ROBERT M. GREELEE AND FRANCES L. GREENLEE WERE THE PREDECESSOR OWNERS OF THE LANDS. THE SUBJECT PROPERTY WAS ACQUIRED IN TWO PARTS. THE FIRST AND LARGEST PORTION WAS DEEDED TO THE GREENLEES BY W.D. AND BABA LEE BOWERS IN 1967 PER THE WARRANTY DEED RECORDED IN VOLUME 153, PAGE 445 OF DESCHUTES COUNTY DEED RECORDS, AND CONSISTING OF THE NW1/4 NW1/4 SE1/4 AND THE NE1/4 SW1/4 OF SECTION 4, EXCEPTING THE SE1/4 NE1/4 SW1/4 THEREOF. ADJOINING PROPERTY WAS LATER ACQUIRED BY THE GREENLEES FROM THE BOWERSES IN 1982, AS DESCRIBED IN THE STATUTORY WARRANTY DEED RECORDED IN VOLUME 365, PAGE 781, DEED RECORDS OF DESCHUTES COUNTY, AND CONSISTING OF THE SW1/4 NW1/4 SE1/4 AND THE SE1/4 NE1/4 SW1/4 OF SECTION 4, LYING NORTHERLY OF HARRIS WAY (PREVIOUSLY KNOWN AS BABA LANE). OUR BOUNDARY RESOLUTION BEGAN WITH THE BREAKDOWN OF THE RELEVANT PORTIONS OF SECTION 4 INTO 1/16TH ALIQUOT PARTS. AN IRON ROD SET BY BURTON BROTHERS IN 1969 AT THE LOCATION OF AN ORIGINAL STONE MARKING THE WEST 1/4 CORNER OF SECTION 4 WAS RECOVERED IN GOOD CONDITION AND FIRMLY SET IN SOLID ROCK. MICK TYE PLACED A IRON PIPE WITH A BRASS CAP IN A ROCK MOUND OVER THIS IRON ROD AS THE INITIAL POINT OF STONERIDGE IN 1981, BUT UNKNOWN PERSONS HAVE REMOVED THE IRON PIPE MONUMENT AND ROCK MOUND. A BEARING TREE NOTED BY GEORGE COLVIN IN HIS RESTORATION RECORD OF 1987 IS STILL PRESENT IN THE RECORD LOCATION WITH RESPECT TO THE IRON ROD, AND AS SUCH, THE IRON ROD WAS ACCEPTED AS THE MONUMENT MARKING THE WEST 1/4 CORNER. EDGAR GRAVES SURVEYED THE NORTH HALF OF SECTION 4 IN 1978 AND SET MONUMENTS ON THE SOUTH BOUNDARY THEREOF, INCLUDING THE CENTER 1/4, CENTER -WEST 1/16, C-E-W 1/64, THE CENTER -EAST 1/16 AND THE C-W-E 1/64 CORNERS. WE HELD GRAVES' MONUMENTED CENTER 1/4 CORNER, AS HAVE NUMEROUS SUBSEQUENT SURVEYS. THE CENTER -WEST 1/16 CORNER LIES WITHIN HUNNELL ROAD AND WAS NOT FOUND; ITS POSITION WAS CALCULATED BY SINGLE PROPORTIONING. THE MONUMENT SET BY GRAVES FOR THE C-E-W 1/64 WAS FOUND ON THE EAST -WEST QUARTER SECTION LINE, BUT IT IS SUBSTANTIALLY OUT OF POSITION IN EASTING; AS NO ADJACENT PROPERTY OWNERS OR SURVEYS HAVE RELIED ON THIS MONUMENT, WE HAVE REJECTED IT AND USED OUR CALCULATED POSITION INSTEAD. GRAVES' MONUMENT AT THE CENTER -EAST 1/16 CORNER HAS BEEN RELIED ON BY SEVERAL SUBSEQUENT SURVEYS, AND WE HAVE HELD IT ACCORDINGLY. HIS MONUMENT AT THE C-W-E 1/64 CORNER HAS BEEN RELIED UPON BY ADJACENT PROPERTY OWNERS AND SUBSEQUENT SURVEYS, AND WE HAVE HELD IT ACCORDINGLY. GARY HICKMAN SET THE CENTER -SOUTH AND