THE EMERGENCY ACCESS EASEMENT (EAE) SHALL BE FOR
UNRESTRICTED INGRESS AND EGRESS FOR THE PURPOSE OF
PROVIDING UNOBSTRUCTED EMERGENCY VEHICLE ACCESS TO THE
EFFECTED PROPERTIES. THE PROPERTY SUBJECT TO THE
EASEMENT ARE THOSE AREAS USED FOR TRAVEL BY EMERGENCY

"WHITTED MARKET ROAD" WAS ESTABLISHED ON JUNE 5, 1927 IN DESCHUTES
COUNTY COMMISSIONER JOURNAL 177 AT PAGE 176. SAID ROAD BEGINS NEAR
THE CENTER ONE -QUARTER CORNER OF SECTION 18, TOWNSHIP 15 SOUTH,
RANGE 13 EAST AND TRAVELS GENERALLY SOUTH TO THE INTERSECTION WITH
OLD BEND REDMOND HIGHWAY IN THE SOUTHWEST QUARTER OF SECTION 31,
TOWNSHIP 15 SOUTH, RANGE 13 EAST. BOTH "KIRK WHITTED MARKET ROAD" AND
"WHITTED MARKET ROAD" GENERALLY FOLLOW THE SAME ALIGNMENT.
OF NOTE, THE FIELD BOOK OF THE SURVEY OF "WHITTED MARKET ROAD" ON THE
INSIDE COVER STATES "KIRK WHITTED MARKET RD". THIS LEADS ME TO THE
CONCLUSION THAT THE LATER ESTABLISHMENT WAS MOST LIKELY A CORRECTIVE
ESTABLISHMENT TO AS -BUILT LOCATION OF "KIRK WHITTED ROAD" ESTABLISHED
20 YEARS EARLIER.
TO RETRACE THE "KIRK WHITTED ROAD" ESTABLISHMENT I LOCATED THE
FOLLOWING CORNERS CALLED OUT IN THE ROAD ESTABLISHMENT NOTES AND
ROAD SKETCH: THE NORTH ONE QUARTER CORNER OF SECTION 31, TOWNSHIP 14
SOUTH, RANGE 13 EAST, THE SOUTH ONE QUARTER CORNER OF SAID SECTION 31
THAT IS COMMON TO THE NORTH ONE -QUARTER CORNER OF SECTION 6,
TOWNSHIP 15 SOUTH, RANGE 13 EAST, THE SOUTH ONE -QUARTER CORNER OF
SAID SECTION 6, AND THE WEST ONE -QUARTER CORNER AND SOUTHWEST
ONE -QUARTER CORNER OF SECTION 30, TOWNSHIP 15 SOUTH, RANGE 13 EAST.
I THEN CREATED THE ROAD ALIGNMENT OF "KIRK WHITTED ROAD" USING THE
RECORD COURSES AND DISTANCES AS CITED IN THE ESTABLISHMENT NOTES.
RUNNING THE ROAD FROM THE POINT OF BEGINNING TO THE TERMINUS DID NOT
COME ANYWHERE CLOSE TO CLOSING ON SAID SOUTHWEST CORNER OF
SECTION 30. 1 TRIED SEVERAL DIFFERENT SCENARIOS OF PLACING THE ROADWAY
AT THE AFOREMENTIONED CORNERS. THE BEST FIT I FOUND WAS HOLDING SAID
WEST ONE -QUARTER CORNER AND SOUTHWEST CORNER OF SAID SECTION 30
AND ROTATING THE ALIGNMENT TO MATCH THE MEASURED BEARING. THIS
METHOD GENERALLY FOLLOWS THE CURRENT LOCATION OF HELMHOLTZ ROAD
(WHITTED MARKET ROAD) TO A POINT ROUGHLY 660' SOUTH OF OBSIDIAN AVENUE
AT WHICH POINT IT DIVERGES TO THE EAST. NORTH OF OBSIDIAN AVENUE AND
SOUTH OF HIGHWAY 126, THIS SOLUTION IS GENERALLY PARALLEL WITH AND 60
FEET, MORE OR LESS, EASTERLY OF HELMHOLTZ ROAD (WHITTED MARKET ROAD).
