PROHIBITED USES SHALL CONSIST OF, BUT ARE NOT LIMITED TO, PERMANENT STRUCTURES, BUILDINGS INCLUDING PORCHES
AND ROOF EAVES OR COMPONENTS AND APPURTENANCES THEREOF, OR ANY OTHER HORIZONTAL OR VERTICAL
ENCROACHMENT, OBSTRUCTION, EXCAVATION OR ALTERATION OF THE PUE. THE PUE SHALL PERPETUALLY ENCUMBER ALL
AFFECTED PROPERTIES. CITY AND UTILITIES SHALL BE RESPONSIBLE FOR THE MAINTENANCE OF THE UTILITIES AND RELATED
FACILITIES LOCATED WITHIN THE PUE. ALL AFFECTED PROPERTIES AND PROPERTY OWNERS SHALL BE RESPONSIBLE FOR
LANDSCAPE AND SURFACE MAINTENANCE WITHIN THE PUE. CITY AND UTILITIES USE OF THE PUE SHALL NOT UNREASONABLY
INTERFERE WITH OWNERS USE OF ITS PROPERTY. THE CITY AND UTILITIES DO HEREBY AGREE TO DEFEND, HOLD HARMLESS,
