MUNSON 80548PLS RENEWS: 12/31/2022 W.O. # 22-009 PLATE ONE OF TWO SURVEYOR'S NARRATIVE THE PURPOSE OF THIS SURVEY IS TO MAP AND MONUMENT THE CORNERS AND LINES OF THAT PROPERTY DESCRIBED IN THE STATUTORY WARRANTY DEED RECORDED AS DOCUMENT NO. 2021-65248 IN DESCHUTES COUNTY OFFICIAL RECORDS, AS REQUESTED BY THE OWNER, GOAL DEVELOPERS LLC. CONTROL FOR THIS SURVEY IS PER THE SURVEYS OF RECORD REFERENCED HEREIN AND THE MONUMENTS SHOWN AS HELD AND SET ON THIS MAP OF SURVEY. THE LEGAL DESCRIPTION IN THE VESTING DEED ESSENTIALLY CONFORMS TO TRACT #1 OF MINOR LAND PARTITION NO. MP-78-12, AS SURVEYED BY GEORGE COLVIN. HOWEVER, COLVIN'S SURVEY HAS A COUPLE OF NOTABLE ISSUES: FIRSTLY, COLVIN'S MAP APPEARS ONLY TO BE MAPPING TRACT 24 AND A PORTION TRACT 19 OF WARD'S TRACTS (STATED AS TRACT 19A IN ERROR IN COLVIN'S SURVEY), ALL WEST OF AND ABUTTING HUNTER ROAD AS PLATTED BY AUBREY PERRY IN HIS SUBDIVISION OF WARD'S TRACTS. BUT UPON CLOSER INSPECTION OF THE MAP AND OTHER SURVEYS AND DEED DESCRIPTIONS, IT IS EVIDENT THAT COLVIN'S PLAT BOUNDARY INCLUDES THE VACATED PORTION OF HUNTER ROAD, AND EXCLUDES TRAVIS ROAD ALONG THE WESTERN EDGE OF THE PLAT. RICHARD GRAUE PERPETUATED THE SAME AMBIGUITY IN HIS SURVEY OF TRACT 24 IN 1966, WHICH UPON CLOSER INSPECTION IS CLEAR THAT IT ALSO INCLUDES A PORTION OF HUNTER ROAD (VACATED IN 1964) AND EXCLUDES TRAVIS ROAD. SECONDLY, UPON CLOSER ANALYSIS, COLVIN'S PARTITION BOUNDARY DOES NOT MATHEMATICALLY CLOSE BY 0.47 FEET, AND INDEED, EVEN A CURSORY INSPECTION OF THE PLAT BOUNDARY BEARINGS & DISTANCES INDICATES THAT IT WOULD NOT CLOSE. WE MADE A DILIGENT SEARCH FOR ALL OF COLVIN'S SET MONUMENTS TO DERIVE TRUE INTENT. MOST OF OUR CALCULATED SEARCH LOCATIONS WERE AT OR NEAR FENCES OR UTILITY INSTALLATIONS, AND WERE NOT FOUND; HOWEVER, WE DID FIND ONE OF COLVIN'S MONUMENTS AT THE NORTHWEST CORNER OF TRACT #2. THIS MONUMENT FIT WELL WITH OUR BOUNDARY RESOLUTION DESCRIBED FURTHER BELOW, AND WE HELD ITS POSITION AS THE TRUE INTENTION OF PARTITIONER IN 1978. THE ERROR'S IN COLVIN'S LAND PARTITION APPEAR TO HAVE BEEN PROPAGATED THROUGH SUBSEQUENT DEED CONVEYANCES, PARTICULARLY IN TRACT #2, WHICH WAS SOLD BY THE ORIGINAL PARTITIONER IN 1978, SHORTLY AFTER THE PARTITION PLAT WAS APPROVED (BOOK 269, PAGE 568, DEED RECORDS), AND DOES NOT INCLUDE ANY OF VACATED HUNTER ROAD. A CORRECTION DEED WAS SUBSEQUENTLY RECORDED BY THE PARTITIONER (VOLUME 51, PAGE 406, OFFICIAL RECORDS) THAT ACKNOWLEDGED THAT THE ORIGINAL CONVEYANCE OF TRACT #2 DID NOT ACCOUNT FOR THE VACATION OF HUNTER ROAD. HOWEVER, FURTHER SUBSEQUENT CONVEYANCES OF BOTH TRACTS AGAIN USED INCORRECT LEGAL DESCRIPTIONS, PERPETUATING