MINUTES
DESCHUTES COUNTY PLANNING COMMISSION
DESCHUTES SERVICES CENTER

JUNE 12, 2014 — 5:30 P.M.
I. CALL TO ORDER
Meeting was called to order at 5:30 p.m. by Chair Christen Brown. Members present were
Vice Chair Hugh Palcic, Steve Swisher, James Powell and Todd Turner. Absent: Ed
Criss, Matt Lisignoli. Staff present were Nick Lelack, Planning Director; Will Groves,
Senior Planner; Paul Blikstad, Senior Planner; and Sher Buckner, Administrative
Secretary.
Minutes of May 8, 2014 were approved.
II. PUBLIC COMMENTS
None.
III. WORK SESSION: TA -14-4 - Legislative Text Amendment to DCC Chapters _19—.0-4-an—d-
19.106
9.04and19.106 to change the required rental availability of individually owned overnight lodging
units for destination resorts within the Bend Urban Area Reserve from 45 to 38 weeks per
calendar year, to amend the phasing of overnight lodgings required in the first phase of
resort development, and to make other changes consistent with state law — Will Groves,
Senior Planner
Will discussed the proposal and gave a PowerPoint presentation. Chair Brown asked
about the 38 -week change. Will said it was a change from 35 weeks, possibly because
the units would be more attractive to investors with more time available for families who
rent during the summer. Chair Brown also asked if the parcels are tracked individually or
can an owner of five units do an average; Will said it is separate for each unit.
Commissioner Turner asked for more information about the plat designations and deed
restrictions — if a person buys a unit for five years and retires, how can they make it a
residence? Also, how is "unit" defined in this situation — by bedrooms, lock -off units, etc?
Will said it has been an ongoing discussion for the County, and what we settled on is a
bedroom, bathroom and separate lock. In Caldera, they built what looked like houses but
they lock off into separate units. This text amendment is limited specifically to the number
of weeks the units are available, however. The largest section that is changing is the one
for reporting requirements. Commissioner Turner asked how often the destination resorts
report this information, and Will said it is annually. Commissioner Powell asked about
differences between Titles 19 and 18. Will said the applicant's proposal was to change
certain sections and other things came up — flood plains are not in there possibly because
they do not affect these properties, for example. Commissioner Powell and Will discussed
reporting requirements. Nick added that this has been in the press, too, and the practical
effect will be that it only applies to Tetherow.
IV. WORK SESSION: TA -14-2 — Legislative Text Amendment to amend DCC 18.32.030 to
add new manufactured home parks as a conditional use, and also amend DCC 18.128.150
to delete item "Q" — Paul Blikstad, Senior Planner
Paul discussed the application and presented PowerPoint slides. Commissioner Turner
wondered why this text amendment is needed, if a new manufactured home site is allowed
in the MUA-10 Zone now. Paul said it is because this is a new park (Goal 15 exception),
not an expansion. Nick added that for an existing park to expand, the entire park has to
be brought up to current standards; a new park has to comply with current standards and
codes. This morning at a meeting at the Riverhouse for the state of the County, one of the
issues that came up is affordable housing. This could be an example of how government
can be a partner in finding a solution. Commissioner Turner asked if the process would be
to do a lot line adjustment to make this a single parcel so it is not an expansion. Paul said
yes.
Chair Brown and Paul discussed the applicant representing property owners; this is a text
amendment and legislative, so it does not require property owner signature.
Commissioner Powell and Paul spoke about expansion within a given parcel and applying
to expand within the MUA-10 Zone, if you are adjacent to the parcel. Commissioner
Powell asked how this addresses the affordable housing issue. We don't want to open all
of MUA-10 to this, so this text amendment would be a minor part of the issue.
Commissioner Powell asked if there are any incentives that would indicate to a City like

wants to do this — can he do it for this use, rather than conventional housing? There is
nothing to prevent this from being used elsewhere. Nick said another topic of discussion
at this morning's meeting was looking at incentives to provide affordable housing. We
could also discuss other alternatives in the Code, since this is legislative.
Commissioner Turner asked if there was an agreement between the City and County
about adjacent lands — Nick said we have an intergovernmental agreement regarding the
Urban Reserve which requires coordination. Commissioner Turner and Nick discussed
the applicant participating in the Urban Growth Boundary process for the City of Bend.
They have hired a consultant and expect to finish by April of 2016.
V. PLANNING COMMISSION & STAFF COMMENTS
Nick said that there will be an agricultural lands discussion with the Board in two weeks.
We would like to open it up for public comments after the presentation. Commissioner
Swisher asked if we would be discussing the work plan, and Nick said we could add it to

the agenda. It is on the Board's agenda for next week and they may or may not approve it
right away. Nick discussed the high groundwater lots in South County that were
designated as non -developable, somewhere between 1200-1800 lots. If we do a Goal 11
exception, a traffic analysis must be done on the impact for these lots.
Nick also discussed re -convening the Transferable Development Credit committee, which
redirects growth in La Pine and/or assists with septic systems. The Harper Bridge boat
launch issue is still pending and a committee will convene.
Commissioner Powell and Nick discussed events at vineyards and restrictions under State
law. Also, Principal Planner Kevin Harrison has announced his retirement after 24 years
at the County. We will be consolidating the two Principal Planner positions into one
Planning Manager position for Peter Gutowsky and hiring another senior planner.
