THE PURPOSE OF THIS SURVEY IS TO ESTABLISH PROJECT SURVEY CONTROL, RESOLVE THE RIGHTS OF WAY OF
WILSON AVENUE, 9TH STREET, 15TH STREET AND WILDCAT DRIVE; AND TO MEMORIALIZE EXISTING MONUMENTS
THAT MAY BE DESTROYED DURING THE CONSTRUCTION OF ROADWAY AND UTILITY IMPROVEMENTS PURSUANT TO
ORS 209.155.
THE EAST -WEST CENTER LINE OF SECTION 4 WAS RETRACED BY HOLDING THE WEST ONE -QUARTER CORNER OF
SECTION 4 (#1137), THE CENTER ONE -QUARTER CORNER OF SECTION 4 (#1127) AND THE PUBLISHED COCS
COORDINATE FOR THE ONE -QUARTER CORNER COMMON TO SECTIONS 3 & 4. THE MONUMENT (#1129) FOUND AT
THE EAST ONE -QUARTER CORNER WAS NOT HELD DUE TO IT BEING BENT IN A SOUTHERLY DIRECTION.
THE EAST LINE OF SECTION 4 WAS RETRACED BY HOLDING THE SOUTHEAST CORNER OF SECTION 4 (#1138), THE
PUBLISHED COCS COORDINATE FOR THE ONE -QUARTER CORNER COMMON TO SECTIONS 3 & 4 AND THE
CALCULATED POSITION FOR THE NORTHEAST CORNER OF SECTION 4 AS DETAILED HEREON.
THE NORTH LINE OF THE NORTHWEST ONE -QUARTER OF THE SOUTHWEST ONE -QUARTER OF SECTION 3 WAS
ESTABLISHED BY HOLDING THE PUBLISHED COCS COORDINATE FOR THE ONE -QUARTER CORNER COMMONS TO
SECTIONS 3 & 4 AND MONUMENT (#1190) SET IN CS03590 (R9).
THE PROPERTY ENCOMPASSING PRESENT DAY WILSON AVENUE AND 9TH STREET, EAST OF THE BURLINGTON
NORTHERN SANTA-FE RAILROAD, WAS ORIGINALLY PLATTED IN THE PLAT BEND PARK (R1) AND SUBSEQUENTLY
VACATED BY THE CITY OF BEND PER ORDINANCE NO. 338 RECORDED NOVEMBER 12, 1946 IN BOOK 77, PAGE 503. A
SEARCH THROUGH COUNTY CLERK RECORDS FOUND THAT THE CITY OF BEND ACQUIRED LOTS 1-16, BLOCK 62 OF
BEND PARK (R1) IN THAT DEED RECORDED DECEMBER 30, 1918, AS VOLUME 24, PAGE 265; AND A 72 ACRE TRACT
OF LAND DESCRIBED IN CORRECTION DEED RECORDED MARCH 16, 1949 AS BOOK 89, PAGE 379.
IN THE 1950'S THE CITY CONVEYED PROPERTY WITHIN THE 72 ACRE TRACT BY METES AND BOUNDS DESCRIPTION
TO WILLIAM AND CONSTANCE MILLER IN DEED VOLUME 115, PAGE 53; AND LEONARD LUNDGREN IN DEED VOLUME
107, PAGE 384 AND LELCO IN DEED VOLUME 271, PAGE 274, RETAINING STRIPS OF LAND THAT MAKE UP THE
ORIGINAL ROADWAYS OF WILSON AVENUE AND 9TH STREET. ACCEPT FOR WHAT IS SHOWN HEREIN, NO RIGHT OF
WAY DEDICATIONS WERE FOUND FOR THE ORIGINAL ROADWAYS.
