS 06803. Parkway Acres, dated May 9, 1968; (Only shows the 1/ 16 and Sec. Cor to the north) . CS O4583 Subdivision of Sec. 21, dated June 13, 1969; CS OBB86 Pine Meadow Tracts, dated July 3, 1969. In CS O4582 Hawthorne makes the following statement in his notes: "The 1/4 corner to Sections 20 & 21 an existing Brass Cap set by the B.L.M. resurveys in this area was found to be in error as the original B.T. had been found since the resurveys were made and the 1/4 corner to Sections 20 & 21 was reset according to the original G.L.O. survey data from the existing B.T." On the survey diagram Hawthorne states: SET 1/2 " X 18 " REIN. BAR N 92,130.00 E99,901.15 ORIG . B.T. FOUND EXISTING BRASS CAP IS 1.40 ' E & 1.67 ' N OF IRON BAR SET. He then shows the point he established as the 1/4 corner and indicates 4 reference trees giving the size and distance to the tree but no bearing. In the NE quadrant 8 " L . Pine 54.25 '; in the SW quadrant, 18" P. Pine, 10.05; in the NW quadrant 10" P. Pine 13.72; and a 24" P. Pine 15,32'. DESCRIPTION OF CORNER EVIDENCE FOUND: Found: 2-1/2 " brass cap on steel pipe rising 3 " above ground from which: A 1/2 in. dia, rebar at ground level bears S .48 °W ., 2.2 ft. dist. A Lodgepo le Pine sawn stump, 11 in. dia. x 7 ft. tall, bears N .34 °E ., 47.1 ft. (71 lks) . established by BLM in 1956. A Lodgepole Pine, 14" dia., bears N.67 *E., 52.2 ft. with lath nailed on the south face, established by Hawthorne at 54.25 from rebar. A two trunk Ponderosa Pine, east stem is 19 " dia., west stem is 20 in. dia., bears S .03 °E ., 11.7 ft. to the West stem with a lath nailed on the west face, established by Hawthorne at 10.05 from rebar and bears S .0 *E., 11.2 ft. to east stem with a location poster. HAM 2396 Renewal Date 6/30/23 CROSS INDEX P-09 DESCRIPTION OF CORNER EVIDENCE FOUND continued A Ponderosa Pine, 30 in. dia ., bears S .54 °W ., 14.7 ft chopped out as if someone was looking for scribing. 13.9 ft. to Hawthorne rebar. A Ponderosa Pine, 22 " dia ., bears N .70 °W ., 4.5 ft. with overgrown face, established by BLM in 1958. A sawn Ponderosa Pine stump, 35 " dia ., bears N .70 °W ., 86.8 ft- to exposed face with possible faint scribing. Original 1668 GLO BT. A Ponderosa Pine, 29 in dia., bears North 13.7 ft., with lath nailed on West face, established by Hawthorne at 15.32 ft. from rebar. I reject Hawthorns rebar as the 1/4 corner for the following reasons. 1. Hawthorne states it was not set from the original BT but the BLM notes say that it was. NOTE: in 1958 the. BLM did do some resurveying in the township but not in this area. 2. The BLM cap was set at GLO bearing and distance from the visible face while Hawthorne appears to have measured from the center of the stump. The GLO practice was to measure to the face until the Manual of 1894 changed the measure point on a BT to the center of the tree. 3. The bearing difference from the stump to the rebar and to the BLM cap is slightly over one degree. That is not enough to justify declaring the BLM to have set the monument in error and create a "pin cushion corner". Without having the original post from 1868, there is no way to say Hawthornes' measurement from the original BT was closer to the original corner position than where the BLM established the monument. 4. The BLM cap was established in 1958 and the notes were approved in 1960. Hawthorne. set his rebar in 1969, apparently without researching the BLM remonumentation notes. He appears to have thought the cap was established during a resurvey, which still would not be enough reason to reject it. 5. It should be noted that the new Reference Trees established by Hawthorne do fit the distances shown on his survey plat. It was common in this area for the private surveyors to nail a lath on the side of a tree, measure distance to the nail, and use that as corner reference. 6. I do accept the S 1/16 between sections 20 8 21 established by Hawthorne a 1/4 mile south of this corner, since it is the first monument set for that position, even though, by our measurement it is not precisely on the line between this corner and the section corner to the south.