UNCERTAINTY. THESE UNCERTAINTIES WERE MORE RECENTLY RESOLVED IN 2001, WHERE THE DEVISEES OF THE ORIGINAL PARTITIONER QUITCLAIMED A PORTION OF HUNTER ROAD TO -THE OWNERS OF TRACT #2 (DOC. NO.2001-40153, OFFICIAL RECORDS), AND IN 2015, WHERE THE OWNERS OF TRACT #2 QUITCLAIMED A PORTION OF TRACT 24 OF WARD'S TRACTS TO THE OWNERS OF TRACT #1 OF MP-78-12 (DOC. NO. 2015-11717, OFFICIAL RECORDS). NO CONFLICT IN DEEDED PROPERTY CURRENTLY EXISTS BETWEEN THE TWO TRACTS OF MINOR LAND PARTITION NO. MP-78-12. THE CURRENT VESTING DEED TO TRACT #1 REFERENCED ABOVE IS CORRECT IN ITS ENTIRETY; TRACT #2 LACKS A SINGLE UNIFYING DEED DESCRIBING ITS CURRENT BOUNDARIES, AND FOR BREVITY'S SAKE, IS REFERRED TO ONLY AS TRACT #2 IN THIS SUBJOINED MAP. WITH THE CORRECT LEGAL DESCRIPTIONS NOW RESOLVED, WE REESTABLISHED THE SOUTH LINE OF RAE ROAD BY HOLDING FOUND MONUMENTS AT THE SOUTHEAST CORNER OF MINOR LAND PARTITION MP-78-13 AS SURVEYED BY BILL KAUFFMAN, AND THE SOUTHEAST CORNER OF LOT 4 OF PATRIA ACRES AS SURVEYED BY EDGAR GRAVES. THE SOUTHEAST CORNER OF HUNTER ROAD (NOW VACATED) WAS REESTABLISHED BY HOLDING GRAVES' RECORD DISTANCE FROM THE AFOREMENTIONED SOUTHEAST CORNER OF LOT 4. THE SOUTHEAST CORNER OF TRACT 24, ALSO BEING THE SOUTHWEST CORNER OF HUNTER ROAD, WAS REESTABLISHED BY HOLDING THE RECORD PLAT RIGHT-OF-WAY WIDTH OF 50 FEET. THE SOUTHWEST CORNER OF THE SUBJECT PROPERTY WAS REESTABLISHED BY HOLDING THE DEEDED 50.00-FOOT RIGHT-OF-WAY WIDTH OF TRAVIS ROAD. THE SOUTHEAST CORNER OF THE SUBJECT PROPERTY WAS REESTABLISHED BY HOLDING RECORD DEED DISTANCES. WE THEN OFFSET THIS LINE THE DEED DISTANCE OF 50 FEET EASTERLY TO REESTABLISH THE EASTERLY RIGHT-OF-WAY LINE OF TRAVIS ROAD AND THE WESTERLY LINE OF THE SUBJECT PROPERTY. THE EASTERLY LINE OF HUNTER ROAD WAS REESTABLISHED BY HOLDING OUR AFOREMENTIONED RESOLVED SOUTHEAST CORNER OF THE SAME, AND GRAVES' WITNESS CORNER FOR THE NORTHWEST PLAT BOUNDARY OF PATRIA ACRES, WHICH HAS BEEN HELD BY NUMEROUS SUBSEQUENT SURVEYS IN THE AREA. WE THEN PROJECTED THAT RESOLVED EASTERLY LINE NORTHERLY A RECORD DISTANCE OF 30 FEET TO REESTABLISH THE NORTHEAST CORNER OF HUNTER ROAD (ALSO BEING THE SOUTHEAST CORNER OF TRACT 19A). THE EASTERLY CORNER COMMON TO TRACTS #1 AND #2 OF MP-78-12 WAS REESTABLISHED AT RECORD DEED DISTANCE. WE FOUND AN ORIGINAL IRON PIPE SET BY PERRY AT THE NORTHEAST CORNER OF TRACT 24, AND HELD IT ACCORDINGLY FOR THE WESTERLY LINE OF HUNTER ROAD, PROJECTING SAID LINE NORTHERLY AS SHOWN. THIS SAME IRON PIPE WAS USED TO REESTABLISH THE NORTHERLY LINE OF TRACT 24 IN CONJUNCTION WITH THE MONUMENT SET BY BOB KARL AT THE NORTHWEST CORNER OF SAID TRACT. THE SOUTH