WILSON AVENUE
THE NORTHERLY RIGHT OF WAY OF WILSON AVENUE, WEST OF SE CENTENNIAL STREET, WAS ESTABLISHED IN THE
PLAT OF BEND PARK (R1), AND WAS PLACED BY FITTING THE RECORD SHAPE OF SAID (R1) TO MONUMENTS #1160 &
#1165, FOUND IN CS13616 (R19). THE NORTHERLY RIGHT OF WAY OF WILSON AVENUE, BETWEEN SE CENTENNIAL
STREET AND THE WEST LINE OF THE BURLINGTON NORTHERN RIGHT OF WAY WAS ESTABLISHED IN THAT
WARRANTY DEED TO THE CITY OF BEND IN DEED VOLUME 266, PAGE 205 AND PLACED PARALLEL WITH AND 40.00
FEET NORTHERLY OF SAID EAST -WEST CENTER LINE OF SECTION 4.
THE SOUTHERLY RIGHT OF WAY OF WILSON AVENUE, WEST OF THE BURLINGTON NORTHERN SANTA-FE RAILROAD,
WAS ESTABLISHED IN THE PLAT CLEAR SKY ESTATES (R4), PARALLEL WITH AND 30.00 FEET SOUTH OF SAID
EAST -WEST CENTER LINE OF SECTION 4. SAID PLAT (R4) ESTABLISHED THE EAST -WEST CENTER LINE OF SECTION
4 BETWEEN THE CENTER ONE -QUARTER CORNER, SHOWN AS A 2- BRASS CAP, AND THE CENTER -WEST 1/16
CORNER, SHOWN AS A SET 2" BRASS CAP IN LAMP HOLE. ADDITIONALLY, (R4) SHOWS 2" BRASS CAPS SET AT
INTERMEDIATE STREET CENTER LINE INTERSECTIONS AND THE EAST -WEST CENTER LINE OF SAID SECTION 4.
SUBSEQUENTLY, AN UNRECORDED REPLAT OF CLEAR SKY ESTATES (R18) RECOVERED PK NAILS ALONG SAID
EAST -WEST CENTER LINE. WE SEARCHED FOR AND FOUND NO MONUMENTS ALONG SAID EAST -WEST CENTER LINE
WITHIN THE BOUNDS OF (R4 AND R18).
THE SOUTHERLY RIGHT OF WAY WAS RETRACED BY HOLDING FOUND MONUMENTS #1172 AND #1118 SET IN (R4
AND R18). THIS RESOLUTION FIT WELL WITH THE MAJORITY OF INTERMEDIATE MONUMENTS AND WAS DETERMINED
TO BE THE BEST EVIDENCE AVAILABLE IN LIEU OF OFFSETTING THE RETRACED EAST -WEST CENTER LINE OF SAID
SECTION 4, SOUTH 30.00 FEET. ADDITIONALLY, THIS RESOLUTION FIT VERY WELL WITH A SPLIT OF THE EXISTING
FACE OF CURB. CITY OF BEND AS -BUILT PLAN "CLEAR SKY ESTATES - WILSON AVE PLAN & PROFILE", DATED
2/25/1977, DRAWING NUMBER 8-6 ON FILE WITH THE CITY OF BEND, SHOWS THE FACE OF CURB BEING 24 FEET
NORTH AND SOUTH OF THE WILSON AVENUE CONSTRUCTION CENTER LINE AND THE RIGHT OF WAY BEING 35 FEET
SOUTH OF SAID CONSTRUCTION CENTER LINE. THE CONSTRUCTION CENTER LINE WAS RECREATED FROM THE
EXISTING FACE OF CURB AND OFFSET 35 FEET SOUTH AND FIT WITHIN 0.05' OF THE RETRACED SOUTHERLY RIGHT
OF WAY.
