HomeMy WebLinkAboutSurvey 21349NARRATIVE: THE PURPOSE OF THIS SURVEY IS TO RETRACE THE BOUNDARY AND MONUMENT THE PROPERTY DESCRIBED IN THE PERSONAL REPRESENTATIVE'S DEED RECORDED APRIL 4, 2024 AS INSTRUMENT NO. 2024-08202 IN DESCHUTES COUNTY OFFICIAL RECORDS (B) PER THE REQUEST OF GEORGE AND TONIE BLAIR. THE PROPERTY LEGAL DESCRIPTION ON THE DEED APPEARS TO BE DERIVED FROM A SURVEY BY ROLAND S. ALLMON, FILED AS (A). ALTHOUGH THERE IS NO DATE ON (A), ALL OTHER SURVEYS RECORDED BY ALLMON IN DESCHUTES COUNTY WERE BETWEEN 1962-1967, THEREFORE IT CAN BE ASSUMED THAT THIS SURVEY WAS COMPLETED AROUND THAT TIME PERIOD. PREVIOUS TO 1972, A LICENSED PROFESSIONAL ENGINEER (PE) COULD PERFORM SURVEY WORK IN THE STATE OF OREGON. WHILE ALLMON HAD A PROFESSIONAL ENGINEER LICENSE IN THE STATE OF NEBRASKA (ISSUED DECEMBER 31, 1955), HE WAS STILL IN THE PROCESS OF APPLYING FOR AN OREGON PROFESSIONAL ENGINEER LICENSE WHEN HE PERFORMED (A); HE STAMPED (A) WITH HIS NEBRASKA STAMP AND NOTED "OREGON LICENSE APPLIED FOR". THIS SURVEY WAS ACCEPTED AND FILED BY THE DESCHUTES COUNTY SURVEYOR AT THE TIME, THEREFORE IT IS ACCEPTED AS A CONTROLLING REFERENCE. THE E1/2 OF THE SW1/4 OF SECTION 6 AND THE E1/2 OF THE NW1/4 OF SECTION 7 WERE SURVEYED AND MONUMENTED BY ALLMON IN (A). THE UNITED STATES DEPARTMENT OF THE INTERIOR BUREAU OF LAND MANAGEMENT (BLM) OFFICIALLY FILED A DEPENDENT RESURVEY AND SUBDIVISION OF SECTIONS 6, 7, 18 AND 19 ON SEPTEMBER 6, 2019 (C). DURING THIS BLM SURVEY, THE CORNERS DIVIDING THE SW1/4 OF SECTION 6 AND THE NW1/4 OF SECTION 7 WERE REMONUMENTED (EXCEPT MONUMENT 100 WHICH HAD PREVIOUSLY BEEN REMONUMENTED IN 1982) IN THE SAME POSITION AS SET IN (A) AND ARE SHOWN HEREON. THE WEST LINE OF THE SUBJECT PROPERTY WAS ESTABLISHED ALONG THE WEST LINE OF THE SE1/4 OF THE SW1/4 OF SAID SECTION 6, BETWEEN FOUND MONUMENTS 104 AND 106 AND THE WEST LINE OF THE NE1 /4 OF THE NW1 /4 OF SAID SECTION 7, BETWEEN FOUND MONUMENTS 101 AND 104 PER (C). MONUMENTS 103 AND 105 WERE HELD FOR THEIR NORTHING ONLY AS THEY HAVE BEEN DISTURBED AND DEPARTED FROM THE SUBDIVISIONAL LINES BY THE AMOUNTS SHOWN HEREON. THE BEARING FOR THE EAST LINE OF THE SUBJECT PROPERTY WAS CALCULATED BY HOLDING MONUMENTS 107 AND 108 AND VERIFIED AGAINST THE AS -BUILT CENTERLINE OF THE RAILROAD TRACKS PER (D), WHICH WERE IN HIGH AGREEMENT. SET MONUMENT 'S1' WAS CALCULATED BY HOLDING RECORD DISTANCE PER (A) & (B) FROM MONUMENT 107, ALONG THE CALCULATED BEARING OF THE EAST LINE. THE SOUTH LINE OF THE SUBJECT PROPERTY WAS CALCULATED BY HOLDING A LINE THROUGH MONUMENT 105 AND SET MONUMENT 'S1'. SET MONUMENT 'S2' WAS CALCULATED BY HOLDING RECORD DISTANCE FROM MONUMENT 107, ALONG A LINE PARALLEL TO THE SOUTH LINE. SET MONUMENT 'S3' WAS CALCULATED BY A BEARING/BEARING INTERSECTION BY HOLDING THE BEARING OF THE CALCULATED SOUTH LINE THROUGH MONUMENT 103 AND THE BEARING OF THE CALCULATED EAST LINE THROUGH SET MONUMENT 'S2'. HUNTINGTON ROAD WAS ORIGINALLY ESTABLISHED AS R.H. CALDWELL PER (E). THE CURRENT -DAY ALIGNMENT OF HUNTINGTON ROAD DOES NOT MATCH THE ORIGINAL ALIGNMENT AS DESCRIBED IN (E). IT HAS BEEN COMMONLY ACCEPTED IN CORRESPONDENCE WITH THE DESCHUTES COUNTY SURVEYOR THAT THE RIGHT-OF-WAY FOR HUNTINGTON ROAD SHOULD BE CALCULATED BY HOLDING THE CENTERLINE OF THE AS -BUILT PAVED ROAD AND OFFSETTING 30 FEET EACH SIDE PER (E) WITH A FULL RIGHT-OF-WAY WIDTH OF 60 FEET. SAID RIGHT-OF-WAY IS SHOWN HEREON FOR REFERENCE ONLY AND IS SUBJECT TO CHANGE SHOULD A FORMAL LEGALIZATION BE PERFORMED BY DESCHUTES COUNTY. SURVEY REFERENCES: TAX LOT 211106C000700 (INST.
