Staff: Nick Lelack, Todd Cleveland and Peter Gutowsky, 1. INTRODUCTION Peter and Nick welcomed everyone and recapped the agenda. Committee members asked the following:  Where is the Pine Forest Development, LLC representative? Peter spoke with Steve Hultberg, a land use attorney representing Pine Forest and extended an invitation to today’s meeting. Steve also received a packet in the mail.  How many PRCs or TDCs are from County owned properties? Todd stated that for the TDCs, research would need to be performed to verify property transactions. Regarding PRCs, no County properties were involved.  How did Pahlisch acquire PRCs? Staff and Chad Bettesworth acknowledged that some TDCs came with the purchase of Quadrant 2c. 2c is Crescent Creek. County owned properties, acquired through foreclosure received restrictive covenants and were then made available to Pahlisch.  When did Pahlisch and Vic Russell purchase their properties? Pahlisch received tentative plat approval for a 107 lot subdivision in 2004 (Quadrant 2c). Vic Russell purchased property from the Baldwin-Herdon Trust in October 2005. According to Chad, twenty-six lots remain. Pahlisch owns Quadrant 2b which consists of approximately 100 lots.  Are there areas in southern Deschutes County that do not require ATTs? Yes. Newberry Estates, Wild Meadows, Section 36 and Haner Park do not require ATTs.  When were rebates made available? The rebate program started in 2012, following the recession. Only about 61 properties have received rebates to date. Three to 4 are in process.  How many systems were updated with assistance? Approximately 68 systems have been updated. 2 2. AUGUST 21 MEETING RECAP Peter acknowledged the meeting recap from August 21. There were no comments. 3. ACCOMPLISHMENTS OF TDC/PROC PROGRAM TO DATE Todd provided a handout summarizing the nitrogen loading reduction to date. REVISITING POLLUTION REDUCTION CREDIT APPROACH Chad discussed Pahlisch’s position. They see the Neighborhood Planning Area as 3 groups:  Quadrant 2 is the Pahlisch/County quadrant with tentative plat approval.  Vic Russell represents Quadrants 1a, b, and d.  Neighborhoods 3 & 4 are owned by the County. Pahlisch is interested in fixing the groundwater problem and believe the current program will create value to taking nitrates out of the groundwater. Pahlisch has the credits needed (PRCs) for the quadrant it owns, 2b. The cost burden is approximately $25,000.00. Chad expressed reservations about another developer coming in and not having the same burden as Pahlisch. Is it preventing land from being developed? Probably, but the land/housing market in La Pine is not ready. Pahlisch currently has twenty-six lots that are shovel ready in Crescent Creek. They are not attracting interest. Does the system work? Not today, but it did not work last year either. If one looks at the past and where it may go... it may. It likely covers the cost of the lot. The PRC program today is not going to just take off. Economy is getting closer, but it is not there yet. Vic Russell is in a different situation. He bought during the transition period between the TDC and PRC program. Pahlisch feels that Vic's situation is between him and Deschutes County. Pahlisch supports Vic working with the County to get it going. Pahlisch is committed to some reasonable proposal that leads to an equitable solution. It should be fair. Pahlisch believes long-term that the program can work.