THE RIGHT OF WAY OF WILSON AVENUE, EAST OF THE BURLINGTON NORTHERN SANTA-FE RAILROAD WAS
ESTABLISHED OVER THE COURSE OF SEVERAL DECADES BY NUMEROUS PARTITION PLATS, SUBDIVISIONS AND
DEEDS WHICH ARE NOTED HEREIN. THE EXISTING LOCATION OF THE AS -TRAVELED ROADWAY WAS
CONSTRUCTED IN THE LATE 1970'S AND SHOWN ON CITY OF BEND AS -BUILT PLANS "WILSON AVE - CENTENNIAL ST
TO SE 9TH ST", DATED MARCH 21, 1979, DRAWING NUMBER 4-19; "EASTSIDE BUSINESS AND INDUSTRIAL PARK -
WILSON AVE", DATED SEPTEMBER 20, 1978, DRAWING NUMBER 9-238 AND "KIWA MEADOWS - MANLEY PL, WILSON
AVE", DATED JUNE 27, 1978, DRAWING NUMBER 8-5 ALL ON FILE WITH THE CITY OF BEND. SUBSEQUENT RIGHT OF
WAY DEDICATIONS ALONG THIS CORRIDOR ARE DESCRIBED WITH VARIED WIDTHS, TAKEN AS AN OFFSET DISTANCE
FROM THE EAST -WEST CENTER SECTION LINE AND NOTED HEREIN.
9TH STREET - SOUTH (ORIGINALLY BAER ROAD)
THE RIGHT OF WAY OF 9TH STREET LYING WITHIN THE SOUTHEAST ONE -QUARTER OF SECTION 4 WAS
ESTABLISHED AS BAER ROAD BY DESCHUTES COUNTY ON FEBRUARY 21, 1940 IN COMMISSIONERS JOURNAL 3,
PAGE 509 WITH A RIGHT OF WAY WIDTH OF 60.00 FEET. THE CENTER LINE WAS PLACED BY HOLDING THE FOUND
MONUMENT (#1142) SET IN CS03655 (R10) AS THE POINT OF TANGENCY ON THE EASTERLY RIGHT OF WAY (30.00
FEET FROM CENTER LINE) AT STATION 5+93.10; AND THE FOUND MONUMENT (#1124) SET IN CS03611 (R5) AS A
POINT ON THE WESTERLY RIGHT OF WAY (30.00 FEET FROM CENTER LINE). THE STATION OF 0+00 WAS HELD AT
THE INTERSECTION OF SAID BAER ROAD CENTER LINE AND THE EAST -WEST CENTER LINE OF SECTION 4 AS SHOWN
ON MAP "THE BAER ROAD" 1940 BY WM. B. GILBERT (R2) ON FILE WITH THE DESCHUTES COUNTY ROAD
DEPARTMENT.
9TH STREET - NORTH
THE CENTER LINE OF 9TH STREET LYING WITHIN THE NORTHEAST ONE -QUARTER OF SECTION 4 WAS ESTABLISHED
BY A SPLIT OF THE EXISTING EDGE OF PAVEMENT PER CITY OF BEND AS -BUILT PLAN "CONSTRUCTION OF S.E.
NINTH STREET" DATED MARCH 20, 1980, DRAWING NO.4-17 ON FILE WITH THE CITY OF BEND. A PORTION OF BAER
ROAD LYING WITHIN THE NORTHEAST ONE -QUARTER OF SECTION 4 AS SHOWN ON PARTITION PLAT 1994-26 (R17),
WAS VACATED BY CITY OF BEND ORDINANCE NS-1551 RECORDED DECEMBER 5, 1991 IN VOL 251, PAGE 1490. NO
RIGHT OF WAY VACATION FOR THE REMAINDER OF BAER ROAD WAS FOUND. STATIONING FOR THE CENTER LINE
OF "9TH STREET - NORTH" IS ASSUMED.
THE EASTERLY RIGHT OF WAY LINE WAS WAS ESTABLISHED BY HOLDING THE FOUND MONUMENTS (POINT #1130 &
#1132) SET IN PARTITION PLAT 1994-26.
THE WESTERLY RIGHT OF WAY LINE WAS ESTABLISHED BY BEST FITTING A LINE BETWEEN FOUND MONUMENTS
#1108, #1109, AND #1111 SET IN PARTITION PLATS 2006-08 AND 2017-07.
