EASEMENT SHALL PERPETUALLY ENCUMBER THE PROPERTY. THE CITY SHALL BE RESPONSIBLE FOR THE
MAINTENANCE OF WATER EQUIPMENT AND RELATED FACILITIES LOCATED WITHIN THE EASEMENT.
PROPERTY OWNER SHALL BE RESPONSIBLE FOR LANDSCAPE AND SURFACE MAINTENANCE WITHIN THE
EASEMENT AND ALSO FOR RESTORING ANY ASPHALT, LANDSCAPING, OR OTHER SURFACE

FURTHERMORE, THE PARTIES UNDERSTAND THAT LANDSCAPING AND/OR OTHER SITE IMPROVEMENTS
MAY BE DAMAGED DURING THE CITY'S TESTING OF FIRE HYDRANTS AND RELATED FACILITIES AND THAT
THE PROPERTY OWNER WILL BE RESPONSIBLE FOR REPAIRING THAT DAMAGE. CITY'S USE OF THE
EASEMENT SHALL NOT UNREASONABLY INTERFERE WITH OWNER'S USE OF ITS PROPERTY. THE CITY

NARRATIVE
THE PURPOSE OF THIS SURVEY IS TO PARTITION AND MONUMENT THAT LAND DESCRIBED IN
STATUTORY WARRANTY DEED TO GOODWILL INDUSTRIES OF THE COLUMBIA WILLAMETTE, RECORDED
FEBRUARY 23, 2012 AS VOLUME 2012, PAGE 06153, DESCHUTES COUNTY OFFICIAL RECORDS.
THE BASIS OF BEARINGS IS NORTH 00021'55" EAST ALONG THE WEST LINE OF SAID DEED PER THE PLAT
OF JUSTIN GLEN - PHASE 1, RECORDED JULY 26, 1996 IN PLAT CABINET D, PAGE 237, DESCHUTES
COUNTY PLAT RECORDS.
THE WEST BOUNDARY OF SAID LAND WAS ESTABLISHED BY HOLDING THE FOUND MONUMENT AT THE
SOUTHEAST CORNER OF LOT 76, JUSTIN GLEN - PHASEI AND THE NORTHWEST CORNER OF SAID DEED
VOLUME 2012, PAGE 06153, SET IN (R1).
THE NORTH BOUNDARY OF SAID LAND, WAS ESTABLISHED BY HOLDING THE FOUND MONUMENTS AT
THE NORTHEAST CORNER AND NORTHWEST CORNER SET IN (R1) AND RECORD COURSES CALLED FOR
IN (D2).
THE EAST BOUNDARY OF SAID LAND, BEING COINCIDENT WITH THE WEST RIGHT OF WAY OF NW 6TH
STREET WAS ESTABLISHED BY HOLDING A LINE BETWEEN THE FOUND MONUMENTS AS SHOWN ON
SHEET 2.
THE CENTER LINE OF NW OAK TREE LANE WAS ESTABLISHED BY HOLDING THE FOUND MONUMENTS
SET IN (R2).
THE SOUTH BOUNDARY WAS ESTABLISHED 30.00 FEET NORTH AND PARALLEL WITH SAID CENTER LINE
OF NW OAK TREE LANE.
