MINUTES
DESCHUTES COUNTY HISTORIC LANDMARKS COMMISSION
DESCHUTES SERVICES CENTER
1300 NW WALL STREET , BEND , OREGON , 97701
MAY 6, 2013 – 5:30 P.M.
I. CALL TO ORDER
Chairman Stenman called the meeting to order at 5:30 p.m. Members present were Chris
Horting-Jones, Bill Olsen, Sharon Leighty, Kelly Madden, Ray Solley, Dennis Schmidling,
Rachel Stemach, and Broc Stenman. County staff present were Nick Lelack, Planning
Director, Peter Gutowsky, Principal Planner, and Cynthia Smidt, Associate Planner.
Commissioner Leighty motioned the deferment of the election of officers until the August 5
meeting until which time the current officers will maintain their current positions. Second
by Commissioner Horting-Jones and approved unanimously. Election of Officers was
deferred to the August 5 meeting.
II. PUBLIC COMMENTS
Terry Holtzapple, Archaeologist with the Bureau of Land Management (BLM), presented
and answered questions regarding the idea of establishing signage at the Tumalo Dam
historic site. The signage would bring attention to the fact that it is recognized as a historic
resource with both the County and the BLM. Staff suggested Ms. Holtzapple begin with
the County Road Department since the sign will likely go in the road right-of-way.
Chairman Stenman requests staff to keep the Commission updated on this proposal.
III. PUBLIC HEARING: DR-13-6, Declaratory Ruling Cline Falls Power Plant Declaratory
Ruling – Cynthia Smidt
Chairman Stenman read the opening statement for this de novo hearing. In regards to
conflicts of interest, the Commissioners had none to declare. There were no challenges
from the audience. Cynthia provided an overview of the item, through a PowerPoint
presentation. Laurie Craghead, County Assistant Legal Counsel, emphasized to the
Commission that the interpretation sought is not whether the site should have been
designated but what of the site was designated as a historic resource.
Testimony:
Liz Dickson, attorney, testified on behalf of Central Oregon Irrigation District (COID), the
property owner. Ms. Dickson and COID argue that the historic resource Submitted into the

record was Black Rock Consulting’s survey of the existing Cline Falls dam. Based on this
survey, Ms. Dickson requests the Commission to reconsider the statement in the Staff
Report regarding the age of the dam. Ms. Dickson submitted information into the record
regarding the Oregon Land Use Board of Appeals (LUBA) case of Paulson v. Washington
County.
Mark Sturtevant, managing director of hydro resources, testified on behalf of PacifiCorp.
John Sample, attorney, also testified on behalf of PacifiCorp.
Staff, Nick Lelack and Peter Gutowsky provided testimony. Peter provided a general
overview regarding ordinances and the relationship with the Economic, Social,
Environmental, and Energy (ESEE) Analysis.
Discussion: Commissioner Horting-Jones asked PacifiCorp a question regarding the
Historical Research Associates report by Natalie Perrin. Monte Garrett with PacifiCorp
noted that Natalie Perrin did not do a site visit to the property. Her report is based on her
document research. Commissioner Madden asked about the stairway and insulation on
the property. Mr. Garret and Mr. Sample responded. Discussion ensued with
Commissioners and staff.
Chairman Stenman recommends the oral record of the hearing be closed and the written
record will remain open for additional comments. Deliberations will be made at another
meeting. Commissioner Leighty motioned to close the oral record of the hearing and for
the written record to remain open for seven days for new comments (end May 13) and an
additional seven days (end May 20) for rebuttal comments. Second by Commissioner
Olsen and approved unanimously.
IV. CERTIFIED LOCAL GOVERNMENT GRANT UPDATES – Peter Gutowsky and Cynthia
Smidt
Historic Preservation Month – Peter provided an update regarding the letters sent to
property owners of Goal 5 and National Registered properties.
Photo Project – Peter indicated that staff has not contacted Mary Alice Willson but will
begin the process this month. Cynthia suggested the subcommittee meet with staff to help
get the project going. Cynthia indicated that the grant incorporated the volunteers (e.g.
commissioners) to perform research on the designated properties.
Petersen Rock Garden – Cynthia provided an update regarding the issues revolving with
the historic resource, including the recently submitted code enforcement compliant.
Regarding the national nomination, Diana Painter from the state office did do a site visit to
the property. Discussion ensued with Commissioners and staff.
Request for Proposal (RFP) – Peter provided an update regarding the reconnaissance
level survey aspect of the CLG grant. Peter asked for feedback on the RFP proposal
requires. Discussion ensued regarding the RFP, CLG grant, and other topics. An RFP
review subcommittee was created, which includes Chairman Stenman and
Commissioners Stemach and Madden. Staff will also work with State Historic
Preservation Office (SHPO) to customize the RFP proposal. Once the subcommittee and
SHPO are satisfied with the proposed RFP, staff will initiate the RFP without additional
Commission review. The Commission agreed that grant monies from the reconnaissance

level survey should be reallocated to the photo project and educational aspects of the
grant. Staff will work with SHPO to amend the grant. The photo project will have a kick-
off event inviting the photographers and property owners. Chairman Stenman requested
an update at the next meeting.
V. COMMUNITY DEVELOPMENT DEPARTMENT (CDD) DRAFT ANNUAL WORK
PROGRAM – Nick Lelack
Nick reviewed the draft CDD 2013 Annual Report with the Commission. Discussion ensued.
Chairman Stenman suggested that HLC projects be listed as sub-bullets in the report
VI. COMMISSION / STAFF COMMENTS
Cynthia mentioned that Oregon Department of Transportation (ODOT) is requesting
comments regarding the Highway 97 Bend North Corridor Project. There is one national
historic resource, Rock O’ Range Bridge in the area. Chris Bell with ODOT will attend the
next meeting to discuss the project.
In conjunction with Historic Preservation Month, the Deschutes Land Trust will have a
history hike on Tuesday, May 14 at the Camp Polk preserve and historic site.
Commissioner Madden will be co-leading the hike from 3:00 to 5:00 p.m.
Commissioner Schmidling asked, and Peter responded, for clarification regarding
“conflicting use determination” as used in ESEE Analyses.
Chairman Stenman requests that past meeting minutes be completed by the next meeting.
The Commission agreed that the next meeting would be Monday, June 24, 2013.

There being no further business, the meeting was adjourned.
