MINUTES
DESCHUTES COUNTY PLANNING COMMISSION
DESCHUTES SERVICES CENTER
1300 NW WALL STREET, BEND, OREGON, 97701
MARCH 10, 2011 —5:30 P.M.
I. CALL TO ORDER
Meeting was called to order at 5:30 p.m. by Chair Merle Irvine. Members present were:
Vice Chair Chris Brown, Ed Criss, James Powell, Bill Rainey, Todd Turner, and Richard
Klyce. Staff present were Nick Lelack, Planning Director; Peter Gutowsky, Principal
Planner; and Sher Buckner, Administrative Secretary.
II. PUBLIC COMMENTS
None.
III. DISCUSSION: Regional Economic Opportunity Analysis — Nick Lelack, Planning
Director.
Peter gave a PowerPoint presentation about the REOA. The Commissioners, Peter and
Nick discussed the process and timelines. Vice Chair Brown wondered if most of the
activity would be limited to the cities and urban centers. Nick said our role does include
coordinating management of regional supply and demand, so a supply is available to the
City of Bend. Obstacles in the quality of education in Oregon were discussed.
IV. WORK SESSION: Draft Planning Division Work Plan — Nick Lelack, Planning
Director.
Nick said planning staff will be taking on Historic Landmark Commission duties, reviewing
legislation on a continuing basis. The three major projects will be the South County
Community Plan, implementing the Big Look, and the Goal 5 Inventory update. There are
more pending projects than we have the capacity to take on this year. At this point, we are
anticipating a reduction in the amount we receive in General Fund support. For non -
Union -represented employees, salaries will be on hold. Dave Kanner would like all staff to
go back to a 40 -hour work week after three years on 36. Chair Irvine asked if we can
handle the "required" items at our current staffing level. Nick said that so much depends

on how far we get with the "required" work plan items. We should be able to accomplish
all of them and hopefully the "priority" items as well. Commissioner Turner and Nick
discussed the determinations. Nick also said the work session with the Board will be on
April 14. If the Planning Commission has any recommended changes to the Board, we
will pass them on.
Nick said that one of Dave Kanner's messages to CDD was to focus on quality over
quantity. Commissioner Criss and Nick discussed the South County plan and whether the
residents could help. Nick said that as of now, we are not putting in placeholders for a
consultant, mailings, etc. If those are determined to be necessary, we will go back to the
Board. Commissioner Criss said the community is already working with professional
planners. Nick spoke about the recent LUBA decision on destination resorts and said that
we will be moving forward. Peter Gutowsky has scheduled a work session with the Board
on April 6.
V. PLANNING COMMISSION & STAFF COMMENTS.
Nick said that on March 16, the Board will conduct work sessions on the Deschutes
Junction policies and on a declaratory ruling on the Fagen property. On March 29, the
Board will kick off hearings on the Comprehensive Plan Update, the first of which is in
Bend; then on March 31 in La Pine; and on April 5 in Sisters. On April 6, the first item on
the agenda will be the event venue ordinance. Nick said he would like to provide the
Commissioners with audio copies of the recent hearings officer hearing on wineries.
Incidental sales and services cannot exceed 25% of the gross winery sales. In this case,
there is a planted 15 -acre vineyard. The law says the winery either has to have its own
grapes or purchase grapes from a contiguous vineyard. But there is another clause that
says as long as someone has a 15 -acre vineyard planted, this meets the requirement.
There are still questions such as what if the grapes on five acres die? How does the
County go about monitoring the 25%? The Grossman property already has weddings
booked at $4500 each, so how do the numbers come out? The right to farm was raised —
the farmers have the priority to do whatever they want to do. Commissioner Klyce
mentioned the easement on the road and asked whether it gave rights to guests. Nick
said that the hearings officer felt guests were included, and the issue of "customers versus
guests" was discussed. Commissioner Criss asked if the 25% is a State requirement and
Nick confirmed that it is.
Peter Gutowsky spoke to the Commissioners about a review of the local wetland
inventory, which will be approved by the Department of State Lands in March. Once
approved, it becomes officially a part of the statewide inventory. There is no ability to
change the local wetland inventory once the State approves it. He needs to amend the
Comprehensive Plan to recognize this inventory. He still needs to have the
Commissioners review it, perhaps in a work session, and there would be a minimum of
one hearing before the Board. Do the Commissioners want their own hearing? They
agreed it was not necessary. Chair Irvine asked Peter to provide the Commissioners with
a copy of the final draft.
Commissioner Rainey suggested that someone should be able to answer questions about
the financial disclosure requirement for the Planning Commissioners.

Peter discussed the LUBA decision on destination resorts, in which the County prevailed
on all counts. The decision can be appealed to the Court of Appeals, but this does not
appear likely based on the statements made by LUBA in its decision.
