I. CALL TO ORDER Meeting was called to order at 5:30 p.m. by Chair Bill Rainey. Members present were Vice Chair Chris Brown, James Powell, Todd Turner and Matt Lisignoli. Absent: Hugh Palcic and Ed Criss. Staff present were Nick Lelack, CDD Director; Peter Gutowsky, Principal Planner; and Sher Buckner, Administrative Secretary. Minutes of May 23, 2013 were approved. II. PUBLIC COMMENTS None. III. PLANNING PROJECT UPDATES Large Lot Industrial Lands Program — Peter Gutowsky, Principal Planner. Peter discussed the status of this program and affected sites. There may be a proposal for an urban growth boundary amendment some time this winter. Commissioner Powell thought that there wasn't going to be pressure to generate industrial lots if there were already properties with urban area reserves, but it seems like we are looking at annexation outside the city. Does this jeopardize the whole program and the shot that DLCD gave the area for regional planning? Peter said it relates to SB1544 and our staff has talked to DLCD about it; if Redmond is strategic about SB1544, they can get upzoned for local industrial uses once the alternative mobility standards being negotiated with ODOT are reconciled. If there are no willing property owners who want to maintain a large -lot industrial zone for ten years, and if other rigid requirements are added, the process will continue. Bicycle Guide — Peter Russell, Sr. Transportation Planner. There are about 20 routes on our website that do not match up with County maintained roads, so we are updating our suitability guide on the website to show suggested routes. This will save costs on printing brochures and people will be able to use the site from smartphones and PC's. We worked with the Bike -Ped Advisory Group to show the most suitable bikeways and designate them by the amount of traffic each day. We have a free program that will also show information about the routes, shoulder widths, photos of what the ride looks like, elevation gains and topography. Newberry Country: A Plan for Southern Deschutes County — Nick Lelack, CDD Director, and Peter Gutowsky, Principal Planner. The Plan was adopted by the Board, but we did receive an appeal from an absentee landowner in Corvallis. She owns a high -groundwater lot south of Sunriver and will be representing herself at LUBA. Nick said he met with the Upper River Deschutes River Coalition about projects they would like to begin to move forward. Bend Airport Master Plan Update — Peter Russell, Senior Transportation Planner. Peter gave a Power Point presentation regarding the airport. The FAA governs airport planning and future operations considerations, with master plan updates required every 20 years. They consider takeoff/landing volume, local versus pass-through passengers, and many other factors. The mix of aircraft will stay the same for now at the Bend Airport. The City owns the airport but the County controls the zoning. There has been extensive outreach to neighbors to get input for an agreed-upon vision. The east side of the airport is slated for more development, and helicopter operations will be moved there so that helicopter and fixed -wing aircraft are separated. Longer runways are also needed due to our elevation. The City currently does not have staff to do the airport update, so the County submitted a scope of work about three weeks ago to be the land use consultant, with the exception of the traffic study. We estimated about $35,000 and have not heard back yet. We discussed with the City having just one entity owning the airport and administering the Code, but it was determined that it was better to keep these responsibilities separate. Commissioner Powell suggested that Leading Edge's flight training activities be considered — they are doing night operations and flying too low over residential areas. Peter said that the airport has instituted a "fly friendly" campaign and is trying to soften the interaction with the neighbors. There are "decibel contours" on the master plan showing areas where, for example, the noise has to be kept to 65 dB, but all of the airport's neighbors do not live in those areas. Planning Division Work Plan for 2013-14 — Nick Lelack, CDD Director. The Board conducted the public hearing and approved the work plan on June 5. We may be able to look at livestock limitations in the fall as we add another long-range staff member. Several people have requested that the July 25 joint Planning Commission/Board meeting be moved from the SHARC to the La Pine High School, and we are looking into that. We expect to receive the City of Sisters UGB airport expansion application in a couple of weeks which will be going to a hearings officer. We have withdrawn our application for a grant to work on the Deschutes River Woods plan due to the City applying for grant assistance in siting an OSU campus, and we do not want to compete with them. We may have the resources to begin working on a plan for Deschutes River Woods but will have to see. There have been some significant horse shows on Cline 2 Falls Road and we considered what is required and allowed. The County amended its definition of "farm use," including horse events, in 1964. It was very wide open and allowed any type of horse event. County Counsel also said no outdoor mass gathering permit was needed. There was a Code complaint filed and the attorney found out that horse events in EFU were redefined in 1965 as being oriented toward K-12 education. We asked the Board to update our definition of use so it is consistent with State law and to add horse events/shows to the agritourism definition, so under a limited use permit they would be allowed up to six events per year. The Board agreed to look at the horse event/agritourism definition and we met with the applicant. It gets complicated, and there will be at least one text amendment application coming before the Planning Commission. The Sisters Rodeo and J Bar J, for example, were approved under different permits. Legislative Update — Nick Lelack, CDD Director. Nick submitted a summary of 2013 Legislation — bills passed and signed by the Governor and also showing which ones would require us to amend our Code. IV. SUMMER SCHEDULE: Nick Lelack, CDD Director. We had talked about moving our August meeting back a week for a tour and retreat on August 29 rather than August 22; we could also move it to September 5. Chair Rainey said he would like to able to attend but will be gone through the end of August. Nick will check with the two Commissioners who were absent this evening. V. PLANNING COMMISSION & STAFF COMMENTS Commissioner Powell has been reappointed to a three-year term because Commissioners cannot serve more than ten years, whether or not they are consecutive, and he has been a Commissioner before. Commissioner Criss has been reappointed to a four-year term. We also received another appeal to LUBA for the Simpsons' elk farm off Lower Bridge Road. The key issue is going to be what "principally engaged in agriculture" means. They have farm dwellings on the property and a principal residence, and the question is whether all of the people in these dwellings are "principally engaged in agriculture." Commissioner Brown asked whether elk are considered livestock, and Nick said he thought so but wasn't sure. The Board would like a work session on July 10 at 1:30 to prepare for the joint meeting with the Planning Commissioners on July 25. Nick also summarized the recent LUBA decision regarding the Thornburgh conceptual master plan. VI. ADJOURN There being no further business, the meeting was adjourned.