LINE OF TRACT 19A WAS REESTABLISHED BY HOLDING THE AFOREMENTIONED SOUTHWEST CORNER OF THE SAME AS RESET BY MANLEY AND OUR CALCULATED SOUTHEAST CORNER DISCUSSED ABOVE. THE DEED CALLS THE SOUTH HALF OF THE THIS STRIP BETWEEN TRACT 19A AND TRACT 24 (THE "FLAGPOLE" OF TRACT 19, PROJECTED FURTHER THROUGH HUNTER ROAD) AS BELONGING TO OUR CLIENT, AND WE HAVE MONUMENTED IT ACCORDINGLY. AN IRON ROD SET BY SUN COUNTRY ENGINEERING & SURVEYING WITH MINOR LAND PARTITION MP-78-50 LIES NEARBY OUR RESOLVED NORTHEAST CORNER OF THE SUBJECT PROPERTY, AND WAS NOTED AS VERY LOOSE AT THE TIME OF THIS SURVEY; ALTHOUGH THIS MONUMENT IS CLOSE IN OUR RESOLVED NORTHING POSITION, IT IS SUBSTANTIALLY OUT OF PLACE IN EASTING AND THE ACCEPTED WEST LINE OF PATRIA ACRES, WHICH IS A REPLAT OF TRACT 25 OF WARD'S TRACTS. A CLOSER EXAMINATION OF SUN COUNTRY'S PARTITION MAP REVEALS THAT THE PLAT BOUNDARY DOES NOT CLOSE WITHIN 0.84 FEET IN EASTING. ALTHOUGH SUN COUNTRY'S MEASURED SOUTH LINE OF TRACT 19A OF WARD'S TRACTS APPEARS TO BE CORRECT, FOR REASONS UNKNOWN, THE DISTANCE ALONG THE SOUTH LINE OF THE PLAT BOUNDARY OF MINOR LAND PARTITION MP-78-50 IS QUITE DIFFERENT, EVEN THOUGH THE LINES ARE SUPPOSED TO BE PARALLEL AND ONLY 15 FEET APART. WE BELIEVE THIS MONUMENT WAS SET IN ERROR AND/OR SUBSEQUENTLY DISTURBED, AND WE HAVE REJECTED IT ACCORDINGLY. INDEED, LATER RESURVEYS BY SUN COUNTRY IN TRACT 18 OF WARD'S TRACTS AND PARTITION PLAT 1991-17 HAVE USED GRAVES' MONUMUENT AT THE NORTHWEST OF CORNER OF PATRIA ACRES AND DID NOT REFERENCE THEIR OLDER SET MONUMENT AT THE SOUTHEAST CORNER OF MP-78-50. THE EXTERIOR LINES AND CORNERS OF THE SUBJECT BOUNDARY THUS REESTABLISHED, WE THEN MONUMENTED THE MISSING CORNERS. ALONG THE NORTH LINE OF THE SUBJECT PROPERTY, A LANDSCAPE BERM CONSTRUCTED BY OWNERS OF PARCEL 3 OF MINOR LAND PARTITION MP-78-50 LIES OVER A PORTION OF THE WESTERLY PART OF THIS LINE, AND A LOW LAVA ROCK RETAINING WALL IS BUILT ALONG THE EASTERLY PORTION OF THIS SAME LINE. THE EDGE OF A PAVED DRIVEWAY FOR THIS SAME PARCEL FOLLOWS THE BOUNDARY LINE VERY CLOSELY. A CHAIN LINK FENCE BELONGING TO THE OWNERS OF LOT 3 OF PATRIA ACRES WAS BUILT TO GRAVES' WITNESS CORNER, RATHER THAN THE TRUE NORTHWEST CORNER OF THE LOT, AND AS SUCH, SKEWS EASTERLY AWAY FROM OUR CLIENT'S PROPERTY FROM THE SOUTHWEST CORNER OF LOT 3. REMNANTS OF A MUCH OLDER FENCE WERE FOUND CLOSER TO OUR RESOLVED EASTERLY LINE. A WAVY WIRE FENCE NEAR THE COMMON PROPERTY LINES BETWEEN TRACTS #1 AND #2 OF MINOR LAND PARTITION NO. MP-78-12 GENERALLY FOLLOW WITH ONE FOOT OF OUR RESOLVED LINE BETWEEN THE TWO. NO OTHER UNUSUAL CONDITIONS WERE ENCOUNTERED DURING OUR SURVEY.
