THE PURPOSE OF THIS SURVEY IS TO REPLAT THAT PORTION OF LOTS 1-3, BLOCK
24, WIESTORIA, CITY OF BEND, DESCHUTES COUNTY, OREGON, AS DESCRIBED IN
THAT STATUTORY WARRANTY DEED RECORDED AS INSTRUMENT NO.2025-11047 IN
DESCHUTES COUNTY OFFICIAL RECORDS, AS REQUESTED BY OUR CLIENT, IAN
MINSKER, AND APPROVED BY THE CITY OF BEND IN FILE NUMBER PLLD20250280.
CONTROL FOR THIS SURVEY IS BASED ON THE SURVEYS AND DEEDS OF RECORD
REFERENCED IN THIS PLAT AND THE SURVEY MONUMENTS SHOWN AS HELD AND
SET ON THIS MAP. BASIS OF BEARINGS FOR THIS SURVEY IS THE CENTRAL
OREGON COORDINATE SYSTEM (DESCHUTESI3 TRANSFORMATION) USING THE
NAD83(2011) EPOCH 2O10.00 REFERENCE FRAME, AS MEASURED USING GNSS
OBSERVATIONS BETWEEN THE MONUMENTS FOUND AT THE SOUTHEAST CORNERS
OF LOT 8, BLOCK 17 AND LOT 6, BLOCK 24 IN THE WIESTORIA SUBDIVISION.
RESEARCH OF DESCHUTES COUNTY CLERK AND ASSESSOR RECORDS INDICATE
THAT LOTS 1-4 OF BLOCK 24 OF WIESTORIA WERE TITLED IN ONE OWNER AS OF
MARCH 7, 1967, PRIOR TO TWO CONVEYANCES BEING MADE LATER THAT YEAR
THAT DIVIDED THOSE LOTS INTO THREE SEPARATE HOLDINGS. THE FIRST
CONVEYANCE AND SENIOR DEED WAS OF THE PROPERTY CURRENTLY VESTED BY
VIRTUE OF INSTRUMENT NO.2025-02835 IN DESCHUTES COUNTY OFFICIAL
RECORDS, DIRECTLY NORTH OF THE SUBJECT PROPERTY; SAID DEED CALLS FOR
THE NORTH HALF OF LOTS 1 & 2 AND THE NORTH HALF OF THE WEST 30 FEET OF
LOT 3. THE SECOND CONVEYANCE AND FIRST JUNIOR DEED IS THAT OF THE
PROPERTY DIRECTLY TO THE EAST OF THE SUBJECT PROPERTY, CURRENTLY
VESTED BY VIRTUE OF INSTRUMENT NO.2019-49999 OF DESCHUTES COUNTY
OFFICIAL RECORDS; SAID DEED CALLS FOR ALL OF LOT 4 AND THE EAST 20 FEET OF
LOT 3, INTRODUCING A POTENTIAL CONFLICT AND JUNIOR -SENIOR RIGHTS
SITUATION. FINALLY, THE VESTING DEED FOR THE SUBJECT PROPERTY CALLS FOR
THE SOUTH HALF OF LOTS 1 & 2 AND THE SOUTH HALF OF THE WEST 30 FEET OF
LOT 3, A MIRROR OF THE SENIOR DEED DESCRIPTION TO THE NORTH; THE SUBJECT
PROPERTY IS THE MOST JUNIOR DEED. L
NO RECORD OF SURVEY FOR THE SUBJECT PROPERTY IN ITS CURRENT DEED
CONFIGURATION WAS FOUND DURING RESEARCH OF DESCHUTES COUNTY
SURVEYOR RECORDS. HOWEVER, BRUCE ROGERS SURVEYED THE ABUTTING
PROPERTY TO THE NORTH IN 1967, AND THE MONUMENT SET AT THE SOUTHWEST
CORNER OF THAT PROPERTY BY ROGERS, ALSO BEING THE NORTHWEST CORNER
OF THE SUBJECT PROPERTY, WAS FOUND INTACT AND HELD AS THE TRUE
INTENDED COMMON WEST CORNER OF THE TWO PROPERTIES. NO MONUMENTS
WERE FOUND AT THE REMAINING THREE CORNERS OF THE SUBJECT PROPERTY.