NARRATIVE (CONTINUED)
15TH STREET - (ORIGINALLY F.A. HUNNEL ROAD)
THE RIGHT OF WAY OF 15TH STREET WAS ESTABLISHED AS F.A. HUNNELL ROAD BY CROOK COUNTY ON MARCH 5, 1908 IN
CROOK COUNTY COMMISSIONERS JOURNAL 4, PAGE 213 WITH A RIGHT OF WAY WIDTH OF 40.00 FEET. THE ORIGINAL PETITION
CALLS FOR THE ROAD TO FOLLOW AS NEAR AS PRACTICABLE THE WEST LINE OF SECTION 3. THE ORIGINAL SURVEYORS
REPORT BEGINS AT THE NORTHWEST CORNER OF SECTION 3 AND HEADS DUE SOUTH WITH THE EXCEPTION OF A JOG TO THE
EAST, NEAR THE WEST ONE -QUARTER CORNER OF SECTION 3, ENDING AT THE SOUTHWEST CORNER OF SECTION 3. OTHER
THAN THE ROAD ITSELF NO PHYSICAL EVIDENCE OF THE ORIGINAL SURVEY WAS FOUND.
THERE SEEMS TO BE A DISCREPANCY OVER THE YEARS AS TO WHETHER THE RIGHT OF WAY WAS 40 FEET OR 60 FEET WIDE.
THE STATUTORY WIDTH OF 60 FEET APPEARS TO HAVE BEEN APPLIED TO THIS ROAD FOR A PERIOD OF TIME AND SOME PLATS
AND DEEDS HAVE BEEN RECORDED UNDER THIS ASSUMPTION. ADDITIONALLY, COUNTY RESOLUTION NO. 1127 DATED
SEPTEMBER 6 1972, TRANSFERRED THE ROAD AND RIGHT OF WAY TO THE CITY OF BEND BETWEEN BEAR CREEK ROAD AND
THE CITY LIMITS (WILSON AVENUE) AND DESCRIBES A STRIP OF LAND 60 FEET WIDE WHICH CENTER LINE BEGINS AT THE
NORTHEAST CORNER OF SECTION 4 AND HEADS SOUTHERLY ALONG THE EASTERLY LINE OF SECTION 4 TERMINATING AT THE
EAST ONE -QUARTER OF SECTION 4. THE JURISDICTIONAL TRANSFER DOES NOT MENTION THE ORIGINAL RIGHT OF WAY OF F.A.
HUNNELL ROAD.
THE CENTER LINE OF 15TH STREET, NORTH OF WILSON AVENUE WAS RETRACED BY A SPLIT OF THE EXISTING FACE OF CURB
AS SHOWN ON CITY OF BEND AS -BUILT PLAN "NEW 12" D.I. WATER MAIN 15TH STREET - WILSON TO TEMPEST" DATED JUNE 19,
1986, DRAWING NO. 28-25 ON FILE WITH THE CITY OF BEND. A REVIEW OF AERIAL PHOTOS GOING BACK TO 1994 SHOW THE
ALIGNMENT FOR THIS SECTION OF 15TH STREET HAS BEEN TRAVELED AND USED IN ITS PRESENT LOCATION FOR AT LEAST 28
YEARS. THE WESTERLY RIGHT OF WAY 15TH STREET, NORTH OF WILSON AVENUE, WAS ESTABLISHED PARALLEL WITH AND
20.00 FEET WESTERLY OF SAID CENTER LINE. THE EASTERLY RIGHT OF WAY 15TH STREET, NORTH OF WILSON AVENUE, WAS
DEDICATED IN THE PLAT CARRIAGE ADDITION NO. II (R3), AS A 30.00 FOOT STRIP PARALLEL WITH THE EAST LINE OF THE
NORTHEAST ONE -QUARTER OF SAID SECTION 4.
THE CENTER LINE OF 15TH STREET, SOUTH OF WILSON AVENUE, IS COINCIDENT WITH THE EAST LINE OF THE SOUTHEAST
