THE PURPOSE OF THIS SURVEY WAS TO MONUMENT A PROPERTY LINE ADJUSTMENT
BETWEEN LOTS 4 AND 5, BLOCK 3, REVISED PLAT OF HARRIS ESTATES, PHASE 3
APPROVED BY THE DESCHUTES COUNTY COMMUNITY DEVELOPMENT IN LAND USE
FILE NO.247-23-000309-LL. THE SUBJECT PROPERTY IS LOCATED IN THE NORTHWEST
ONE -QUARTER OF SECTION 15, TOWNSHIP 14 SOUTH, RANGE 13 EAST, WILLAMETTE
MERIDIAN, DESCHUTES COUNTY, OREGON.
DURING THE RESEARCH PORTION AND FIELD EXPLORATION OF THIS PROJECT IT
BECAME EVIDENT THAT SEVERAL ISSUES WERE DISCOVERED IN THE HARRIS
ESTATES, PHASES 1, 2, AND 3 PLATS. THESE ISSUES WERE DISCOVERED SHORTLY
AFTER PLAT RECORDATION AS EVIDENT BY THE FILING
OF "CORRECTED" OR "REVISED" PLATS WITH THE DESCHUTES COUNTY CLERK AND
SURVEYOR SEVERAL MONTHS LATER. THESE ISSUES INCLUDE THE LOCATION OF
N.E. 1 ST STREET AND THE LOCATION OF SOME LOT LINES WITHIN THE PLAT
BOUNDARY.
HARRIS ESTATES, PHASE 3 WAS ORIGINALLY RECORDED WITH THE DESCHUTES
COUNTY CLERK IN VOLUME B OF PLATS AT PAGE 715 ON 12/31/1979 AND FILED WITH
THE DESCHUTES COUNTY SURVEYOR'S OFFICE AS CS07374 ON 01/03/1980. THIS
PLAT CONTAINS ALL THE NECESSARY ITEMS SUCH AS THE DEDICATION AND
ACKNOWLEDGEMENT, SURVEYOR'S CERTIFICATE, JURISDICTIONAL APPROVALS,
WATER RIGHT STATEMENTS, ETC.
SEVERAL MONTHS LATER A REVISED PLAT OF HARRIS ESTATES, PHASE 3 WAS
RECORDED WITH THE DESCHUTES COUNTY CLERK IN VOLUME B OF PLATS AT PAGE
748 AND FILED WITH THE COUNTY SURVEYOR'S OFFICE ON MAY 21, 1980 AS CS07375.
NO DEDICATION, ACKNOWLEDGEMENT, JURISDICTIONAL APPROVALS, WATER
RIGHTS STATEMENT, ETC. ARE SHOWN ON THIS MAP, ONLY THE SURVEYOR'S
CERTIFICATE AND SURVEYOR'S STAMP APPEAR ON THIS MAP.
IN REVIEWING THE DEED RECORDS FOR LOTS 4, 5, 6, 7, 8, AND 9, BLOCK 3 OF HARRIS
ESTATES, PHASE 3, ALL LOTS REMAINED WITHIN OWNERSHIP OF THE DECLARANT
BETWEEN THE RECORDING OF HARRIS ESTATES, PHASE 3 AND THE RECORDING OF
THE "REVISED PLAT OF HARRIS ESTATES, PHASE 3".
LOTS 4, 5, AND 9 VESTING DEEDS REFER TO HARRIS ESTATES, PHASE 3 WHILE THE
VESTING DEEDS OF LOTS 6, 7, AND 8 REFER TO "HARRIS ESTATES, PHASE 3 AS
REVISED....".
