THE SOUTHWEST ONE -QUARTER OF SECTION 9 WAS BROKEN DOWN USING THE FOUND MONUMENTATION SHOWN HERON SHEET 1. THE CALCULATED EAST ONE -SIXTEENTH CORNER COMMON TO SECTIONS 8 AND 17,
AND THE WEST ONE -SIXTEENTH CORNER COMMON TO SECTIONS 9 AND 16 ARE PERPETUATED POSITIONS OF FORMER IRON RODS THAT WERE HELD BY SURVEYS IN THE AREA, THESE POSITIONS WERE NOT
ESTABLISHED BY PROPORTIONATE MEASUREMENT (MID -POINT), THEY WERE ESTABLISHED BY HOLDING RECORD SURVEY DATA AND EXTENSIONS OF MONUMENTED LINES OR CENTERUNES. THE NORTH LINE OF THE SOUTH
ONE-HALF OF SECTION 9 PRESENTS SOME CHALLENGES. THERE WERE MULTIPLE SURVEYS THAT RESOLVED THIS LINE WHICH RESULTED IN MULTIPLE MONUMENTS AT THE CENTER ONE -QUARTER AND THE CENTER WEST
ONE -SIXTEENTH CORNER OF SAID SECTION. BECAUSE OF THIS NOT ALL BOUNDARIES AGREE WITH ONE SET OF MONUMENTS, NOR DO THEY ALL AGREE WITH THE LINE DERIVED BY THIS SURVEY'S SECTION BREAKDOWN.
IT IS NOT THE INTENTION TO USE THIS SECTION BREAKDOWN TO RESOLVE ALL THE BOUNDARY LINES. THIS SECTION BREAKDOWN WILL BE USED TO RESOLVE THOSE BOUNDARIES WHERE COMMON MONUMENTS WERE
HELD BY PREVIOUS SURVEYS. THERE ARE BOUNDARIES ON THIS SURVEY WHERE DIFFERENT MONUMENTS FOR A COMMON CORNER POSITION WERE ACCEPTED FOR RESOLVING DIFFERENT BOUNDARIES. THE METHODS
USED TO DERIVE THE BOUNDARIES WILL BE DISCUSSED IN THE FOLLOWING PARAGRAPHS.
THE CENTERUNE OF BERG LANE WAS ESTABLISHED BY HOLDING THE MONUMENTATION PER MAJOR PARTITION MJP-86-1 (R8). THE WESTERLY RIGHT-OF-WAY OF SAID BERG LANE BEING 30.00 FEET FROM CENTERUNE
AND THE WESTERLY ONE-HALF OF THE 150.00 FOOT RADIUS CUL-DE-SAC WAS DEDICATED PER SAID MAJOR PARTITION MJP-86-1. THE EASTERLY RIGHT-OF-WAY OF SAID BERG LANE BEING 30.00 FROM
CENTERUNE AND EASTERLY ONE-HALF OF THE 150.00 FOOT RADIUS CUL-DE-SAC WAS DEDICATED PER DEED VOLUME 150, PAGE 1362, RECORDED AUGUST 26, 1987, OFFICIAL RECORDS OF DESCHUTES COUNTY.