SOUTHEAST 1/16 CORNERS IN HIS 1991 SURVEY OF LANDS SOUTH OF THE SUBJECT PROPERTY, REJECTING ROBERT ARNDORFER'S MONUMENTS PREVIOUSLY SET. WE HAVE ACCEPTED HICKMAN'S MONUMENTS, AS HAVE SUBSEQUENT SURVEYS OF ADJACENT LANDS BY PHILIP BALDNER AND JERRY STICHLER. HICKMAN HELD GEORGE COLVIN'S MONUMENT SET IN 1983 AT THE SOUTHWEST 1/16 CORNER. THIS CORNER LIES WITHIN HUNNELL ROAD AND WAS NOT FOUND; TO CALCULATE ITS POSITION, WE FOUND AND HELD HICKMAN'S MONUMENT ON THE SOUTH 1/16 LINE 30 FEET EASTERLY AS A WITNESS. THE RELEVANT 1/4 AND 1/16 CORNERS NOW BEING ESTABLISHED, WE BROKE THE NE1/4 SW1/4 AND NW1/4 SE1/4 SIXTEENTH SECTIONS DOWN INTO 1/64 ALIQUOT PARTS USING NORMAL METHODS; OUR FULL BREAKDOWN IS SHOWN ON A SEPARATE SHEET IN THIS RECORD OF SURVEY. WITHIN THE NE1/4 SW1/4 AND NW1/4 SE1/4 SIXTEENTH SECTIONS, COLVIN SURVEYED IN 1978 MINOR LAND PARTITION MP-78-84 AND MAJOR LAND PARTITION NO. MJP-78-45. ALTHOUGH NOT EXPLICITLY STATED IN EITHER SURVEY, THE INTENT APPEARS TO BE THAT THE BOUNDARIES OF BOTH PLATS FOLLOW SUBDIVISIONAL SECTION LINES AND THE RIGHT-OF-WAY OF BABA LANE (NOW HARRIS WAY). COLVIN NOTES FINDING SEVERAL MONUMENTS WITHOUT MENTIONING THEIR ORIGIN OR RELATIONSHIP TO ANY LINES OF POSSESSION THAT MAY HAVE EXISTED AT THE TIME; HE MAY ALSO HAVE BEEN UNCLEAR AS TO THEIR ORIGIN. THE PARENT PROPERTY OF BOTH PARTITION PLATS WAS ACQUIRED IN 1970 BY JACK H. BARNES AND MONA G. BARNES FROM W.D. BOWERS AND BABA LEE BOWERS (VOLUME 172, PAGE 379, DEED RECORDS OF DESCHUTES COUNTY). THIS DEED USES ALIQUOT PARTS IN THE DESCRIPTION, AND NO CONFLICT EXISTS WITH OUR CLIENT'S PROPERTY DESCRIPTION. HOWEVER, COLVIN'S MONUMENTATION DOES NOT FOLLOW THE 1/16 AND 1/64 LINES AS RESOLVED BY OUR SURVEY, AND BOTH STICHLER AND HICKMAN ALSO NOTED THE SAME FACT WITH THEIR SURVEYS OF ADJACENT PROPERTIES. WE THEREFORE HAVE REJECTED ALL OF COLVIN'S SET OR REFERENCED MONUMENTATION IN THE ABOVE TWO PARTITION PLATS PURPORTING TO BE THE 1/16 OR 1/64 CORNERS OR FOLLOWING THE LINES THEREOF, AS DID STICHLER AND HICKMAN, ALTHOUGH THESE MONUMENTS MAY STILL BE OF VALUE IN DETERMINING THE INTERIOR DIVIDING LINES OF THE PARCELS CREATED WITH COLVIN'S PARTITION PLATS, WHICH IS OUTSIDE THE SCOPE OF THIS SURVEY. HUNNELL ROAD WAS SURVEYED AND RESOLVED BY J.T. HAGLUND IN HIS 2021 SURVEY, WHICH USED THE CENTRAL OREGON COORDINATE SYSTEM, AS DOES OUR SURVEY. WE USED HAGLUND'S RECORD COORDINATES AND CENTERLINE DATA TO PLOT HUNNELL ROAD ON OUR MAP. AS A CHECK, WE COMPARED THE STATIONING OF TWO MONUMENTS TIED BY HAGLUND