THE PURPOSE OF THIS SURVEY IS TO REPLAT LOTS 4 AND 5, BLOCK 21, WIESTORIA,
CITY OF BEND, DESCHUTES COUNTY, OREGON, INTO THE MARSHALL COTTAGES
SUBDIVISION, AS REQUESTED BY OUR CLIENT, 635 MARSHALL LLC, AND AS
APPROVED BY THE CITY OF BEND IN FILE NUMBER PLLD20240609.
CONTROL FOR THIS SURVEY IS BASED ON THE SURVEYS OF RECORD REFERENCED
ON THIS PLAT AND THE SURVEY MONUMENTS SHOWN AS HELD AND SET ON THIS
MAP. DAVID CLONINGER FULLY RESOLVED AND MONUMENTED THE BOUNDARIES
OF THE PARENT LOTS IN HIS 2023 RECORD OF SURVEY, HOLDING THE NORTHEAST
CORNER OF LOT 5 AS SET BY JOHN EATON THROUGH AN ORIGINAL LOT STAKE IN
1958, AND THEN SETTING THE REMAINING MISSING CORNERS OF LOTS 4 AND 5.
WE FOUND ALL OF THE AFOREMENTIONED MONUMENTS IN GOOD CONDITION AND
HELD THEM ACCORDINGLY. THE MONUMENTS ON THE COMMON LINE BETWEEN
LOTS 4 AND 5 WERE SUBSEQUENTLY DESTROYED BY CONSTRUCTION AND NOT
RESET, AS THEY ARE NO LONGER RELEVANT TO THE REPLATTED LANDS.
MONUMENTS HAVE BEEN SET BY OUR FIRM AT ALL OF THE NEW LOT CORNERS OF
THE MARSHALL COTTAGES SUBDIVISION PLAT AS SHOWN. FENCES AND RETAINING
WALLS BUILT ALONG THE EAST AND WEST PLAT BOUNDARIES PRECLUDED SETTING
THE ACTUAL INTERIOR LOT CORNERS AT THOSE LOCATIONS, AND THEREFORE
THOSE CORNERS WERE WITNESSED WITH MONUMENTS SET AT THE INTERSECTION
OF THE LOT LINES AND PRIVATE EASEMENT LINES. NO OTHER UNUSUAL
CONDITIONS WERE ENCOUNTERED.

1, CHRISTOPHER R. MUNSON, A PROFESSIONAL LAND SURVEYOR REGISTERED BY
THE STATE OF OREGON, BEING FIRST DULY SWORN, DEPOSE AND SAY THAT I OR
THOSE UNDER MY DIRECT SUPERVISION HAVE CORRECTLY SURVEYED AND
MARKED WITH LEGAL MONUMENTS THE LANDS SHOWN ON THIS SUBDIVISION PLAT
MAP; THAT THE INITIAL POINT IS A 5/8-INCH IRON ROD WITH AN ORANGE PLASTIC
CAP MARKED "MUNSON & ASSOCIATES" AT THE SOUTHEAST CORNER OF THE PLAT
BOUNDARY; AND THE FOLLOWING IS A TRUE AND CORRECT DESCRIPTION OF THE

EASEMENT NOTE
THERE EXISTS A MIDDLE HOUSING LAND DIVISION COMMON SEWER COVENANT PER
INSTRUMENT NO. 2025-19796 OF DESCHUTES COUNTY OFFICIAL RECORDS. THIS
COVENANT ENCUMBERS THE ENTIRETY OF LOTS 4 AND 5, BLOCK 21, WIESTORIA,
CITY OF BEND, DESCHUTES COUNTY, OREGON, AND ALSO REFERS TO SAID LOTS
AS THE "EASEMENT AREA".
DECLARATION
KNOW ALL PERSONS BY THESE PRESENTS THAT 635 MARSHALL LLC, AN OREGON
LIMITED LIABILITY COMPANY, AS FEE OWNER OF THE LANDS DESCRIBED HEREIN,
HAS CAUSED SAID LANDS TO BE SURVEYED AND SUBDIVIDED ACCORDING TO THE
PROVISIONS OF OREGON REVISED STATUTES CHAPTER 92; AND HEREBY RESERVES
THE PRIVATE UTILITY EASEMENTS SHOWN HEREON FOR THE BENEFIT OF THE LOTS