THE NORTHERLY RIGHT-OF-WAY LINE OF COOLEY ROAD WAS ESTABLISHED BY HOLDING THE FOUND MONUMENTATION AND RECORD CURVE DATA PER MINOR PARTITION MP-83-2 (R2) AND MAJOR PARTITION
MJP-86-1 (R8). PORTIONS OF THE ORIGINAL 40 FOOT WIDE COOLEY ROAD ALIGNMENT WERE VACATED PER VOLUME 35, PAGE 617, RECORDED SEPTEMBER 08, 1980 AND VOLUME 36, PAGE 108, RECORDED OCTOBER
15, 1980. A NEW RIGHT-OF-WAY WAS DEDICATED BY DEED PER VOLUME 324, PAGE 768, RECORDED ON JULY 11, 1980, DEED RECORDS OF DESCHUTES COUNTY. SAID DEED DEDICATED "A STRIP OF LAND 80 FEET
WIDE, LYING 40 FEET ON EACH SIDE OF THE CENTERLINE OF COOLEY ROAD AS IT FOLLOWS THE CENTERLINE OF THE EXISTING PAVING OF THIS DAY". SAID DEDICATION WAS FOR A PORTION OF COOLEY ROAD
LOCATED IN THE EAST ONE-HALF OF THE SOUTHEAST ONE -QUARTER OF SECTION 8, AND THE WEST ONE-HALF OF THE SOUTHWEST ONE -QUARTER OF SECTION 9. SINCE THE DEED CALLS TO THE CENTERUNE OF

FOUND 5/8" IRON ROD PER MINOR LAND PARTITION MP-80-13 (R4) BEING THE NORTH WEST CORNER OF SAID PARTITION PLAT NUMBER 1993-62. SAID PARTITION PLAT NUMBER 1993-62 DID DEDICATE A 60.00
FOOT RIGHT-OF-WAY WIDTH FOR THIS ROAD. THE EAST AND WEST RIGHT-OF-WAY LINES ESTABLISHED BY THIS SURVEY WERE NOT PARALLEL BASED ON THE TIED MONUMENTS, RESULTING A VARIABLE WIDTH
RIGHT-OF-WAY. HOWEVER SAID RIGHT-OF-WAY MAINTAINS ITS DEDICATED WIDTH OF 60 FEET AND DOES NOT VARY UNDER SAID 60 FEET IN WIDTH.

ONE-HALF OF SECTION 9. AS A RESULT MANY DEED DESCRIPTIONS WERE WRITTEN BASED ON THE IRON ROD FOR LANDS IN THE EAST ONE-HALF OF SECTION 9. LATER SURVEYS IN THE WEST ONE-HALF OF
SECTION 9 PRIMARILY HELD THE SCRIBED 'X' AS THE CENTER ONE -QUARTER AFTER THE IRON ROD WAS SET, SUCH AS CS13561 (R26) BEING THE OUTBOUNDS SURVEY FOR "HIGHLAND COMMERCIAL PARK" (R31).
THE REASONING FOR NOT HOLDING THE SCRIBED 'X' FOR THE CENTER ONE -QUARTER IS NOT EXPLAINED ON THE FACE OF CS02313 (R10), SAID SURVEY SHOWS A SECTION BREAKDOWN AND DOES SHOW SOME
EXISTING OCCUPATION AGREEING WITH THE NEW LINES. THE LATER MINOR PARTITION BY KARL CS02315 (R12) STATED THAT THE SCRIBE 'X' WAS APPARENTLY SET BY ARNDORFER IN 1965 BUT WAS NOT SET
FROM A CORRECT SUBDIVISION OF SECTION 9 AND HELD SUTTON'S IRON ROD BECAUSE SUTTON CORRECTLY SURVEYED SECTION 9. ARNDORFER'S SURVEY DOES SHOW WHAT CONTROLLING MONUMENTS WERE
FOUND SURROUNDING SECTION 9 AND BEYOND FOR THOSE NOT FOUND, HOWEVER THE METHODOLOGY OF HOW THE CENTER ONE -QUARTER WAS ESTABLISHED WAS NOT EXPLAINED OR ILLUSTRATED CLEARLY.
BECAUSE THE SCRIBED 'X' WAS ESTABLISHED PRIOR TO SUTTON'S IRON ROD AND HAS BEEN HEAVILY RELIED UPON FOR LANDS IN THE WEST ONE-HALF OF SECTION 9 THIS SURVEY HELD THE SCRIBED 'X' AS
THE CENTER ONE -QUARTER OF SECTION 9 FOR ESTABLISHING LINES AND PERPETUATING POSITIONS THAT PREVIOUSLY RELIED UPON SAID SCRIBED 'X'. HOWEVER SINCE SUTTON'S IRON ROD WAS HEAVILY RELIED