NORTH AND SOUTH OF THE AREA OF INTEREST WITH OUR OWN SURVEY DATA AND CALCULATED STATIONING, THE RESULTS OF WHICH MATCHED WELL WITH EACH OTHER. THIS RESOLUTION OF HUNNELL ROAD IS SHOWN ON A SEPARATE SHEET ON THIS SURVEY, AS IS THE RESOLUTION OF HARRIS WAY DESCRIBED BELOW. HARRIS WAY WAS DEDICATED BY THE BOWERSES TO THE PUBLIC IN 1970 IN A ROUTE DESCRIBED IN VOLUME 172, PAGE 115 OF DEED RECORDS, BEGINNING AT BOWERY LANE TO THE SOUTH AND MEANDERING IN A GENERAL NORTHWESTERLY DIRECTION TO HUNNELL ROAD. AS DESCRIBED, HARRIS WAY FORMS BOTH A PORTION OF THE SOUTHWESTERLY BOUNDARY OF THE GREENLEE PROPERTY, AND THEN CROSSES THE GREENLEE PROPERTY TO MEET HUNNELL ROAD. HOWEVER, AS THE DEDICATION OCCURRED IN 1970, THREE YEARS AFTER THE GREENLEES ACQUIRED THEIR ORIGINAL PROPERTY IN 1967, THE DEDICATION HAS NO EFFECT OVER THAT 1967 CONVEYANCE, AND WE DO NOT SHOW THAT PORTION ON OUR SURVEY. THE COUNTY ASSESSOR ALSO SHOWS THIS PORTION OF HARRIS WAY AS A DASHED, RATHER THAN SOLID LINE ON HIS MAPS. MUCH LATER, THE COUNTY DID ACCEPT THE HARRIS WAY DEDICATION IN 2004, EXCEPT FOR THAT PORTION CROSSING THE 1967 GREENLEE PROPERTY; THAT ACCEPTANCE IS RECORDED AS DOCUMENT NO.2004-41598 IN DESCHUTES COUNTY OFFICIAL RECORDS. THE SMALLER PORTION OF PROPERTY ACQUIRED BY THE GREENLEES FROM THE BOWERSES IN 1982 IS, HOWEVER, SUBJECT TO THE BABA LANE DEDICATION, AND THE DEED FOR THAT PORTION STATES THAT THE CONVEYED PROPERTY LIES NORTH OF HARRIS WAY. WE RECOVERED SEVERAL MONUMENTS ALONG THE SOUTH BOUNDARY OF HARRIS WAY AS COLVIN FOUND IN MINOR LAND PARTITION MP-78-84. WE ALSO FOUND SEVERAL MONUMENTS ON THE NORTH SIDE OF HARRIS WAY, NOT FOUND. IN ANY RECORD, THAT CORRESPOND TO THE POINTS OF CURVATURE AND TANGENCY IN THE RIGHT-OF-WAY. IT IS UNCLEAR WHO SET THESE MONUMENTS, BUT IT WAS CERTAINLY A LAND SURVEYOR. TENNESON ENGINEERING SURVEYED ROCK O' THE RANGE HOMESITES TO THE SOUTH FOR THE BOWERSES, AND EDGAR GRAVES NOTES IN HIS 1978 SURVEY TO THE NORTH THAT HE CORRECTED THE MONUMENTS SET BY TENNESON IN 1975, ANOTHER SURVEY OF WHICH WE HAVE NO RECORD OF. WE ALSO HAVE IN OUR POSSESSION A TRANSMITTAL LETTER FROM TENNESON ENGINEERING TO BOB GREENLEE DATED JULY 12, 1967, IN WHICH TENNESON STATES THEY HAVE ENCLOSED A "BLUE LINE PRINT OF ROCK O' THE RANGE HOMESITES WITH THE ADDITION OF THE SURVEY OF BABA LANE" AND A "CURVE DATA SHEET FOR BABA LANE", BOTH OF WHICH NOW APPEAR TO BE LOST. WE FIND IT LIKELY GIVEN THE ABOVE THAT TENNESON ENGINEERING SURVEYED AND MONUMENTED BABA LANE AT SOME POINT, ALTHOUGH