NARRATIVE
WE WERE COMMISSIONED BY MARILYN K. GRAGG AND BY THE ROBERT L. GRAGG
REVOCABLE LIVING TRUST, OWNERS, TO PARTITION THE PROPERTY DESCRIBED IN
BARGAIN AND SALE DEED DOCUMENT NO. 1994-045321.
IN THE SURVEY OF THIS PARTITION, THOSE MONUMENTS SHOWN AS FOUND
WERE TIED WITH OUR GPS EQUIPMENT. ALL MONUMENTS FOUND AT THE
CORNERS OF PROPERTY WERE HELD AS SHOWN. THE MONUMENT AT THE
NORTHWEST 1116 CORNER WAS ALSO HELD, ESTABLISHING THE BOUNDARY OF
THE PARTITION.
MONUMENTS FOUND AS SHOWN TO THE WEST OF THE PROPERTY ON BOTH THE
NORTH AND SOUTH RIGHT—OF—WAY OF SISTERS—REDMOND HIGHWAY 126 WERE
HELD, AND THE EASTERLY PROLONGATION OF THE LINES BETWEEN SAID
MONUMENTS ESTABLISHED THE HIGHWAY ALIGNMENT THROUGH THE PROPERTY.
THE CALCULATED RIGHT—OF—WAY MATCHES THE WIDTH OF 60.00 FEET AS
SHOWN THE ON THE ASSESSOR'S MAP, AS PER WARRANTY DEED 157-1268.
RESEARCH WAS CONDUCTED REGARDING THE OWNERSHIP OF THE AREA OF THE
PROPERTY CONTAINING THE STATE HIGHWAY RIGHT—OF—WAY, DURING WHICH
COUNTY HISTORICAL RECORDS, COUNTY ROAD RECORDS, STATE HIGHWAY
RECORDS, AND ORIGINAL LAND PATENT RECORDS WERE ALL INSPECTED TO
DEFINE OWNERSHIP OF THE RIGHT—OF—WAY. THE RESOLUTION OF THE
HIGHWAY OF THE REDMOND TO SISTERS BRANCH OF THE MCKENZIE HIGHWAY
WAS RECORDED JANUARY 1, 1921 IN COMMISSIONER'S JOURNAL 1, PAGES
300-301, AND PAGE 308, WITH A RIGHT OF WAY WIDTH OF 60 FEET. THE
HIGHWAY WAS THEN ESTABLISHED BY ORDER OF THE DESCHUTES COUNTY
COMMISSIONERS ON SEPTEMBER 19, 1921 AS RECORDED IN DESCHUTES
COUNTY COMMISSIONERS JOURNAL 1, PAGES 375-376. IN 1939, THE
MCKENZIE HIGHWAY WAS ESTABLISHED AS A STATE HIGHWAY UNDER OREGON
LAWS 1939 CHAPTER 529, SECTION 15, 1, PER THE MARCH 2O20 OREGON
DEPARTMENT OF TRANSPORTATION (ODOT) PUBLICATION `HISTORY OF STATE
HIGHWAYS IN OREGON'. FURTHER CONSULTATION WITH ODOT LED TO THE
CONCLUSION THAT THE STATE DOES NOT HAVE FEE OWNERSHIP OF THE
HIGHWAY RIGHT—OF—WAY, BUT INSTEAD IT EXISTS BY EASEMENT. THE ODOT
SURVEYOR AND RIGHT—OF—WAY DEPARTMENT FURTHER STATED THAT THE
UNDERLYING FEE IS THE ABUTTING LAND OWNERS OF THE EASEMENT.
THE LOCATION OF THE DEDICATION DUE TO THE ROAD ENCROACHMENT ON
BUCKHORN LANE WAS DETERMINED BY LOCATING THE EXISTING ASPHALT PAVING.
THE BEARINGS FOR THIS SURVEY WERE BASED ON THE WEST LINE OF THE
NW 1 /4 OF SECTION 12 PER REFERENCE SURVEY H.
