THE PURPOSE OF THIS SURVEY IS TO REPLAT AND SUBDIVIDE LOT 7, BLOCK 1,
VIEW ACRES (R1) INTO 7 LOTS AS SHOWN. FOR THE NORTH LINE, A 1 /2 INCH PIPE
AT THE SOUTHWEST CORNER OF LOT 8-B (R3) AND A 1 /2 INCH PIPE AT THE
SOUTHEAST CORNER OF LOT C-2 OF RMP 79-036 (R4) WAS HELD AS SHOWN.
THIS LINE WAS EXTENDED TO THE EASTERLY RIGHT OF WAY LINE OF SW 25TH
STREET WHICH WAS HELD BY THE SOUTHWEST CORNER OF LOT 7 BLOCK 1, VIEW
ACRES (R1), A 1 /2 INCH REBAR, AND A 1 /2 INCH PIPE AT THE NORTHWEST

CALIBRATION TIES MULTIPLE COCS POINTS USING PUBLISHED COORDINATES.
THE COCS HORIZONTAL DATUM IS NAD83 (91) AND USES A MOLODENKSY
TRANSFORMATION. THE COCS VERTICAL DATUM IS NGVD 29
PUBLIC UTILITY EASEMENT
THE PUBLIC UTILITY EASEMENT (PUE) SHALL BE USED TO CONSTRUCT AND
MAINTAIN PUBLIC UTILITIES (UTILITIES) INCLUDING BUT NOT LIMITED TO CITY
WATER, SEWER AND STORM DRAINAGE UTILITIES AND GAS, ELECTRICAL,
PHONE AND COMMUNICATIONS SERVICES AND FOR UNRESTRICTED INGRESS
AND EGRESS TO AFFECTED PROPERTIES FOR THE PURPOSE OF INSTALLING,
REPAIRING, TESTING, MAINTAINING, AND REPLACING THE UTILITIES AND
RELATED FACILITIES. THE PUE SHALL BE NON—EXCLUSIVE EXCEPT THAT THE
CITY AND UTILITIES SHALL HAVE THE EXCLUSIVE RIGHT TO CONSTRUCT,
INSTALL, MAINTAIN AND OPERATE THE UTILITIES, THEIR EQUIPMENT AND ALL
RELATED FACILITIES ABOVE AND BELOW GROUND WITHIN THE PUE INCLUDING
THE RIGHT OF ACCESS TO SUCH FACILITIES AND THE RIGHT TO REQUIRE
THE REMOVAL OF ANY OBSTRUCTIONS INCLUDING TREES AND VEGETATION
THAT MAY BE PLACED WITHIN THE PUE AT THE AFFECTED PROPERTY
OWNER'S EXPENSE. PROPERTY OWNERS MAY USE THE SURFACE OF THE PUE
PROVIDED SUCH USE DOES NOT INTERFERE WITH THE CITY'S AND UTILITIES
RIGHTS CONTAINED IN THIS EASEMENT. PROPERTY OWNERS SHALL NOT
PERMIT ANY OTHER USE OR UTILITIES TO BE LOCATED IN THE PUE WITHOUT
THE WRITTEN CONSENT OF THE CITY. APPROVED USES WITHIN THE PUE
SHALL CONSIST OF, BUT ARE NOT LIMITED TO, LANDSCAPING, PAVED
DRIVEWAY OR PARKING AREAS, TRAILS, PATHS, SIDEWALKS OR OTHER USES
THAT WILL NOT AFFECT THE ABILITY OF THE CITY OR UTILITIES TO ACCESS
THE PUE. PROHIBITED USES SHALL CONSIST OF, BUT ARE NOT LIMITED TO,
PERMANENT STRUCTURES, BUILDINGS INCLUDING PORCHES AND ROOF EAVES
OR COMPONENTS AND APPURTENANCES THEREOF, OR ANY OTHER
HORIZONTAL OR VERTICAL ENCROACHMENT, OBSTRUCTION, EXCAVATION OR
ALTERATION OF THE PUE. THE PUE SHALL PERPETUALLY ENCUMBER ALL
AFFECTED PROPERTIES. CITY AND UTILITIES SHALL BE RESPONSIBLE FOR THE
MAINTENANCE OF THE UTILITIES AND RELATED FACILITIES LOCATED WITHIN
THE PUE. ALL AFFECTED PROPERTIES AND PROPERTY OWNERS SHALL BE
RESPONSIBLE FOR LANDSCAPE AND SURFACE MAINTENANCE WITHIN THE PUE.
CITY AND UTILITIES USE OF THE PUE SHALL NOT UNREASONABLY INTERFERE
WITH OWNER'S USE OF ITS PROPERTY. THE CITY AND UTILITIES DO HEREBY
AGREE TO DEFEND, HOLD HARMLESS, AND INDEMNIFY AFFECTED PROPERTIES
AND OWNERS, THEIR SUCCESSORS AND ASSIGNS, FROM ANY CLAIM OF
LIABILITY OR ANY OTHER CLAIM INVOLVING THE UTILITIES, OR ARISING OUT