IT REMAINS POSSIBLE THAT ANOTHER PARTY DID SO. REGARDLESS, THE EXISTING SURVEY MONUMENTATION ALONG BABA LANE APPEARS TO HAVE BEEN RELIED UPON BY BOTH ADJACENT PROPERTY OWNERS WITH RESPECT TO THEIR DEEDS, AS WELL AS COLVIN'S PARTITIONS. WE HELD UNDISTURBED MONUMENT #20 ON OUR MAP AS THE POINT OF TANGENCY, AND HELD COLVIN'S MONUMENT (#24) BETWEEN TRACTS #2 AND #3 OF MINOR LAND PARTITION MP-78-84 AT RECORD RIGHT-OF-WAY WIDTH TO ESTABLISH THE NORTH TANGENT BEARING. A BENT MONUMENT (#19) WAS FOUND IN CLOSE PROXIMITY TO THIS TANGENT LINE, CONFIRMING OUR RESOLUTION, AND WE HELD THIS MONUMENT FOR EASTING. MONUMENT #25 IS OF UNKNOWN ORIGIN AND WELL EASTERLY OF OUR CALCULATED POSITION, BUT IT MATCHES THE RIGHT-OF-WAY WIDTH ALMOST EXACTLY. WORKING BACK FROM OUR CALCULATED POINT OF TANGENCY AT POINT #21, WE EXTENDED A TANGENT CURVE OF RECORD RADIUS WHICH MATCHED A MONUMENT FOUND AT THE POINT OF CURVATURE SOUTH (#22). WE THEN OFFSET THAT CURVE 60 FEET NORTHEASTERLY. AS SEVERAL MONUMENTS ARE MISSING OR BADLY DAMAGED IN THE MIDDLE OF HARRIS WAY RIGHT-OF-WAY ADJACENT THE SUBJECT PROPERTY, WE MOVED AHEAD TO MONUMENT #28, WHICH WE HELD FOR THE POINT OF CURVATURE. WE THEN STRUCK A BACK TANGENT FROM THE MONUMENT, HOLDING RECORD WIDTH FROM MONUMENT #26 IN ORDER TO ESTABLISH THE TANGENT BEARING. AS THE OVERALL LENGTH BETWEEN MONUMENTS #28 AND #19 IS SLIGHTLY SHORT, WE PROPORTIONED THIS DISTANCE ALONG THE TANGENT AND CURVE, HOLDING RECORD RADIUS FOR THE CURVE. MOVING FORWARD FROM MONUMENT #28 AGAIN, WE PROJECTED A TANGENT CURVE OF RECORD RADIUS, THE LINE OF WHICH ON THE SOUTHERLY SIDE OF THE RIGHT-OF-WAY MATCHED THE MONUMENT #30. HARRIS WAY IS TRUNCATED ON OUR MAP WHERE IT MEETS THE 1967 GREENLEE PROPERTY. THE EXTERIOR LINES AND CORNERS OF THE SUBJECT PROPERTY THUS REESTABLISHED, WE SET A NEW MONUMENTS AT ALL RELEVANT CORNERS WHERE NONE PREVIOUSLY EXISTED. A CONCISE BOUNDARY MAP OF THE SUBJECT PROPERTY THAT EXCLUDES THE SECTIONAL BREAKDOWN AND RIGHT-OF-WAY RESOLUTIONS IS SHOWN ON THE FIRST PAGE OF THIS SURVEY. HARRIS WAY, WHICH IS A PAVED ROAD FROM BOWERY LANE, CHANGES TO GRAVEL APPROXIMATELY AT THE BOUNDARY OF THE 1967 GREENLEE PROPERTY AND CONTINUES WESTERLY TO ITS TERMINUS AT HUNNELL ROAD. FENCES AND OTHER POTENTIAL LINES OF POSSESSION ALONG THE EXTERIOR PROPERTY BOUNDARIES WERE NOT EXAMINED IN DETAIL, BUT APPEAR TO ENCROACH ON OUR RESOLVED PROPERTY LINES AT MONUMENTS #30 AND #31. OUR CLIENT WAS ADVISED OF POTENTIAL UNWRITTEN RIGHTS REGARDING THE ABOVE CIRCUMSTANCES BY THIS SURVEY.