IN COMPARING THE DIFFERENCES BETWEEN THE ORIGINAL PLAT OF HARRIS
ESTATES, PHASE 3 AND THE "REVISED PLAT OF HARRIS ESTATES, PHASE 3" AS IT
AFFECTS THE PROPERTY SUBJECT OF THIS LOT LINE ADJUSTMENT (LOTS 4 AND 5,
BLOCK 3), THE BEARING AND DISTANCE SHOWN BETWEEN MONUMENTS ON THE
DIVISIONAL LINE BETWEEN LOTS 4 AND 5 IS SIGNIFICANTLY DIFFERENT AS WELL AS
THE LENGTH OF THE WEST LINE OF LOT 4 FROM THE SECTION CORNER SOUTH TO
THE NORTH RIGHT-OF-WAY LINE OF N.E. 1 ST STREET. HOWEVER, THE SAME
MONUMENTS AND COURSES FOR LOT 5 RUNNING FROM THE NORTHEAST CORNER
IN A CLOCKWISE FASHION AROUND THE LOT TO THE NORTHWEST CORNER
THEREOF REMAINED THE SAME BETWEEN HARRIS ESTATES, PHASE 3 AND
THE "REVISED PLAT OF HARRIS ESTATES, PHASE 3", THIS LEADS ME TO BELIEVE
THERE WAS SOME COMPUTATIONAL ERROR'S IN THE ORIGINAL PLAT OF HARRIS
ESTATES, PHASE 3 AND A PART OF THE REASON A REVISED PLAT WAS FILED. ALL
FOUND MONUMENTS AND OCCUPATION AGREES WITH THE LATER "REVISED PLAT OF
HARRIS ESTATES, PHASE 3". IN REGARDS THE LENGTH OF THE WEST LINE OF SAID
LOT 4, IN PARTITION PLAT 2004-35 BY BAHRKE, HE HOLDS THE DISTANCE OF THIS
LINE AS SHOWN IN THE "REVISED PLAT OF HARRIS ESTATES, PHASE 3" AND ALSO
DEDICATES THE WESTERN PORTION OF N.E. 1 ST STREET RIGHT-OF-WAY ON SAID
PARTITION PLAT. THIS WAS APPROVED BY DESCHUTES COUNTY AND ITS OTHER
DEPARTMENTS WHICH LEADS ME TO THE OPINION THAT THE "REVISED PLAT OF
HARRIS ESTATES, PHASE 3" TO HAVE THE CORRECT LENGTH OF THE WEST LINE OF
SAID LOT 4 AS WELL AS THE NORTH RIGHT-OF-WAY LINE OF NORTHEAST 1 ST
STREET.
WITH THE ABOVE TAKEN INTO ACCOUNT ALONG WITH THE YEARS OF OCCUPATION
AND RELIANCE ON THE LOCATION OF SURVEY MONUMENTS IN THE FIELD ALL IN
AGREEMENT WITH THE "REVISED PLAT OF HARRIS ESTATES, PHASE 3" 1 DECIDED TO
HOLD THE "REVISED PLAT OF HARRIS ESTATES, PHASE 3" AS WHAT WAS INTENDED
TO BE CONVEYED BY THE ORIGINAL GRANTOR.
THE BOUNDARY OF LOT 4, BLOCK 3, REVISED PLAT OF HARRIS ESTATES, PHASE 3
WAS DETERMINED BY HOLDING FOUND MONUMENTS PER THE REVISED PLAT OF
HARRIS ESTATES, PHASE 3.
THE BOUNDARY OF LOT 5, BLOCK 3, REVISED PLAT OF HARRIS ESTATES, PHASE 3,
WAS DETERMINED BY HOLDING FOUND MONUMENT PER THE REVISED PLAT OF
HARRIS ESTATES, PHASE 3. THE SOUTHWEST CORNER OF SAID LOT 5 WAS NOT
FOUND AND REPLACED AT RECORD BEARING AND DISTANCE FROM THE SOUTHEAST
CORNER THEREOF.
THEN ADJUSTED THE LINES AND SET MONUMENTS AS SHOWN AT THE DIRECTION
OF MY CLIENT AND IN ACCORDANCE WITH THE APPROVED LAND USE DECISION.
THE BASIS OF BEARINGS IS N 89°46'51" E ALONG THE NORTH LINE OF
LOT 4, BLOCK 3, REVISED PLAT OF HARRIS ESTATES, PHASE 3 BETWEEN FOUND
MONUMENTS AS SHOWN PER THE REVISED PLAT OF HARRIS ESTATES, PHASE 3,
FILED AS CS07375.
