NARRATIVE
WE WERE COMMISSIONED BY COREY CLARK TO PARTITION HIS PROPERTY, WHICH
IS DESCRIBED IN BARGAIN AND SALE DEED DOCUMENT NO. 2013-038674
(REFERENCE DEED E).
IN THE SURVEY OF THIS PARTITION, THOSE MONUMENTS SHOWN AS FOUND
WERE TIED WITH OUR GPS EQUIPMENT. THE POSITION OF THE THE INITIAL
POINT, FOUND AND HELD AS THE NORTHEAST CORNER OF THE SUBJECT
PARCEL, CLOSELY MATCHED FOR RECORD DISTANCE ALONG THE EAST LINE TO
THE CALCULATED CENTERLINE OF UMATILLA AVENUE PER REFERENCE SURVEY C.
THE CENTERLINE OF UMATILLA AVENUE WAS CALCULATED BY HOLDING THE
RECORD ROAD HALF -WIDTH FROM A MONUMENT FOUND AT A PROPERTY
CORNER ON THE NORTH RIGHT-OF-WAY PER REFERENCE SURVEY A, AND
GOING TO THE SOUTH 1116 CORNER AS SHOWN. THE LINE ESTABLISHED BY
MONUMENTS FOUND ON THE WEST RIGHT-OF-WAY OF SW 21ST STREET WERE
OFFSET BY THE RECORD ROAD WIDTH TO ESTABLISH THE WEST LINE OF THE
SUBJECT PROPERTY. THE EAST LINE OF THE SUBJECT PROPERTY WAS HELD
PARALLEL WITH THE CALCULATED WEST LINE AT THE INITIAL POINT AS SHOWN
PER REFERENCE SURVEY C AND AS DESCRIBED PER REFERENCE DEED E, AND
CLOSELY MATCHED THE FOUND MONUMENTS ALONG SAID EAST LINE. THE
NORTH AND SOUTH LINES WERE HELD PARALLEL WITH THE CENTERLINE OF
UMATILLA AVENUE PER REFERENCE DEED E THE POSITION OF THE SOUTH
LINE WAS ESTABLISHED BY HOLDING THE RECORD ROAD HALF -WIDTH OF
UMATILLA AVENUE.
THE BEARINGS OF THIS PARTITION ARE BASED ON THE SOUTH LINE OF THE
NE1/4 SE114 OF SECTION 20, BEING THE CENTERLINE OF UMATILLA AVENUE,
AS PER REFERENCE SURVEY D.

PUBLIC UTILITY EASEMENT NOTE
THE PUBLIC UTILITY EASEMENT (PUE) SHALL BE USED TO CONSTRUCT AND MAINTAIN
PUBLIC UTILITIES (UTILITIES) INCLUDING BUT NOT LIMITED TO CITY WATER, SEWER AND
STORM DRAINAGE UTILITIES AND GAS, ELECTRICAL, PHONE AND COMMUNICATIONS
SERVICES AND FOR UNRESTRICTED INGRESS AND EGRESS TO AFFECTED PROPERTIES FOR
THE PURPOSE OF INSTALLING, REPAIRING, TESTING, MAINTAINING, AND REPLACING THE
UTILITIES AND RELATED FACILITIES. THE PUE SHALL BE NON-EXCLUSIVE EXCEPT THAT
THE CITY AND UTILITIES SHALL HAVE THE EXCLUSIVE RIGHT TO CONSTRUCT, INSTALL,
MAINTAIN AND OPERATE THE UTILITIES, THEIR EQUIPMENT AND ALL RELATED FACILITIES
ABOVE AND BELOW GROUND WITHIN THE PUE INCLUDING THE RIGHT OF ACCESS TO

SIDEWALKS OR OTHER USES THAT WILL NOT AFFECT THE ABILITY OF THE CITY OR
UTILITIES TO ACCESS THE PUE PROHIBITED USES SHALL CONSIST OF, BUT ARE NOT
LIMITED TO, PERMANENT STRUCTURES, BUILDINGS INCLUDING PORCHES AND ROOF EAVES
OR COMPONENTS AND APPURTENANCES THEREOF, OR ANY OTHER HORIZONTAL OR
VERTICAL ENCROACHMENT, OBSTRUCTION, EXCAVATION OR ALTERATION OF THE PUE THE
PUE SHALL PERPETUALLY ENCUMBER ALL AFFECTED PROPERTIES. CITY AND UTILITIES
SHALL BE RESPONSIBLE FOR THE MAINTENANCE OF THE UTILITIES AND RELATED
FACILITIES LOCATED WITHIN THE PUE. ALL AFFECTED PROPERTIES AND PROPERTY
OWNERS SHALL BE RESPONSIBLE FOR LANDSCAPE AND SURFACE MAINTENANCE WITHIN
THE PUE. CITY AND UTILITIES USE OF THE PUE SHALL NOT UNREASONABLY INTERFERE
WITH OWNER'S USE OF ITS PROPERTY. THE CITY AND UTILITIES DO HEREBY AGREE TO
DEFEND, HOLD HARMLESS, AND INDEMNIFY AFFECTED PROPERTIES AND OWNERS, THEIR
SUCCESSORS AND ASSIGNS, FROM ANY CLAIM OF LIABILITY OR ANY OTHER CLAIM