THE SOUTHWEST CORNER OF THE SUBJECT PROPERTY, ALSO BEING THE
SOUTHWEST CORNER OF LOT 1 OF BLOCK 24, WAS REESTABLISHED BY HOLDING
FOUND MONUMENTS AT THE SOUTHEAST CORNERS OF LOT 8 IN BLOCK 17 AND LOT
6 OF BLOCK 24, AND HOLDING THE RECORD PLAT RIGHT-OF-WAY WIDTH OF 6TH
STREET; THE SOUTH CORNERS OF LOT 3 OF BLOCK 24 WERE CALCULATED BY
PROPORTIONING THE REMAINDER.
THE NORTHWEST CORNER OF BLOCK 24 WAS CALCULATED BY HOLDING THE
SOUTHWEST CORNER OF BLOCK 25 SET BY JIM PERRY AND THE AFOREMENTIONED
NORTHWEST CORNER OF THE SUBJECT PROPERTY SET BY ROGERS, AND HOLDING
RECORD PLAT RIGHT -OF -WIDTH OF PENN AVENUE; THE RESULTANT BEARINGS OF
THE RESOLVED EAST LINE OF 6TH STREET MATCHED WELL GIVEN THE AGE OF THE
SUBDIVISION. THE NORTHWEST CORNER OF LOT 3 OF BLOCK 24 WAS DETERMINED
BY PROPORTIONING BETWEEN THE MONUMENT FOUND AT THE NORTHEAST
CORNER OF LOT 4 AND THE AFOREMENTIONED CALCULATED POSITION OF THE
NORTHWEST CORNER OF BLOCK 24. THE WITNESS MONUMENT SET BY ROGERS AT
THE NORTHEAST CORNER OF THE SENIOR DEED PROPERTY TO THE NORTH WAS
FOUND, BUT WAS DISTURBED AND UNUSABLE DUE TO THE GROWTH OF A NEARBY
PONDEROSA PINE OVER THE LAST 50+ YEARS, PUSHING IT OUT OF POSITION.
THE NORTHEAST CORNER OF THE SUBJECT PROPERTY WAS THEN DETERMINED
HOLDING THE RECORD SENIOR DEED DISTANCE OF 30 FEET FROM THE WEST LINE
OF LOT 3 AT A POINT EXACTLY HALFWAY BETWEEN SOUTH RIGHT-OF-WAY LINE OF
PENN AVENUE AND THE NORTH RIGHT-OF-WAY LINE OF THE PUBLIC ALLEY. AS THE
RESOLVED WIDTH OF LOT 3 IS DEFICIENT FROM THE RECORD PLAT WIDTH,
HOLDING THE 20 FOOT WIDTH FROM THE EAST LINE OF LOT 3 WOULD INTRODUCE A
SMALL JOG IN THIS CORNER AREA. WE FIND THAT THIS WAS NOT THE INTENT OF
THE ORIGINAL GRANTOR OR GRANTEE WITH RESPECT TO BOTH THE LEGAL
DESCRIPTIONS OF ALL ADJOINING PROPERTIES AT THIS CORNER, AS WELL AS
RICHARD HANKINS' 1967 SURVEY OF LOT 4 AND THE EAST 20 FEET OF LOT 3, IN
WHICH HE SHOWS THIS CORNER AS ON THE COMMON LINE WITH NO JOG. WE HAVE
THEREFORE USED ONLY OUR REESTABLISHED NORTHEAST CORNER DESCRIBED
ABOVE AS THE COMMON CORNER TO ALL THREE PROPERTIES, WHICH RESPECTS
SENIOR -JUNIOR DEED RIGHTS.
FINALLY, THE SOUTHEAST CORNER OF THE SUBJECT PROPERTY WAS ESTABLISHED
BY HOLDING THE FIRST JUNIOR DEED RECORD DISTANCE OF 20 FEET FROM THE
SOUTHEAST CORNER OF LOT 3. THE SUBJECT PROPERTY BOUNDARY THUS BEING
FULLY RESOLVED, WE SET MONUMENTS AT THE PLAT BOUNDARY AND NEWLY
CREATED LOT CORNERS WHERE NONE PREVIOUSLY EXISTED. A FENCE LIES
WESTERLY OF THE EAST LINE OF THE SUBJECT PROPERTY, AND OUR CLIENT
INTENDS TO RELOCATE THIS FENCE IN CONJUNCTION WITH THE PROPERTY OWNER
TO THE EAST ON THE NEWLY RESOLVED AND MONUMENTED LINE. NO OTHER
